the cost of tender documents as <strong>in</strong>dicated above <strong>in</strong> Para 2.1.2 will have to bedeposited by the tenderer <strong>in</strong> the form of a bank draft payable <strong>in</strong> favour ofDy.FA&CAO/IRPMU, Shivaji Bridge, New Delhi along with the tenderdocument. This should be paid separately not <strong>in</strong>cluded <strong>in</strong> the Earnest Money. Incase, tender is not accompanied with the cost of the tender documents asdetailed above, tender will be summarily rejected.2.1.3 These tender documents must be submitted duly completed <strong>in</strong> all respects <strong>in</strong> asealed cover super-scribed as tender form for the work “As on Top Sheet” andshould be deposited <strong>in</strong> the tender Box <strong>in</strong> the office of the Chief Adm<strong>in</strong>istrativeOfficer/IRPMU, Shivaji Bridge, New Delhi on or before 15.00 hours on26/03/2009. The tenders will be opened immediately soon thereafter and ratesread out <strong>in</strong> the presence of such tenderer/s as is/are present. <strong>Tender</strong>s which arereceived after the time and date specified above may not be considered. In case the<strong>in</strong>tended date for open<strong>in</strong>g of tenders is declared holiday, the tenders will be openedon the next work<strong>in</strong>g day at the same time.2.1.4 <strong>Tender</strong>s sealed and super-scribed as aforesaid can also be sent by registered postaddressed to the Chief Adm<strong>in</strong>istrative Officer/IRPMU, Shivaji Bridge, New Delhion or before 15.00 hrs. on 26/03/2009, but a tender which is received after thetime and date specified <strong>in</strong> Clause 2.1.3 above may not be considered. Anytender delivered or sent otherwise will be at the risk of the tenderer/s.2.2 COMPLETION OF TENDER DOCUMENTSThe tenderer/s shall quote One Uniform percentage rate/s <strong>in</strong> figures as well as <strong>in</strong>words, for all labour and materials for Group ‘A' , (Schedule Items) and Group‘B’,(Non-Schedule items) <strong>in</strong> the attached Schedule of Rates and Quantities.Every possible fluctuation, <strong>in</strong> the rate of labour, material and generalcommodities, and other possibilities of each and every k<strong>in</strong>d which may effect therates, should be considered and kept <strong>in</strong> view before quot<strong>in</strong>g the rates and no claimon this account shall be enterta<strong>in</strong>ed by the Railway under any circumstancesexcept the price escalation payable as per price variation clause, if any, providedseparately <strong>in</strong> the tender documents.The rate/s should be quoted <strong>in</strong> figures as well as <strong>in</strong> words. If there is variationbetween the rates quoted <strong>in</strong> figures and <strong>in</strong> words, the rate quoted <strong>in</strong> `words' shallbe taken as correct. If more than one or improper rates are tendered for the sameitem, the tender is liable to be rejected.Each page of the tender papers is to be signed and dated by the tenderer/s or suchperson/s on his/their behalf who is/are legally authorized to sign for him/them.<strong>Tender</strong>s conta<strong>in</strong><strong>in</strong>g erasures and alterations of the tender documents are liable tobe rejected. Any corrections made by the tenderer/s <strong>in</strong> his/their entries should be<strong>in</strong> <strong>in</strong>k and must be attested by him/them under full signature and date.7Signature of the tenderer/s


Additional conditions or stipulations if any must be made by the tenderer/s <strong>in</strong> acover<strong>in</strong>g letter with the tender. The Railway reserves the right not toconsider conditional tenders and reject the same without assign<strong>in</strong>g any reason.Only those additional conditions which are explicitly accepted by the Railwayshall form part of the contract.2.3 CREDENTIALS TO BE SUBMITTED ALONGWITH TENDER/S.2.3.1 <strong>Tender</strong>er/s should enclose documents and certificates to show that he/they has/have satisfactorily carried out works of the type <strong>in</strong>volved <strong>in</strong> the construction ofthe work be<strong>in</strong>g tendered for. He/They should also produce proof of thesatisfaction of the Railway of his/their technical ability and f<strong>in</strong>ancial stability toundertake the work of the magnitude tendered for.The tenderer/s shall submit with his/their tender a list of serviceable mach<strong>in</strong>ery,tools and plants, equipments and vehicles he/they has/have <strong>in</strong> hand for execut<strong>in</strong>gthe work & those he/they <strong>in</strong>tends/<strong>in</strong>tend to purchase.2.3.2 (A) The tenderer/s must submit along with his/their tenders:-A statement show<strong>in</strong>g similar works executed by him/them.Certificates of successful completion of his/their work.A statement of all payments received aga<strong>in</strong>st all successfully completedwork/works <strong>in</strong> progress of all types (not necessarily similar <strong>in</strong> type to work <strong>in</strong>this tender) <strong>in</strong>dicat<strong>in</strong>g the organizations/units from which the payments havebeen received. Necessary certificates <strong>in</strong> this regard, from the authorities whomade the payments, for three preced<strong>in</strong>g years should be enclosed, dulyattested.A list of their Eng<strong>in</strong>eer<strong>in</strong>g Organization and equipments, construction Toolsand Plants available with them.The similar Nature of work is def<strong>in</strong>ed as under:"The tenderer should have executed Civil Eng<strong>in</strong>eer<strong>in</strong>g build<strong>in</strong>g works.When work has been physically competed and f<strong>in</strong>al bill is yet to be passed, thevalue of the work for judg<strong>in</strong>g the eligibility criteria, will be considered as under:8Signature of the tenderer/s


Cases where measurements have not been recorded or f<strong>in</strong>al measurements havebeen recorded with negative variation, the value of the work will be taken asamount paid <strong>in</strong>clud<strong>in</strong>g statutory deductions.Cases where measurements have been recorded and the work has been completedwith positive variation but a variation has not been sanctioned, the value of thework will be taken as orig<strong>in</strong>al contractual value.In case of composite works <strong>in</strong>volv<strong>in</strong>g comb<strong>in</strong>ation of different works, even separatecompleted works of required value should be considered while evaluat<strong>in</strong>g theeligibility criteria. For example, <strong>in</strong> a tender for bridge works where similar natureof work has been def<strong>in</strong>ed as bridge works with pile foundation and PSCsuperstructure, a tenderer, who had completed one bridge work with pilefoundation of value at least equal to 35% of tender value and also had completedone bridge work with PSC superstructure of value at least equal to 35% of tendervalue, will be considered as hav<strong>in</strong>g fulfilled the eligibility criterion of hav<strong>in</strong>gcompleted s<strong>in</strong>gle similar nature of work.“For judg<strong>in</strong>g the technical eligibility and f<strong>in</strong>ancial capability only those workswhich had been executed for the Govt. or Semi Govt. organizations shall beconsidered and the tenderer will submit the certificate to this effect from theofficer concerned duly signed under the official seal. It should be noted thatcredentials for the works executed for Private Organizations shall not beconsidered.The tenderer/ contractor shall submit a statement of contractual payment receiveddur<strong>in</strong>g the last thee f<strong>in</strong>ancial years and current year on the prescribed proforma asdetailed at Annexure-I. The details shall be based on the form 16-A issued byemployer i.e. the certificate of deduction of tax at a source under Section 203 ofthe Income Tax Act, 1961. The photocopies of the form 16-A shall be enclosedduly attested by Notary public with seal and Notarial stamps thereon.If a tenderer has completed a work of similar nature where cement and steel wasissued by department free of cost, tenderer must submit the completion certificate<strong>in</strong>dicat<strong>in</strong>g cost of these materials and total cost of work (<strong>in</strong>clud<strong>in</strong>g cost ofcement/steel) shall be considered to decide eligibility or otherwise.Contractor has to satisfy the eligibility criteria for technical capability andcompetence as well as for f<strong>in</strong>ancial capacity and organizational resources.2.4 CONSTITUTION OF THE FIRM2.4.1 The tenderer/s who are constituents of firm, company, association or societymust forward attested copies of the constitution of their concern, partnershipdeed and power of attorney with their tender. <strong>Tender</strong> documents <strong>in</strong> such cases9Signature of the tenderer/s


are to be signed by such persons (as may be legally competent to sign them onbehalf of the firm, company, association or society as the case may be). Cooperativesocieties must likewise submit an attested copy of their certificate ofregistration along with the documents as above mentioned.The Railway will not be bound by any power of attorney granted by thetenderer/s or by changes <strong>in</strong> the composition of the firm made subsequent tothe execution of the contract. The Railway may, however, recognize suchpower of attorney and changes after obta<strong>in</strong><strong>in</strong>g proper legal advice, cost ofwhich will be chargeable to the contractor.JVs/Consortiums/ MOUs shall NOT be considered.2.4.2(a)2.4.2(b)2.4.2(c)2.4.2(d)If the tenderer expires after the submission of his tender or after theacceptance of his tender, the railway shall deem such tender/contract ascancelled, if a partner of firm expires after the submission of their tender theRailway shall deem such tender as cancelled unless the firm reta<strong>in</strong> itscharacter.If the contractor’s firm is dissolved on account of death, retirement of anypartners or for any reason whatsoever, before fully complet<strong>in</strong>g the whole workor any part of it, undertaken by the pr<strong>in</strong>cipal agreement the surviv<strong>in</strong>g partnersshall rema<strong>in</strong> jo<strong>in</strong>tly/severally and personally liable to complete the wholework to the satisfaction of the Railway and to pay compensation for lossessusta<strong>in</strong>ed, if any by the Railway due to such dissolution. The amount of suchcompensation shall be decided by Chief Adm<strong>in</strong>istrativeOfficerc/IRPMU.The decision <strong>in</strong> the matter shall be b<strong>in</strong>d<strong>in</strong>g on the contractor.The cancellation of any document such as power of attorney, partnership deedetc., shall forthwith be communicated to the Railway <strong>in</strong> writ<strong>in</strong>g, fail<strong>in</strong>g whichthe Railway shall have no responsibility or liability for any action taken on thestrength of the said documents.The value of contract and the quantities given <strong>in</strong> the attached schedule ofitems, rates and quantities are approximate and are given only as a guide.These are subject to variations/additions and or omission. The quantum ofwork to be actually carried out shall not form the bases of any disputeregard<strong>in</strong>g the rates to be paid and shall not give rise to claim for compensationon account of any <strong>in</strong>crease or decrease either <strong>in</strong> the quantity or <strong>in</strong> the contractvalue.INCOME TAX CLEARANCE CERTIFICATE2.5.1 Under Section194-C of the Income Tax Act 1961 deduction of 2% plus surchargeas applicable on Income Tax will be made for sums paid for carry<strong>in</strong>g out the work10Signature of the tenderer/s


under this contract. In case of supply contract for ballast, deduction of 2% (TwoPercent) Income tax will be made for the sums paid for labour portion only (i.e.,load<strong>in</strong>g, unload<strong>in</strong>g, stack<strong>in</strong>g, measurement and lay<strong>in</strong>g etc.)3.0 EARNEST MONEY3.1 The tender must be accompanied by a sum of Rs. 12,560/- (Rs.Twelvethousand five hundred sixtyd only) <strong>in</strong> favour of Dy.FA&CAO/ IRPMU, ShivajiBridge, New Delhi i.e. 2% of first one crore of tender value & ½% for balanceamount as <strong>in</strong>dicated <strong>in</strong> <strong>Tender</strong> Notice) as Earnest Money <strong>in</strong> the mannerprescribed <strong>in</strong> Clause 3.2 fail<strong>in</strong>g which the tender shall be summarily rejected.The earnest money shall be rounded to the nearest Rs.10/-.Labour co-operative are required to deposit only 50% of the earnest money asreferred to <strong>in</strong> clause 3.1 above.3.1.2 The tenderer/s shall keep the offer open for a period of 90 days from the open<strong>in</strong>gof the tender <strong>in</strong> which period tendered/s cannot withdraw his/their offersubject to period be<strong>in</strong>g extended further, if required, by mutual agreement fromtime to time. It is understood that the tender documents have been sold/issued tothe tenderer/s and tenderer/s is/are be<strong>in</strong>g permitted to <strong>in</strong> consideration ofstipulation on his/their part that after submitt<strong>in</strong>g his/their offer he/they will notresile from his/their offer or modify the terms and conditions thereof <strong>in</strong> a mannernot acceptable to North Central Railway should the tenderer/s fail to observe tocomply with the forego<strong>in</strong>g stipulation or fail to undertake the contract afteracceptance of his/their tender the entire amount deposited as earnest money forthe due performance of the stipulation and to keep the offer open for thespecified period, shall be forfeited to the Railway. If the tender is accepted, theamount of all earnest money will be held as <strong>in</strong>itial security deposit for due andfaithful fulfillment of the contract. The earnest money of unsuccessful tenderer/swill, save as here<strong>in</strong> before provided be returned to the unsuccessful tenderer/swith<strong>in</strong> a reasonable time, but Railway shall not be responsible for any loss ordepreciation that happen to the earnest money for the due performance of thestipulation and to keep the offer open for the period stipulated <strong>in</strong> the tenderdocuments while <strong>in</strong> Railway possession nor will be liable to pay <strong>in</strong>terest thereon.3.2 The Earnest Money of the requisite amount referred to <strong>in</strong> Clause 3.1 above isrequired to be deposited either <strong>in</strong> cash with the Chief Cashier, NorthernRailway, Delhi on any work<strong>in</strong>g day before 15.00 Hrs. on 26/03/2009 or <strong>in</strong> anyof the follow<strong>in</strong>g form.Deposit receipts, pay orders & demand drafts. These forms of earnestmoney could be either of the State Bank of India or of any of theNationalized Banks. The previous deposits of earnest money may be considered for adjustment aga<strong>in</strong>stthe present tender if so desired by the tenderer/s only when the earlier tender hasbeen f<strong>in</strong>alized and the earnest money deposited has actually become availablewithout any attachment and there is no change <strong>in</strong> the constitution of the partiesseek<strong>in</strong>g adjustment.4.0 ACCEPTANCE OF TENDER4.1 If the tenderer/s deliberately give/s a wrong <strong>in</strong>formation/whose credentials/documents <strong>in</strong> his/their tender and thereby creates/ create circumstances forthe acceptance of his/ their tender, Railway reserves the right to reject such tenderat any stage, besides, shall suspend the bus<strong>in</strong>ess for one year.The authority for acceptance of the tenders rests with CAO/ IRPMU, Dy ChiefEng<strong>in</strong>eer/IRPMU,North Central Railway, Shivaji Bridge, New Delhi as the casemay be who does not undertake to asign reasons for decl<strong>in</strong><strong>in</strong>g to consider anyparticular tender or tenders. whole or <strong>in</strong> part or to divide the tender amongst more than one tenderer ifdeemed necessary4.3 The successful tenderer/s shall be required to execute an agreement with thePresident of India act<strong>in</strong>g through the (CAO/IRPMU)/ Dy.CE (IRPMU), ShivajiBridge, New Delhi for carry<strong>in</strong>g out of the work as per agreed conditions. The costof stamp for the agreement will be borne by the North Central Railway.4.3.1 The contractors operations and proceed<strong>in</strong>gs <strong>in</strong> connection with the works shall atall times be conducted dur<strong>in</strong>g the cont<strong>in</strong>uance of contract <strong>in</strong> accordance with thelaws, ord<strong>in</strong>ance, rules and regulations for the time be<strong>in</strong>g <strong>in</strong> force and thecontractor shall further observe and comply with the bye-laws and regulationsof the Govt. of India, State Govt. and of Municipal & other authorities hav<strong>in</strong>gjurisdiction <strong>in</strong> connection with the works or site over operations such as theseare carried out by the contractor/s and shall give all notice required by such byelawsand regulations. The Hospital and medical regulations <strong>in</strong> force for the timebe<strong>in</strong>g shall also be complied with by the contractor/s and his workmen.4.3.2 The contractor shall be responsible for the observance of the rules and regulationsunder the m<strong>in</strong>es act and m<strong>in</strong>eral rules and Indian Metallurgical rules andregulations of State/Central Govt. concerned as amended from time to time.The contractor shall at all times keep the railway adm<strong>in</strong>istration <strong>in</strong>demnifiedaga<strong>in</strong>st all penalties that may be imposed by the Govt. of India or State Govt. for<strong>in</strong>fr<strong>in</strong>gements or any of the clauses of the m<strong>in</strong>es act and rules made there under<strong>in</strong> respect of quarries from which the ballast for these works is procured.The tenderer/s shall not <strong>in</strong>crease his/their rate <strong>in</strong> case the Railway Adm<strong>in</strong>istrationnegotiates for reduction of rates. Such negotiations shall not amount tocancellation or withdrawal of the orig<strong>in</strong>al offer and rates orig<strong>in</strong>ally quoted will beb<strong>in</strong>d<strong>in</strong>g on the tenderer/s.The tenderer/s shall submit an analysis of rates if called upon to do so.4.6 A corrigendum shall be issued <strong>in</strong> case the <strong>in</strong>crease <strong>in</strong> quantity <strong>in</strong> one or more itemsresult an extra expenditure <strong>in</strong> excess of 10% of the value of the contract orRs.50,000/- whichever is less. For the purpose of assess<strong>in</strong>g the <strong>in</strong>crease <strong>in</strong> thequantity and the <strong>in</strong>crease <strong>in</strong> the value of contract only such of the items <strong>in</strong> whichthere is any <strong>in</strong>crease shall be taken <strong>in</strong>to account and the sav<strong>in</strong>g <strong>in</strong> other itemsignored.4.7 Non-compliance with any of the conditions set forth here<strong>in</strong> is liable to result <strong>in</strong> thetender be<strong>in</strong>g rejected.4.8 Variation <strong>in</strong> quantity13Signature of the tenderer/s


“The tenderer/contractor will be bound to execute the additional quantities to theextent of (+50% ) of the agreement value on the follow<strong>in</strong>g terms and conditions:If agreemental value goes beyond (+) 25%, <strong>in</strong> that case, for the first 15%<strong>in</strong>crease <strong>in</strong> the value of the agreement, the rates shall be reduced by 2% <strong>in</strong> the<strong>in</strong>cremental value.The rate shall be further reduced by 2% for the <strong>in</strong>cremental value of the agreement,for the next 10% <strong>in</strong>crease <strong>in</strong> the value of the agreement beyond 15% as <strong>in</strong> (a).In case agreemental value goes beyond (+) 50%, the rates for <strong>in</strong>cremental value shallbe decided as per prevail<strong>in</strong>g codal provision.SECURITY DEPOSIT ON ACCEPTANCE OF TENDER5.1 The security deposit/rate of recovery/mode of recovery on acceptance oftender shall be as under:a) The security deposit for each work will be 5% of the contract value,b) The rate of recovery will be at the rate of 10% of the bill amount till thefull security deposit is recovered,c) Security deposits will be recovered only from the runn<strong>in</strong>g bills of thecontract and no other mode of collect<strong>in</strong>g security deposit such as securitydeposit <strong>in</strong> the form of <strong>in</strong>struments like BG, FD etc. shall be acceptedtowards security deposit.The total security deposit recoverable from a contractor <strong>in</strong>clud<strong>in</strong>g the amount ofearnest money deposited with the tender as given <strong>in</strong> Clause above will notexceed the security amount recoverable at the rates mentioned above.The security deposit unless forfeited <strong>in</strong> whole or <strong>in</strong> part accord<strong>in</strong>g to the terms andconditions shall be returned to the contractor after the physical completion of thework as certified by the competent authority. The competent authority shallnormally be the authority who is competent to sign this contract. If the competentauthority is of the rank lower than JA grade, then a JA Grade Officer (concernedwith the work) should issue the certificate. The certificate, <strong>in</strong>ter alia, shouldmention that the work has been completed <strong>in</strong> all respects and that all thecontractual obligations have been fulfilled by the contractors and that there is nodue from the contractor to Railways aga<strong>in</strong>st the contract concerned. Beforereleas<strong>in</strong>g the SD, an unconditional and unequivocal no claim certificate from thecontractor concerned should be obta<strong>in</strong>ed.14Signature of the tenderer/s


Performance Guarantee:5.2 (a) The successful bidder may give performance guarantee amount<strong>in</strong>g to 5% of thecontract value <strong>in</strong> any of the follow<strong>in</strong>g forms.i) A deposit of Cashii) Irrevocable Bank GuaranteeGovt. securities <strong>in</strong>clud<strong>in</strong>g State Loan Bonds at 5% below the market value.Deposit receipts Pay order, Demand drafts and Guarantee Bonds. These forms ofperformance guarantee could be either of the State Bank of India or of any ofNationalized Banks.Guarantee Bonds executed or Deposit Receipts tendered by all scheduled Banks.A deposit <strong>in</strong> the Post office sav<strong>in</strong>g CertificatesA Deposit <strong>in</strong> the National Sav<strong>in</strong>g Certificates.Twelve years National Defence Certificates.Ten years Defence DepositsNational Defence Bonds andUnit Trust Certificate at 5% below market value or at the face value which ever is less.Also FDR <strong>in</strong> favour of Dy.FA&CAO/IRPMU, Shivaji Bridge, New Delhi. (Free from anyencumbrance) may be accepted.The Performance Guarantee will be furnished by the successful contractor after the letterof acceptance has been issued, but before sign<strong>in</strong>g of the agreement and should bevalid up to expiry of the ma<strong>in</strong>tenance period. The agreement should normally besigned with<strong>in</strong> 15 (Fifteen) days after the issue of letter of acceptance andperformance guarantee should also be submitted with <strong>in</strong> this time limit.Performance Guarantee will be released after satisfactory completion of the work andma<strong>in</strong>tenance period is over. The procedure for releas<strong>in</strong>g is same as for SecurityDeposit.In case the contract is resc<strong>in</strong>ded, the Security Deposit shall be forfeited and theperformance guarantee shall be en-cashed and the balance work will be got doneseparately,The balance work will be got done <strong>in</strong>dependently without risk and cost of the orig<strong>in</strong>alcontractor,The orig<strong>in</strong>al contractor shall be debarred from participat<strong>in</strong>g <strong>in</strong> the tender for execut<strong>in</strong>gthe balance work. If the failed contract is a JV or a Partnership Firm, then everymember / Partner of such a firm would be debarred from participat<strong>in</strong>g <strong>in</strong> thetender for the balance work either <strong>in</strong> his / her <strong>in</strong>dividual capacity or as a partnerof any other JV / Partnership firm.15Signature of the tenderer/s


5.3. Exemption of Earnest Money & security depositPublic Sector Undertak<strong>in</strong>gs wholly owned by Railways like RITES, IRCON,Konkan Railway Corporation Limited, CRIS, Rail-Tel Corporation etc. areexempted from deposit<strong>in</strong>g earnest money and Security Deposit.6.0 CONDITIONS OF CONTRACT AND SPECIFICATIONS6.1 Except where specifically stated otherwise <strong>in</strong> the tender documents the work is tobe carried out <strong>in</strong> accordance with (i) North Central Railway GeneralConditions of Contract Regulations for <strong>Tender</strong>/s and Contracts, 2005 (ii) NorthCentral Railway Standard Schedule of Rates 2006 and (iii) North Central RailwayStandard Specifications for Material and Works 2007 with up to date correctionslips. Copies of all these publications can be obta<strong>in</strong>ed from the office ofGeneral Manager, North Central Railway Allahabad/Chief Eng<strong>in</strong>eer /Works,Allahabad, if available, on payment as under:-i) General Conditions of Contract and regulations for<strong>Tender</strong>/s and Contracts, 2005ii) North Central Railway Standard Specifications for Materialand Works 2007.iii North Central Railway Standard Schedule of Rates 2006.)Rs.250 /-Rs.1000 /-Rs.1000/-Demand for these publications from out station will be considered only if a sumof Rs.50/- towards postal charges is also sent with the cost of the books by moneyorder.6.2 The tender documents referred to <strong>in</strong> clause 2.1.1 above will <strong>gov</strong>ern the worksdone under this contract <strong>in</strong> addition to documents referred to <strong>in</strong> clause 6.1 above.Where there is any conflict between special tender conditions regard<strong>in</strong>g<strong>in</strong>structions to tenderer/s, special conditions relat<strong>in</strong>g to site data and specificationsand the stipulations conta<strong>in</strong>ed <strong>in</strong> the schedule of rates and quantities on the onehand and the North Central Railway Standard Specifications for Materials andWorks 2007 the General Conditions of Contract, 2005etc. and the StandardSchedule of Rates o f 2006 on the other hand the former shall prevail.7.0 STUDY OF DRAWINGS AND LOCAL CONDITIONS7.1 The draw<strong>in</strong>gs for the works can be seen <strong>in</strong> the office of the Chief Adm<strong>in</strong>istrativeOfficer/ IRPMU, Shivaji Bridge, New Delhi It should be noted by tenderer/sthat these draw<strong>in</strong>gs are meant for general guidance only and the Railway maysuitably modify them dur<strong>in</strong>g the execution of the work accord<strong>in</strong>g to the16Signature of the tenderer/s


circumstances without mak<strong>in</strong>g the Railways liable for any claims on account ofsuch changes.7.2 The tenderer/s is/are advised to visit the site of work and <strong>in</strong>vestigate actualconditions regard<strong>in</strong>g nature and conditions of soil, difficulties <strong>in</strong>volved dueto <strong>in</strong>adequate stack<strong>in</strong>g space, due to built up area around the site, availability ofmaterials water and labour probable sites for labour camps, stores, godowns,etc. They should also satisfy themselves as to the sources of supply and adequacyfor their respective purpose of different materials referred <strong>in</strong> the specificationsand <strong>in</strong>dicated <strong>in</strong> the draw<strong>in</strong>gs. The extent of lead and lift <strong>in</strong>volved <strong>in</strong> theexecution of works and any difficulties <strong>in</strong>volved <strong>in</strong> the execution of workshould also be exam<strong>in</strong>ed before formulat<strong>in</strong>g the rates for complete items ofwork described <strong>in</strong> the schedule.7.3 Fenc<strong>in</strong>g at Work Site:Contractor(s) while execut<strong>in</strong>g the work of gauge conversion/ doubl<strong>in</strong>g, yardremodel<strong>in</strong>g etc. shall provide suitable fenc<strong>in</strong>g/barricad<strong>in</strong>g to protect/segregate theexist<strong>in</strong>g railway l<strong>in</strong>e from any damage and un-toward <strong>in</strong>cident, as per thedirection or plan approved by Eng<strong>in</strong>eer-<strong>in</strong>-charge. The payment forbarricad<strong>in</strong>g/fenc<strong>in</strong>g shall be paid under the relevant NS items as given <strong>in</strong> theschedule. No work will be started till the fenc<strong>in</strong>g/barricad<strong>in</strong>g is provided andclearance <strong>in</strong> writ<strong>in</strong>g is issued by the Eng<strong>in</strong>eer-<strong>in</strong>-charge.7.4. Safety Gear:Dur<strong>in</strong>g the execution of work, contractors shall ensure that all safety precautionsare taken by their men to protect themselves and site to prevent any untoward<strong>in</strong>cident. In this regard contractor will ensure that adequate number of safetyhelmets, safety belts, safety jackets with reflective arm band; rope, ladders,emergency light etc. are available at site before the work is actually started. Theabove list is only <strong>in</strong>dicative and not exhaustive and safety item will be arranged asper the requirement. Railway reserve the right to stop the work <strong>in</strong> the absence ofproper safety gear and no claim shall be enterta<strong>in</strong>ed <strong>in</strong> this regard. Decision of theEng<strong>in</strong>eer-<strong>in</strong>-charge will be f<strong>in</strong>al and b<strong>in</strong>d<strong>in</strong>g upon the contractor. The cost of allthe safety gear is deemed to have been <strong>in</strong>cluded <strong>in</strong> the rates quoted and noth<strong>in</strong>gextra is payable under this contract.8.0 PERIOD OF COMPLETION8.1 The entire work is required to be completed <strong>in</strong> all respects with<strong>in</strong> Six Monthsfrom the date of issue of the acceptance letter/telegram. Time is the essence ofcontract. The contractor/s will be required to ma<strong>in</strong>ta<strong>in</strong> speedy and requiredprogress to the satisfactions of the Eng<strong>in</strong>eer to ensure that the work will becompleted <strong>in</strong> all respects with<strong>in</strong> the stipulated period fail<strong>in</strong>g which action may17Signature of the tenderer/s


e taken by the Railway Adm<strong>in</strong>istration <strong>in</strong> terms of Clause 17 and/or Clause 62of the General Conditions of Contract 20058.2 The contractor/s shall arrange to execute the different items of works <strong>in</strong> closeconsultation with and as per directions of the Eng<strong>in</strong>eer so that other worksbe<strong>in</strong>g executed <strong>in</strong> the same area either departmentally or through anotheragency such as steel erection, P. Way earthwork <strong>in</strong> formation, etc. are alsoprogressed concurrently. It may be noted, however, that any delay <strong>in</strong> theexecution of departmental works, for whatsoever reason shall not be accepted asan excuse for non-performance of the contract.8.3 The contractor/s will be required to give to Dy. Chief Eng<strong>in</strong>eer/IRPMU amonthly progress report of the work done dur<strong>in</strong>g the month on 4 th of thefollow<strong>in</strong>g month. He will also give to the Dy. Chief Eng<strong>in</strong>eer the programmeof work to be done <strong>in</strong> com<strong>in</strong>g month by 25 th of the preced<strong>in</strong>g month. Theprogramme will be subject to alteration or modifications at the direction of theChief Adm<strong>in</strong>istrative Officer/ IRPMU, Shivaji Bridge, New Delhi who maydiscuss such modifications or alterations with the contractor as considerednecessary. Approval of any programme shall not <strong>in</strong> any way relieve the contractorfrom any of his obligations to complete the whole of the work by the prescribedtime or extended time, if any.9.0 RATES FOR PAYMENT9.1 The rates given <strong>in</strong> the attached schedule of rates tendered by the contractor and asaccepted by the Railways will form the basis of payment for such items under thiscontract.9.2 No material price variation or wages escalation on any account whatsoever thecompensation for `Force Majure' etc. shall be payable under this contract exceptprice escalation clause payable as per price escalation clause, if any, providedseparately <strong>in</strong> the tender documents.9.3 The rates for any item of work not <strong>in</strong>cluded <strong>in</strong> the (Schedule of Items, Rates andQuantities) and which the contractor may be called upon to do by RailwayAdm<strong>in</strong>istration shall be fixed by the supplementary written agreement betweenthe contractor and the Railway before the particular item or items of work is/areexecuted. In the event of such agreement not be<strong>in</strong>g entered <strong>in</strong>to and executed theRailway may execute these works by mak<strong>in</strong>g alternative arrangements. Railwayswill not be responsible for any loss or damages on this account.9.3.1 The contractor shall work <strong>in</strong> close co-operation with the contractors, departmentalstaff work<strong>in</strong>g <strong>in</strong> the adjacent sections of railway & local authorities.18Signature of the tenderer/s


9.4 It should be specifically noted by the tenderers that no separate load<strong>in</strong>g, unload<strong>in</strong>gand lead<strong>in</strong>g charges for materials (which are supplied by the Railway) shall bepaid for by the Railways and the rates quoted by the tenderer/s shall be <strong>in</strong>clusiveof all these charges.9.5 The item Nos., description, units and rates given <strong>in</strong> schedule of rates are as perNorth Central Railway Standard Schedule of Rates 2006 and any discrepancydur<strong>in</strong>g the execution of the work <strong>in</strong> the work<strong>in</strong>g rates, quantity and units etc.should be rectified by reference to the pr<strong>in</strong>ted schedule of rates which be treatedas authority and will be b<strong>in</strong>d<strong>in</strong>g on the contractor.9.6 Should there arise any items which may be necessary for the completion of workbut which does not appear <strong>in</strong> the Schedule of Items, Rates and Quantities attachedwith tenders, its rate will be fixed by analysis of actual <strong>in</strong>puts of all types<strong>in</strong>clud<strong>in</strong>g labour and material or derived from the labour and material rates given<strong>in</strong> the North Central Railway Standard Schedules of Rates 1996. The rates forsuch non-scheduled items occurr<strong>in</strong>g dur<strong>in</strong>g the course of construction shall bepayable subject to the approval of the competent authority.No items or work requir<strong>in</strong>g non-schedule rates will be carried out unless orderedto do so by the Eng<strong>in</strong>eer. The rates derived from the North Central RailwayStandard Schedules of Rates 2006 will be subject to percentage above or belowtendered by the contractor.9.7 Payment for the work done will be made to the contractor only when the formalagreement has been executed between the parties.9.8 SUPPLEMENTARY AGREEMENTAfter the work is completed and taken over by the Railway as per terms andconditions of the contract agreement or otherwise concluded by the parties withmutual consent and full and f<strong>in</strong>al payment is made by the Railway to thecontractor for work done under the contract the parties shall execute thesupplementary agreement annexed here to as Annexure-B.9.9 Measures to be taken <strong>in</strong> construction and repairs on roads, embankments, etc.9.9.1 All borrow pits dug for and <strong>in</strong> connection with the construction and repairs ofbuild<strong>in</strong>gs, roads, embankments, etc. shall be deep and connected with each other<strong>in</strong> the formation of a dra<strong>in</strong> directed towards the lowest level and properly slopedfor discharge <strong>in</strong>to a river, stream, channel or dra<strong>in</strong> and no person shall createany isolated borrow pit which is likely to cause accumulation of water whichmay breed mosquitoes.19Signature of the tenderer/s


9.9.2 Non fulfillment of the provision <strong>in</strong> 9.9.1 above shall be a breach of the contractand contractor/s shall be liable to pay by way of agreed liquidated damages to theRailway at the rates of Rs.100/- for each breach and <strong>in</strong> addition to that contractorfurther undertake to pay the amount <strong>in</strong>curred by the Railway <strong>in</strong> gett<strong>in</strong>g the saidjob/s done at the risk and cost of the contractor. Besides this, the contractor willalso be held responsible for any laws for contraven<strong>in</strong>g them.10.0 SETTING OUT WORKS10.1 The contractor is to set out the whole of the work <strong>in</strong> consultation with theeng<strong>in</strong>eer or an official to be deputed by the Eng<strong>in</strong>eer and dur<strong>in</strong>g the progress ofworks to amend on the requisition of the Eng<strong>in</strong>eer any errors which may arisethere <strong>in</strong> and provide efficient and sufficient staff and labour thereon. Thecontractor shall also alter or amend any errors <strong>in</strong> the dimension l<strong>in</strong>es on levels tothe satisfaction of the Eng<strong>in</strong>eer or his authorized representative without claim<strong>in</strong>gany compensation for the same.10.2 The contractor shall provide, fix and be responsible for ma<strong>in</strong>tenance of all stocks,templates, profiles, land marks, po<strong>in</strong>ts, burjies, monuments, center l<strong>in</strong>e pillars,reference pillars, etc. and shall take all necessary precautions to prevent theirbe<strong>in</strong>g removed altered or disturbed and will be responsible for the consequenceof such removal, alterations or disturbance and for their efficient re<strong>in</strong>statement.10.3 The contractor shall protect and support, as may be required or as directed bythe Eng<strong>in</strong>eer, all build<strong>in</strong>g, fences, walls, towers, dra<strong>in</strong>s, road paths, waterways,foreshores banks, bridges, Railway ground and overhead electric light<strong>in</strong>g, thetelegraphs/telephones and cross<strong>in</strong>g water service ma<strong>in</strong> pipes and cables andwires and altogether matters and th<strong>in</strong>gs of whatever k<strong>in</strong>d not otherwise here<strong>in</strong>specified other than those specified or directed to be removed or alteredwhich may be <strong>in</strong>terfered with or which likely to be affected disturbed orendanger by the execution completion of ma<strong>in</strong>tenance of the works and shallsupport provided under this clause to such cases as directed by the Eng<strong>in</strong>eer. Nopayment shall be made by the Railway to the contractor for these works onaccount of delay for re-arrangement of road traffic or <strong>in</strong> the contractor hav<strong>in</strong>gto carry out the short lengths and <strong>in</strong> such places as per conditions andcircumstances may warrant. These will not form the basis of any claim and ordispute for compensation of any k<strong>in</strong>d.11.0 DRAWINGS FOR WORKS:11.1 The Railway Adm<strong>in</strong>istration reserves the right to modify the plans and draw<strong>in</strong>gsas referred to <strong>in</strong> the special data and specifications as also the estimate andspecifications without assign<strong>in</strong>g any reasons as and when considered necessary bythe railway. The percentage rates for the schedule items and items rates for thenon-schedule items quoted by the contractor as may be accepted by the20Signature of the tenderer/s


ailways will, however, hold good irrespective of any changes, modifications,alterations, additions, omissions <strong>in</strong> the locations of structures and detaileddraw<strong>in</strong>gs, specifications and/or the manner of execut<strong>in</strong>g the work.11.2 It should be specifically noted that some of the detailed draw<strong>in</strong>gs may not havebeen f<strong>in</strong>alized by the railway and will, therefore, be supplied to the contractoras and when they are f<strong>in</strong>alized on demand. No compensation whatsoever onthis account shall be payable by the Railway Adm<strong>in</strong>istration.11.3 No claim whatsoever will be enterta<strong>in</strong>ed by the Railway on account of any delayor hold up of the work/s aris<strong>in</strong>g out of delay <strong>in</strong> approval of draw<strong>in</strong>gs, changes,modifications, alterations, additions, omission and the site layout plans or detailsdraw<strong>in</strong>gs and design and or late supply of such material as are required to bearranged by the Railway or due to any other factor on Railway Accounts.12.0 SUPPLY OF MATERIALS BY THE RAILWAYS12.1 If at any time, material which the contractor/s should normally have to arrangehimself/themselves, are supplied by the Railway either at the contractor'srequest or <strong>in</strong> order to prevent any avoidable delay <strong>in</strong> the execution of work dueto the contractor's <strong>in</strong>ability to make adequate timely arrangements for supplythereof or for any other reason, recovery will be made from the contractor'sbill either at the market rate prevail<strong>in</strong>g at the time of supply or at the bookrate which ever is greater, plus fixed departmental charges viz. freight at 5%(8.33% for items of Iron and G.I. pipe steel) <strong>in</strong>cidental charges at 2% and addedon total cost supervision charges at 12 1 / 2 %. No carriage or <strong>in</strong>cidental chargeswill be borne by the Railway. The contractor cannot, however, claim as a matterof right the issue of such material by the Railway which he/they is required toarrange himself/themselves <strong>in</strong> accordance with the terms and conditions of thiscontract.12.1.1 In case, cement and/or steel is issued to the contractor/s free of cost or on costto be recovered for use on the work, the supply thereof shall be made <strong>in</strong> stageslimited to the quantity/quantities computed by the Railway accord<strong>in</strong>g to theprescribed specifications and approved draw<strong>in</strong>gs as per the agreement. Thecement and/or steel issued <strong>in</strong> excess of the requirements as above shall bereturned <strong>in</strong> perfectly good conditions by the contractor to the Railwayimmediately after completion or determ<strong>in</strong>ation of the contract. If the contractor/sfail/s to return the said stores, then the cost of cement and/or steel issued <strong>in</strong>excess of the requirement computed by the Railway accord<strong>in</strong>g to thespecifications and approved draw<strong>in</strong>g will be recovered from the contractor/s @twice the prevail<strong>in</strong>g procurement cost at the time of last issue viz. 2 X (purchaseprice + 5% freight only). This will be without prejudice to the right of theRailway to take action aga<strong>in</strong>st the contractor/s under the conditions of thecontract for not do<strong>in</strong>g/complet<strong>in</strong>g the work accord<strong>in</strong>g to the prescribed21Signature of the tenderer/s


specifications and approved draw<strong>in</strong>gs. If it is discovered that the quantity ofcement and or steel used is less than the quantity ascerta<strong>in</strong>ed as here<strong>in</strong>before provided, the cost of the cement and/or steel not so used shall berecovered from the contractor/s on the basis of the above stipulated formula.12.1.2 The contractor shall be responsible for the safe transport custody and storageof all Railway materials issued to him and he will be liable to make good theloss due to any cause whatsoever, that may be suffered by the Railway on thisaccount. Special precautions should be taken <strong>in</strong> respect of cement whiletransport<strong>in</strong>g cement, steps should be taken to safeguard aga<strong>in</strong>st cement becom<strong>in</strong>gdamp or wet due to moisture or ra<strong>in</strong>. The contractor will also be responsible forstor<strong>in</strong>g cement <strong>in</strong> damp proof conditions at site of work at his own cost <strong>in</strong>accordance with the standard specifications. The Eng<strong>in</strong>eer shall decide whetherthe cement stored <strong>in</strong> the godown is fit for the work and his decision shall be f<strong>in</strong>aland b<strong>in</strong>d<strong>in</strong>g on the contractor/s.12.2 The contractor should supply a schedule show<strong>in</strong>g the requirements of explosives/materials required to be supplied to him by the Railway based on detailed plans.The materials will be arranged by the Railway accord<strong>in</strong>g to this schedule unlessotherwise modified by the Railway due to additions or alterations <strong>in</strong> the approvedplans. No claim whatsoever will be enterta<strong>in</strong>ed by the Railway on account oflate supply of such materials as are required to be arranged by the Railway.12.3 SUPPLY OF CEMENT AND STEEL BY THE RAILWAYS12.3.1 Cement, Mild Steel/H.Y.S.D./Bars/RSJ/MS Plate, etc. to be supplied by theRailway to the extent as would become a part of the work <strong>in</strong>volved <strong>in</strong> the tenderschedule will be supplied by the Railway free of cost or on cost recovery basisas the case may be as per relevant clauses of special conditions relat<strong>in</strong>g to sitedata and specifications at construction store godown at __________. Thecontractor will be required to lead the same to the site of work at his own costsubject to payment at the rate as quoted aga<strong>in</strong>st relevant item of N.S. Items <strong>in</strong> theSchedule of Items, Rates & Quantities.12.3.2 Cement and steel required for temporary works timber<strong>in</strong>g, shutter<strong>in</strong>g, center<strong>in</strong>g,scaffold<strong>in</strong>g, etc. will have to be arranged entirely by the contractor at his owncost.12.3.3 The empty cement bags for the supply of cement by the Railway shall be propertyof the contractor and the cost of the same shall be recovered at the rate of RupeesTwo per empty cement bag from the ‘on account bill’ of the contractor <strong>in</strong> case thecement is supplied <strong>in</strong> Jute bags. No recovery on account of empty cement bagsshall be made from the contractor, <strong>in</strong> case the cement is supplied <strong>in</strong> H.D.P.E.bags. The Railway, however, reserves its right to take empty bags as are <strong>in</strong> goodconditions and <strong>in</strong> that case no recovery will be made for bags so taken back.22Signature of the tenderer/s


These rates will apply for bags deteriorated while <strong>in</strong> use and not found acceptableto the Railway so taken back from the contractor.13.0 SUPPLY OF MATERIALS BY THE CONTRACTOR/S13.1 Materials used <strong>in</strong> the work by the contractor shall conform to the North CentralRailway Standard Specifications and the relevant I.S.I./I.R.S Specifications, andshould be approved by the Eng<strong>in</strong>eer before utiliz<strong>in</strong>g them on works.13.2 It should be clearly understood that the tendered rates <strong>in</strong>clude wastage and washaway due to ra<strong>in</strong>s, storms, floods or any other cause whatsoever.13.3 No load<strong>in</strong>g, unload<strong>in</strong>g, lead, lift, stack<strong>in</strong>g, octroi, sales tax, toll tax, royalty orany other charges will be paid for the materials, tools and plants and toolsarranged and brought by the contractor to the site of work.14.0 SERVICE ROADS14.1 The contractor/s shall make his/their arrangements for service roads, paths etc.for carry<strong>in</strong>g his/their tools and plants, labour and materials, etc. and will alsoallow the Railway use of such paths and service roads, etc. for ply<strong>in</strong>g its ownvehicles free of cost. The tenderer/s will be deemed to have <strong>in</strong>cluded the cost ofmak<strong>in</strong>g any service roads, roads or paths, etc., that may be required by him/themfor ply<strong>in</strong>g his/their vehicles for the carriage of his/their men and materials, tools,plants and mach<strong>in</strong>ery for successful completion of the work. Similarly, any otherfeeder road connect<strong>in</strong>g any of the exist<strong>in</strong>g roads will be made by the contractor athis/their own cost <strong>in</strong>clud<strong>in</strong>g any compensation that may be required to be paid forthe temporary occupation and or usage of Govt. and or private land and without <strong>in</strong>any way <strong>in</strong>volv<strong>in</strong>g the Railway <strong>in</strong> any dispute for damage and/or compensation.14.2 In case the Railway has its own paths, service roads, the contractor/s will beallowed to use of such paths or service roads free of cost. He/They shall,however, <strong>in</strong> no way <strong>in</strong>volve the Railway <strong>in</strong> any claims or dispute of whateverk<strong>in</strong>d due to the <strong>in</strong>accessibility of such paths or service roads or due to their poorcondition and or ma<strong>in</strong>tenance or their be<strong>in</strong>g to be blocked and/or closed.14.3 The rates quoted by the contractor as per Schedule of Items, Rates and Quantitiesshall form the basis of `on account payment' for the various items under thiscontract.14.4 In the course of execution of various items of work under Schedule of Items,Rates and Quantities runn<strong>in</strong>g bills payment for partly completed works will bemade to the contractor. The quantum of such work for payment shall be decidedby the Eng<strong>in</strong>eer-<strong>in</strong>-charge whose decision shall be f<strong>in</strong>al and b<strong>in</strong>d<strong>in</strong>g on thecontractor.23Signature of the tenderer/s


14.5 No ‘on account payment' by the Railway shall protect the contractor/s aga<strong>in</strong>st orprevent the Railway from recover<strong>in</strong>g from the contractor/s any over paymentmade to him/them.14.6 F<strong>in</strong>al payment of the balance amount due, exclusive of the security depositrequired <strong>in</strong> terms of Clause-5 of these special conditions, will be made after thecompletion of the entire work and on the certification of the Eng<strong>in</strong>eer that workhas been completed <strong>in</strong> all respects and found satisfactory. The security depositwill be refunded after the date of completion accord<strong>in</strong>g to Clause 5.1 of theseconditions.15.0 EMERGENCY WORK15.1 In the event of any accident or failure occurr<strong>in</strong>g <strong>in</strong> or about the work of aris<strong>in</strong>gout for or <strong>in</strong> connection with the construction completion or ma<strong>in</strong>tenance of thework which <strong>in</strong> the op<strong>in</strong>ion of the Eng<strong>in</strong>eer require immediate attention, theRailway may be with its own workmen or other agency execute or partly executethe necessary work or carry out repairs if the Eng<strong>in</strong>eer considers that thecontractor is not <strong>in</strong> a position to do so <strong>in</strong> time and charge the cost thereof, as tobe determ<strong>in</strong>ed by the Chief Eng<strong>in</strong>eer/Const., to the contractor.15.2 In terms of clause 32 of GCC of July 2005, the material and plants brought by thecontractor on the site or land occupied by the contractor <strong>in</strong> connection with theworks and <strong>in</strong>tended to be used for execution thereof shall immediately, they arebrought upon the sites of this said land be deemed to be the property of theRailway, vehicles, equipments, plant and mach<strong>in</strong>ery of the contractor can bedrafted by the Railway Adm<strong>in</strong>istration at their discretion <strong>in</strong> case of accidents,natural calamites <strong>in</strong>volv<strong>in</strong>g human lives, breaches, stoppage of tra<strong>in</strong> operations orany cont<strong>in</strong>gencies which require such requisition<strong>in</strong>g as essential. The decision <strong>in</strong>this regard of the Eng<strong>in</strong>eer-<strong>in</strong>-charge or his superiors i.e. Sr. Eng<strong>in</strong>eer/ ExecutiveEng<strong>in</strong>eer/Dy. Chief Eng<strong>in</strong>eer etc., shall be f<strong>in</strong>al and beyond the ambit ofarbitration clause.15.3 In terms of clause 2.3.2(A) (IV), tenderer is required to submit the list ofequipment, mach<strong>in</strong>ery, construction tools and plants available/deployed at site.The successful tenderer on receipt of acceptance letter and convey<strong>in</strong>g theirconsent shall submit name, addresses, telephone numbers, Fax number/E Mailaddress of the persons to be contacted for requisition<strong>in</strong>g the above items asdetailed <strong>in</strong> forgo<strong>in</strong>g clause 15.2 and notify from time to time if any change <strong>in</strong> thelist of equipments/mach<strong>in</strong>ery or the addresses/<strong>in</strong>dividuals to the Eng<strong>in</strong>eer-<strong>in</strong>charge<strong>in</strong> writ<strong>in</strong>g. The name and address, telephone numbers and the contractorofficials name shall also be displayed at the site of work.15.4 The manpower, consumable items and ma<strong>in</strong>tenance of the above tools and plantswhen requisitioned shall be the responsibility of the tenderer/ contractor so that24Signature of the tenderer/s


the equipments, mach<strong>in</strong>ery, tools and plants shall be available for effectiveutilization at the accident sites, natural calamities, breaches sites etc.15.5 The hire charges per annum shall be calculated at the follow<strong>in</strong>g rates on thepurchase cost of the plant as under:(i)(ii)(iii)(iv)(v)(vi)Depreciation charges at the follow<strong>in</strong>g ratesa) Light plant 16% per annumb) Heavy plant 10% per annumc) Special plant 6% per annumAn additional 10% on the total of (i) above to meet cont<strong>in</strong>gencies10% contractor profit on total cost as detailed (i) to (ii)The hire charges per day shall be arrived at divid<strong>in</strong>g the annual hirecharges of total of (i) to (iii) above by 365 which shall be the assumednumber of work<strong>in</strong>g days <strong>in</strong> year for this purpose. These hire charges willbe payable from the date the plant is handed over to the Railway to date onwhich it is returned to the contractor by Railway.The contractor man power charge shall be payable @ m<strong>in</strong>imum wages asnotified by the State Govt.,/local bodies/labour Department as the casemay be for highly skilled, semi skilled personnel drafted for operat<strong>in</strong>g theplant and mach<strong>in</strong>ery.The payment for the fuel cost shall be paid on the basis of the actualexpenditure <strong>in</strong>curred by the contractor for purchase +10% contractor'sprofit thereof which will be the payments towards his miscellaneousexpenses too.16.0 NIGHT WORK16.1 If the Eng<strong>in</strong>eer is satisfied that the work is not likely to be completed <strong>in</strong> timeexcept by resort<strong>in</strong>g to night work, he may order without confirm<strong>in</strong>g any right onthe contractor for claim<strong>in</strong>g any extra payment for the same.17.0 DISPOSAL OF SURPLUS EXCAVATED MATERIALS17.1 The contractor shall at all time keep the site free from all surplus earth,surplus materials, and all rubbish which shall arise from the works and shoulddispose of the surplus excavated materials as ordered by the Eng<strong>in</strong>eer25Signature of the tenderer/s


fail<strong>in</strong>g which it will be done at the cost of the contractor and cost will bededucted from his dues.17.2 The contractor shall with<strong>in</strong> 15 days of completion of entire works remove allunused and surplus materials tools and plants stag<strong>in</strong>g and refuge or othermaterials produced by his operations and shall leave the site <strong>in</strong> a clear and tidyconditions.18.0 SITE INSPECTION REGISTER18.1 A site <strong>in</strong>spection register will be ma<strong>in</strong>ta<strong>in</strong>ed by the Eng<strong>in</strong>eer or his representative<strong>in</strong> which the contractor will be bound to sign day to day entries made by theEng<strong>in</strong>eer or his representative. The contractor is required to take note of the<strong>in</strong>structions given to him through the site <strong>in</strong>spection register and shouldcomply with the same with<strong>in</strong> a reasonable time. The contractor will alsoarrange to receive all the letters etc., issued to him at the site of works.18.2 The contractor shall, from time to time (before the surface of any portion orthe site is <strong>in</strong>terfered with or the work thereon begun) take such levels as theEng<strong>in</strong>eer may direct <strong>in</strong> his presence or any person authorized by him <strong>in</strong> writ<strong>in</strong>g.Such levels approved and checked by him or such authorized persons shall berecorded <strong>in</strong> writ<strong>in</strong>g and signed by the contractor and shall form the basis of themeasurements. Immediately before any portion of the work,19.0 The contractor shall have to make and ma<strong>in</strong>ta<strong>in</strong> at his own cost suitable approachroad and path, etc., for proper <strong>in</strong>spection of the various works. He shall alsoprovide all facilities as required by the Eng<strong>in</strong>eer such as Ladder and otherappliances for satisfactory <strong>in</strong>spection of the works and places where materials forthe work are stored or prepared.20.0 OPENING UP OF WORK OR MATERIALS FOR INSPECTION OR TEST:Should the Eng<strong>in</strong>eer, or any representative consider it necessary for thepurpose of enabl<strong>in</strong>g <strong>in</strong>spection of tests analysis to be made to verify orascerta<strong>in</strong> the quality of any part of the works or of any materials, the contractorshall as and when required by the Eng<strong>in</strong>eer or his representatives open up thework or materials for <strong>in</strong>spection or test or analysis, pull down or cut <strong>in</strong>to any partof the work to make such open<strong>in</strong>gs, <strong>in</strong>to under or through any part of theworks as may be directed and shall/provide all th<strong>in</strong>gs facilities which <strong>in</strong> theop<strong>in</strong>ion of the Eng<strong>in</strong>eer or his representative are necessary and essential for thepurpose of <strong>in</strong>spection or test or analysis of the works or of any part thereof or thematerials, or of workmanship and the contractor shall close up, cover, rebuild andmade good the whole at his own cost, as and when directed by and to thesatisfaction of Eng<strong>in</strong>eer provided always that of the work <strong>in</strong> the op<strong>in</strong>ion of theEng<strong>in</strong>eer is found to his satisfaction and <strong>in</strong> accordance with the contract. excess expenditure <strong>in</strong> such exam<strong>in</strong>ation, <strong>in</strong>spection or test shall, upon thecertificate of the Eng<strong>in</strong>eer, be borne by the Railways.21.0 GENERAL21.1 PROVISION OF LIGHT SIGNALS ETC.,The contractor/s shall make such provision for light<strong>in</strong>g the works, materials andplant and provide all such marks and lights, signals and other appliances as may benecessary or as may be required by the Eng<strong>in</strong>eer or other responsible authoritiesdur<strong>in</strong>g the execution completion and ma<strong>in</strong>tenance of the work and shall provide alllabour, stores, etc. required for their efficient work<strong>in</strong>g and use at any time of day ornight. He/They shall also provide all arrangement of every description ofwatch<strong>in</strong>g and ma<strong>in</strong>tenance required <strong>in</strong> connection with the forego<strong>in</strong>g and all otherservices for protection of any secur<strong>in</strong>g all dangerous places whether to thecontractor's workmen or to other persons and or vehicular traffic until the work iscertified by the eng<strong>in</strong>eer to have been completed and taken over <strong>in</strong> accordance withthe contract.21.2 The contractor/s will provide upon the works to the satisfaction of the Eng<strong>in</strong>eerand at such, places as he may nom<strong>in</strong>ate, proper and sufficient life sav<strong>in</strong>g, firefight<strong>in</strong>g and first aid appliances which shall at all times be available for use.21.3 LABOUR CAMPSLand for sett<strong>in</strong>g up a workshop by the contractor or for his labour camp or for anyother purpose, shall have to be arranged by the contractor at his own cost andunder his own arrangements. The contractor, however, will be permitted to makeuse of the railway land to the extent that can be made available to him free of cost,by the railway <strong>in</strong> the vic<strong>in</strong>ity of the site of works.The contractor/s shall at all times be responsible for any damage or trespasscommitted by his agent and workmen for carry<strong>in</strong>g out the work.21.4 The Railway Adm<strong>in</strong>istration may recommend to the concerned authorities theissue of necessary transport permits for the work. The contractor shall, however,furnish full justification for the above facilities, to enable the RailwayAdm<strong>in</strong>istration to address the State Government or other authorities <strong>in</strong> thisconnection. The contractor shall also ma<strong>in</strong>ta<strong>in</strong> regular log book of receipts andissue of the materials to work, if so required by the Civil Authorities. No claimwould, however, be enterta<strong>in</strong>ed by the non-issue of any priority permits or ow<strong>in</strong>gto any <strong>in</strong>terruption <strong>in</strong> supply.21.5 No claim for idle labour and or idle mach<strong>in</strong>ery etc. on any account will beenterta<strong>in</strong>ed. Similarly no claim shall be enterta<strong>in</strong>ed for bus<strong>in</strong>ess loss or any suchloss.27Signature of the tenderer/s


22.0 Attention is <strong>in</strong>vited to Clause 17(B) of the G.C.C and Clause 8.1 of tenderconditions accord<strong>in</strong>g to which time is the essence of the contract.23.0 SALES TAX/Turn Over/Local Tax, etc.Sales Tax <strong>in</strong>clud<strong>in</strong>g Turn Over Tax on works contract, Octroi, Royalty, Toll Tax,Local Tax, Duties/Levies as well as Services and any other Tax levied by CentralGovt., State Govt. or Local Bodies, as applicable on the date of quot<strong>in</strong>g the ratesand any change there<strong>in</strong> at a later date, shall be considered to be <strong>in</strong>cluded <strong>in</strong> therates quoted by tenderer/s <strong>in</strong> the <strong>Tender</strong> Schedule.Railways shall deduct the sales tax/Turn Over Tax or any other Tax from theContractor’s bill at the rate as applicable as per rules framed by concernedGovt./Local bodies from time to time and remit it to concerned department andshall issue a certificate regard<strong>in</strong>g Tax/Duties/Levies so deducted on demand bythe contractor.23.1 The successful tenderer on award of contract will have to furnish contractor’sBank Account Number and Name of the Bank aga<strong>in</strong>st which all payments <strong>in</strong>respect of the contract dur<strong>in</strong>g the currency of contract shall be made.24.0 All payments <strong>in</strong> respect of the contract dur<strong>in</strong>g the currency of the contract shallbe made through Electronic Clear<strong>in</strong>g System (ECS) / Electronic Funds Transfer(EFT). The successful tenderer on award of contract must submit ECS/EFTMandate Form complete <strong>in</strong> all respects as detailed at Annexure-J of the tenderdocument. However, if the facility of ECS / EFT is not available at a particularlocation the payment shall be made by Cheque. In such case the successfultenderer on award of contract will have to furnish contractor’s Bank AccountNumber and Name of the Bank aga<strong>in</strong>st which all payments <strong>in</strong> respect of thecontract dur<strong>in</strong>g the currency of contract shall be made.25.0 Damage to the Railway Property:Contractor(s) execut<strong>in</strong>g the works adjacent to the exist<strong>in</strong>g Railway track for e.g.doubl<strong>in</strong>g, gauge conversion, yard remodel<strong>in</strong>g etc. will take all care for avoid<strong>in</strong>gany damage to the underground/OH services such as S&T cables, electriccables/wires, pipel<strong>in</strong>es/sewer l<strong>in</strong>es etc. They must ensure that the work is startedafter obta<strong>in</strong><strong>in</strong>g clearance <strong>in</strong> writ<strong>in</strong>g from the Eng<strong>in</strong>eer-<strong>in</strong>-charge regard<strong>in</strong>g theroute for signal<strong>in</strong>g/ Electrical cables/water supply/sewer l<strong>in</strong>es etc. However, ifany damage occurs dur<strong>in</strong>g execution, he will immediately report the same to theEng<strong>in</strong>eer-<strong>in</strong>-charge and stop the work further till clearance for restart<strong>in</strong>g the workis given by the Eng<strong>in</strong>eer-<strong>in</strong>-charge. It may be further noted that if it is provedthat damage is occurred due to the negligence on the part of the contractor, thecost of the damage will be recovered from him/them. The decision of Eng<strong>in</strong>eer<strong>in</strong>-chargewill be f<strong>in</strong>al and b<strong>in</strong>d<strong>in</strong>g upon the contractor(s).28Signature of the tenderer/s

These draw<strong>in</strong>gs are meant forgeneral guidance only and <strong>in</strong> terms of clause 7 of Special tender conditions andInstruction to <strong>Tender</strong>er/s, Railway may suitably modify them, without mak<strong>in</strong>g theRaiway’s liable for any claims on account of such changes or delay <strong>in</strong>modification of the plan.5.0 SUPPLY OF DRAWINGS:The Railway, dur<strong>in</strong>g the course of execution of work may supply detailedwork<strong>in</strong>g draw<strong>in</strong>g if required by the agency/Contractor.It may clearly be noted that the CAO/IRPMU/Dy Chief Eng<strong>in</strong>eer/IRPMU shallhave full power to make alterations <strong>in</strong> the draw<strong>in</strong>gs and to give such further<strong>in</strong>struction directions as may appear to him necessary for the guidance of thecontractor and for the officials for execution, completion and ma<strong>in</strong>tenance of thework, if required dur<strong>in</strong>g execution of the work.47Signature of the tenderer/s


The plan, sites and items of work are subject to alterations to suit the localconditions as per requirement of the Railway and the contractors will have noclaim on account of the change <strong>in</strong> plan, sites and items of work etc.6.0 CEMENT:6.1 Ord<strong>in</strong>ary Portland cement grade-33/43 conform<strong>in</strong>g to IS: 8112 capable ofachiev<strong>in</strong>g the required Design concrete strength shall only be used, If contractordesire to use ready factory made blended cement with the precautions regard<strong>in</strong>gcur<strong>in</strong>g and limitations with the specific approval of Dy, Chief Eng<strong>in</strong>eer.6.2 To improve the workability of concrete admixtures conform<strong>in</strong>g to IS: 6925 AND is:9103 could be permitted subject to satisfactory proven use. Admixturesgenerat<strong>in</strong>g hydrogen, nitrogen, chlorides etc, shall not be used.6.3 Cement content <strong>in</strong> concrete for PSC work shall neither be less than 400 kg/cum ofconcrete nor more than 500 kg/cum of concrete <strong>in</strong> design mix.6.4 Quality test certificate for cement from manufacturer as per IS Code shall beproduced by the contractor before use of Cement supplied.6.5 The contractor shall procure cement for use <strong>in</strong> the works from the ma<strong>in</strong> producersor their authorized dealers only.6.6 Cement older than 6 weeks from the date of manufacture as marked on the bagsshall not be accepted. Cement bags preferably <strong>in</strong> HDPE bags pack<strong>in</strong>g should bearthe follow<strong>in</strong>g mark<strong>in</strong>gs:-(i)(ii)(iii)(iv)(v)Manufacturer’s NameRegistered trademark of manufacturer, if any.Type of cement.Weight of each bad <strong>in</strong> Kg or No. of Bags/Tonne.Time/Period of manufacture generally marked as week of the year/year ofmanufacture.6.7 Every delivery of cement shall be accompanied by a producer’s certificateconfirm<strong>in</strong>g that the supplied cement conforms to relevant specifications, Everyconsignment of cement must have identification marks on packages <strong>in</strong>dicat<strong>in</strong>gdate of manufactur<strong>in</strong>g and grade and type of cement.6.8 Railway may also take samples dur<strong>in</strong>g the course of execution of works and getcement tested to ascerta<strong>in</strong> its conformity to the relevant IS specificationcontractor’s cost particular lot is put to use.48Signature of the tenderer/s

For this purpose 2set of register duly reconciled and signed by the contractor and the Inspector <strong>in</strong>charge of work certify<strong>in</strong>g the open<strong>in</strong>g balance consumption, clos<strong>in</strong>g balanceshould be ma<strong>in</strong>ta<strong>in</strong>ed. One register each shall be kept <strong>in</strong> the custody of Inspector<strong>in</strong> charge of work and the contractor or his representative.6.12 The Contractor shall be the custodian of cement godown and shall keep the godownunder his lock and key to ensure safe custody of cement. The contractor shallensure that cement once brought to the site and accounted for shall be used at thesite only and shall not be taken away from site for any other purpose.6.13 The contractor shall make the cement godown available to the site Eng<strong>in</strong>eer orhis representative as and when required.6.14 Land for construct<strong>in</strong>g the temporary cement godown shall be handed over by theRailway on the written request of the contractor free of any rent.6.15 The Contractor shall ensure that after completion of the work and/or determ<strong>in</strong>ationof the contract for any reason whatsoever, the temporary cement godown shall bedismantled and all dismantled materials/debris shall be removed and the celar siteshall be handed over back to Railways. All the released material shall be theproperty of the contractor and no payment shall be made by the Railway fordismantl<strong>in</strong>g etc. The f<strong>in</strong>al bill & Earnest Money/Security deposit shall not bereleased unless the godown is dismantled and the site is cleared <strong>in</strong> all respects.6.16 The consumption of cement on works shall be assessed on the basis of cementcontents per unit quantity for various items of work as per N.C.R. SOR-96. Incase of Designed Mix of Concrete of specified strength where the cement is to beused by weight where specially ordered <strong>in</strong> the N.S. items rate or tenderconditions, a variation of + 1% (Max) will be allowed <strong>in</strong> the consumption ofcement on works.49Signature of the tenderer/s


6.17 Stack<strong>in</strong>g of cement <strong>in</strong> the godown shall be done on a layer of wooden sleepers, so asto avoid contact of cement bags with the floor or alternatively scrap G.I. sheetsmay also be used <strong>in</strong> place of sleepers but these must be placed at least 20 cmabove the floor. The bags shall be stacked at least 30 cm clear of the walls toprevent deterioration. The wooden Sleepers/Scrap G.I. sheets shall be arranged bythe contractor at his own cost.6.18 Cement shall be stored <strong>in</strong> such a manner so as to permit easy access for proper<strong>in</strong>spection. Cement should be stacked not more that ten layers high to preventburst<strong>in</strong>g of bags <strong>in</strong> the bottom layers and formation of clods. The stacks of cementbags shall be covered with tarpaul<strong>in</strong> dur<strong>in</strong>g ra<strong>in</strong>y season/ra<strong>in</strong>s so as to obviate thepossibility of deterioration of cement by moisture <strong>in</strong> the atmosphere. Cement,which is set or partially set, is on no account to be used.6.19 he cement brought to the site Godown <strong>in</strong> excess of the requirement calculated basedon the cement factors shall be taken back by the contractor on completion of thework after written approval from AEN/XEN on proper document.6.20 Cement actually consumed on works shall normally match the quantity calculated asper cement factors for various items. If, it is discovered that the cement actuallyconsumed at site is less than the quantity ascerta<strong>in</strong>ed tak<strong>in</strong>g <strong>in</strong>to consideration thecement factors for various items by more than 1% the cost of the cement not soused (i.e. difference between the quantity of cement calculated as per cementfactors and cement actually consumed) shall be recovered at double the quotedrate from the contractor.6.21 Empty cement bags will be the property of the contractor.6.22 Cement and steel for use <strong>in</strong> the works should be procured by the contractor from thema<strong>in</strong> producers/their authorized dealers/authorized stockyards and these shouldconform is IS Specifications.6.23 Railway reserves their right to prohibit the use of any cement bag/bagsnotwithstand<strong>in</strong>g the fact the same may have been approved previously.7.0 PROCUREMENT OF RAW MATERIAL7.1 The cement, steel, CI Pipes & their fitt<strong>in</strong>gs <strong>in</strong>clud<strong>in</strong>g all other material requiredfor the work will have to be arranged by the contractor. The Railway will notsupply any material. The contractor shall make his own arrangements forprocurement of these materials <strong>in</strong> time for expeditious completion of the workcovered <strong>in</strong> the contract. The Railway shall not be responsible for any loss or anydamage <strong>in</strong>curred by the contractor <strong>in</strong> connection with such procurement ofmaterials or expeditious completion of the work.50Signature of the tenderer/s


7.2 All steel shall be free from oil and grease, pa<strong>in</strong>t, loose mill scale, loose rust andother matter likely to adversely affect the bond with concrete, Every delivery ofsteel shall be accompanied by a maker’s certificate of cast analysis confirm<strong>in</strong>gthat the supplied steel conforms to relevant specifications every consignment ofsteel must have identification marks on packages7.3 Railway may also take samples dur<strong>in</strong>g the course of execution of works and getsteel tested to ascerta<strong>in</strong> its conformity to the relevant IS a specification atrailway’s cost before a particular lot is put to use. If test<strong>in</strong>g charges paid by thecontractor the amount will be reimbursed to the contractor on production of bill ofthe test<strong>in</strong>g <strong>in</strong>stitution.8.0 INSPECTION OF MATERIAL:8.1 Inspection of materials like steel/cement to be procured/procured by thecontractor will be carried out by the Railway or their nom<strong>in</strong>ee for which at leastone-week must be given to the a Railway or their nom<strong>in</strong>ee.8.2 Quality test certificate for cement and steel as per relevant I.S code or as desiredby Eng<strong>in</strong>eer-<strong>in</strong>-charge shall be furnished by the contractor at his own cost fromthe manufacturer before use. The sample tested on railway’s cost dur<strong>in</strong>gexecution. In case of samples tested do not pass the quality tests conducted theentire quantity of the batch of cement/steel supplied shall be rejected andreturned to the contractor at his cost.9.0 CERTIFICATION OF INSPECTION AND APPROVAL:9.1 Material shall not be used <strong>in</strong> any case <strong>in</strong> the work until and unless it is certified bythe Eng<strong>in</strong>eer or their nom<strong>in</strong>ee <strong>in</strong> writ<strong>in</strong>g that they have <strong>in</strong>spected the material andapproved by them on behalf of makers certificate or tested <strong>in</strong> the test<strong>in</strong>g<strong>in</strong>stitutions.10.0 SERVICE ROAD10.1 Any service road required by the contractor for his/their use along the alignmentwill be provided by the contractor and shall be born by the contractor if requiredfor transport<strong>in</strong>g of material/vehicle etc.However, contractor may be permitted tomake use of exist<strong>in</strong>g service roads, or service roads constructed by the Railwaysfor its use, free of cost subject to ma<strong>in</strong>ta<strong>in</strong><strong>in</strong>g the service roads <strong>in</strong> its orig<strong>in</strong>alshape throughout the work.11.0 WATER SUPPLY:11.1 The contractor shall be responsible for the arrangements to obta<strong>in</strong> clean watersupply necessary for the work as well as for dr<strong>in</strong>k<strong>in</strong>g water for his labourers at hisown cost, and the quoted rates shall be deemed to <strong>in</strong>clude the cost of such watersupply arrangements. may give assistance only to the extent of recommend<strong>in</strong>g the contractor’sapplication for water supply to any authority for arrang<strong>in</strong>g such supply.12.0 INTERUPTION OF WORKS DURING MONSOONS:-The contract period will extend over a monsoon. The contractor should therefore,plan and prepare his work keep<strong>in</strong>g this fact <strong>in</strong> m<strong>in</strong>d.13.0 PATENTED DEVICES MATERIALS AND PROCESSES:-When the contractor desires to use any designed device, material or processcovered by a letter of patent or copy right, the right for such use shall be securedby suitable legal arrangement and agreement with patent owner and copy of theagreement shall be filed with Railways if so required. The contractor shall also<strong>in</strong>demnify railways aga<strong>in</strong>st any claims aris<strong>in</strong>g out of above.14.0 MAINTENANCE PERIOD:-14.1 The ma<strong>in</strong>tenance period of the permanent works shall be treated as 06 (six)months from the date of completion.14.2 No part refund of security deposit shall be permitted dur<strong>in</strong>g the ma<strong>in</strong>tenanceperiod.15.0 SETTING OUT OF WORKS15.1 The contractor is to set out the whole of the work <strong>in</strong> consultation with an official tobe deputed by the Eng<strong>in</strong>eer <strong>in</strong> charge and dur<strong>in</strong>g progress of the work to amend onthe requisition of the Eng<strong>in</strong>eer, any error which may arise their <strong>in</strong> and provideefficient and sufficient staff and labour thereof. The contractor shall also amend oralter any error <strong>in</strong> the dimensions, l<strong>in</strong>es or levels to the satisfaction of the Eng<strong>in</strong>eer<strong>in</strong> charge or his authorised representative without claim<strong>in</strong>g any compensation forthe same.15.2 The contractor at his own cost shall provide fix and be responsible for thema<strong>in</strong>tenance of all stakes, templates, profiles, land mark, po<strong>in</strong>ts, burgees,monuments, center l<strong>in</strong>e pillars, reference pillars etc. and shall take all precautionsto prevent these be<strong>in</strong>g removed, altered or disturbed and will be responsible for theconsequences of such removals, alterations, or disturbance and for their efficientre<strong>in</strong>statement.16.0 LAY OUT:16.1 Alignment and layout pillars as may be considered necessary by the Eng<strong>in</strong>eer-<strong>in</strong>chargeupto formation level beh<strong>in</strong>d each of the bridge abutments should be52Signature of the tenderer/s


constructed by the contractor at his own cost to de-note center l<strong>in</strong>e. These shall beso constructed that there are adequate facilities for climb<strong>in</strong>g on the top of the samewith proper work<strong>in</strong>g space for conduct<strong>in</strong>g theodolite work. Necessarybase/reference l<strong>in</strong>es and pillars as & where required for sett<strong>in</strong>g out of the bridgeand execution work are also to be constructed and ma<strong>in</strong>ta<strong>in</strong>ed by contractorwithout any extra cost as per directions of the Eng<strong>in</strong>eer-<strong>in</strong>-charge.17.0 EARTHWORK IN CUTTING AND EMBANKMENTS:17.1 Earthwork will be done with contractors own earth by borrow<strong>in</strong>g the earth fromout side the railway land and the rate quoted will be deemed to be <strong>in</strong>clusive of alltaxes, royalty, lead<strong>in</strong>g, load<strong>in</strong>g, unload<strong>in</strong>g, handl<strong>in</strong>g and re-handl<strong>in</strong>g of earth, allleads, lifts, ascents, descents, cross<strong>in</strong>g of nallahs, steams, tracks, level cross<strong>in</strong>g,levell<strong>in</strong>g, dress<strong>in</strong>g as a complete jobs <strong>in</strong> all respects as per specifications <strong>in</strong>dicated<strong>in</strong> succeed<strong>in</strong>g paras. The earthwork shall be compacted mechanically us<strong>in</strong>gvibratory rollers as per specifications.17.2 The soil has to confirm to “RDSO guidel<strong>in</strong>es for earthwork <strong>in</strong> railway projectsJuly, 2003”. The Eng<strong>in</strong>eer-<strong>in</strong>-charge may ask the contractor/s to get the soilsamples tested as per ISI specifications. It may please be noted that <strong>in</strong> nocircumstances the contractor/s will be allowed to form the bank with unapprovedearth. Such tests may be repeated by the Eng<strong>in</strong>eer-<strong>in</strong>-charge dur<strong>in</strong>g the executionof the earth work. The soil samples for which soils are found not confirm<strong>in</strong>g tothe required specifications, the contractor may have to br<strong>in</strong>g earth from otherapproved source. The cost of all tests will have to be borne by the contractor/s.17.3 The contractor/s shall provide all stakes, ballies, bamboo, str<strong>in</strong>gs, pegs and labourfor sett<strong>in</strong>g out profiles of embankment required for the correct execution of thework and shall also be responsible to ma<strong>in</strong>ta<strong>in</strong> <strong>in</strong> the proper order. He is alsorequired to provide labour for the sett<strong>in</strong>g of the same when called upon to do so.This is deemed to <strong>in</strong>cluded <strong>in</strong> the item rate for the earthwork. The contractor/sshall pay necessary precaution to prevent them be<strong>in</strong>g removed altered anddisturbed and shall be responsible for the consequence of such removal alterationsand disturbance and will take action for the proper re<strong>in</strong>statement17.4 The contractor shall be liable to set up field laboratory with adequate equipment soas to carryout tests of the soil as per ISI codes/RDSO guidel<strong>in</strong>es.The contractor shall also be required to provide full assistance for carry<strong>in</strong>g outthese tests, i.e. labour and other materials etc. The rates quoted by the contractorfor earthwork deemed to have <strong>in</strong>cluded of this element and noth<strong>in</strong>g extra shall bepayable on this account.Eng<strong>in</strong>eer-<strong>in</strong>-charge, if required may get the soil samples tested from any outsideagency as deemed suitable and the cost for the same, if any shall to be borne bythe contractor.53Signature of the tenderer/s


17.5 Before the earthwork is started by the contractor, the ground between the l<strong>in</strong>ewhere fill<strong>in</strong>g/excavation is to be done for embankments, cutt<strong>in</strong>g & tra<strong>in</strong><strong>in</strong>g worksshall be cleared of all trees along with roots, shrubs, heavy grass and under growthof every k<strong>in</strong>d. While clear<strong>in</strong>g grass/shrubs from the slopes of exist<strong>in</strong>gembankment, the profile of the exist<strong>in</strong>g bank should not be altered. None of theitems of work mentioned <strong>in</strong> this para will amount the contractor’s to any extrapayment.17.6(a) All trees fall<strong>in</strong>g <strong>in</strong> the Forest Reserve Land shall be cut by respective ForestDepartment. But their roots if rema<strong>in</strong>s shall have to be up-rooted by thecontractor for which no extra payment will be made. However, the uprootedroots shall be the property of the contractor. However if required contractorwill have to cut & transport the trees to nearest forest depot at his own cost.(b) All trees fall<strong>in</strong>g <strong>in</strong> Govt. land handed over to Railways for Railway custody,if <strong>in</strong>sisted by concerned State Govt. will be the property of state Govt., whomay also cut these trees, otherwise contractor will uproot the trees and it willbe the contractor’s property and may be disposed off at their end with ownarrangements. However necessary rebate for tree hav<strong>in</strong>g girth more than 30cm may be taken as per relevant N.S. item and noth<strong>in</strong>g shall be paid extra onthis account.17.7 The decision of Railways <strong>in</strong> respect of ownership of trees <strong>in</strong> (a) & (b)above shall be f<strong>in</strong>al & b<strong>in</strong>d<strong>in</strong>g upon the contractor. In all casesbushes/heavy grass etc. have to be cut by the contractor and rates quoted forearthwork will be deemed to be taken <strong>in</strong> account these elements.17.8.1 The Contractor should commence work systematically at one or morepo<strong>in</strong>ts <strong>in</strong> consultation with the Eng<strong>in</strong>eer and should ma<strong>in</strong>ta<strong>in</strong> cont<strong>in</strong>uous andsteady progress to complete the work <strong>in</strong> cont<strong>in</strong>uous length <strong>in</strong>clud<strong>in</strong>glevell<strong>in</strong>g and dress<strong>in</strong>g.17.8.2 Any extra earth deposited on the top and slopes of the formation shall beremoved with<strong>in</strong> 48 hours after a written notice. If not complied, the sameshall be removed by other means at contractor’s cost. Cost of which shall berecovered from contractor’s bill, the payment shall be made as per designedcross section only.17.9 It must be clearly understood that the rates are <strong>in</strong>tended to cover the full cost ofthe f<strong>in</strong>ished works. The banks and cutt<strong>in</strong>gs are to be correctly dressed to profilewith slopes as specified <strong>in</strong> each case by the Eng<strong>in</strong>eer-<strong>in</strong>-charge. The rates forearthwork shall also <strong>in</strong>clude the follow<strong>in</strong>g.1. Site clearance as per specifications <strong>in</strong>clud<strong>in</strong>g cutt<strong>in</strong>g of trees.2. 17.10 The rates also <strong>in</strong>clude ma<strong>in</strong>tenance of the banks and cutt<strong>in</strong>g to correct profile<strong>in</strong>clud<strong>in</strong>g repairs of all ra<strong>in</strong> cuts, mak<strong>in</strong>g good earth work due to settlement naturalor otherwise due to ra<strong>in</strong>s etc. <strong>in</strong> case of fill<strong>in</strong>g embankments and removal of cutsand slips that may be accumulated <strong>in</strong> cutt<strong>in</strong>g dur<strong>in</strong>g ra<strong>in</strong>s etc. until the f<strong>in</strong>almeasurement have been recorded and banks/cutt<strong>in</strong>g taken over by the Railways,the item rate of schedule of rates and quantities will cover the full cost of f<strong>in</strong>ishedwork of cutt<strong>in</strong>g and embankments.17.11 The follow<strong>in</strong>g category of soil shall not be permitted.1. Peat and organic soils.2. Chalk etc. which are likely to dis<strong>in</strong>tegrate.3. Poorly graded sands with Cu less than 3.4. Clays and silts of high compressibility i.e. MH & CH.5. Clays & silts hav<strong>in</strong>g high percentage of soluble salts.17.12 If the contractor does not attend the ra<strong>in</strong> cuts and other repairs required asprovided for <strong>in</strong> para 18.9 above with<strong>in</strong> one week of its report<strong>in</strong>g, the departmentshall be free to get it done as it deems fit and cost debited to the contractor.17.13 For the earthwork <strong>in</strong> formation & tra<strong>in</strong><strong>in</strong>g/protection work, the toes of the slopeof bank, cutt<strong>in</strong>g on one side of the centre l<strong>in</strong>e and also l<strong>in</strong>es parallel to and 60moutside the toes of slopes of banks should be demarcated by the contractor with adeep furrow at least 15cm deep. This is to be considered as part of sett<strong>in</strong>g out thework and prelim<strong>in</strong>ary to his be<strong>in</strong>g allowed to break ground. This lock spitt<strong>in</strong>g is tobe executed ma<strong>in</strong>ta<strong>in</strong>ed and renewed by him without any payment, whennecessary or and when ordered by the eng<strong>in</strong>eer.17.14 The contractor at his own cost shall provide, fix and be responsible for thema<strong>in</strong>tenance of all stretches, templates, profile, land marks, po<strong>in</strong>ts, burjis,,monuments, centre l<strong>in</strong>e pillars, reference pillars, etc. and shall take all necessaryprecautions to prevent their be<strong>in</strong>g removed/altered or disturbed and will beresponsible for the consequences of such removal, alterations, all disturbances andor their efficient re<strong>in</strong>statement.17.15 In some stretches earthwork <strong>in</strong> formation and protection works may extend <strong>in</strong>tolow ly<strong>in</strong>g area/s form<strong>in</strong>g ponds with water stand<strong>in</strong>g <strong>in</strong> the same. In such casescontractor/s shall have to provide at his/their own cost requisite and appropriatebunds <strong>in</strong> the ponds to clear the area for provid<strong>in</strong>g earth work and other protectionworks. Any dewater<strong>in</strong>g required to be done shall also be done by the contractor/sat their own cost. Noth<strong>in</strong>g extra shall be payable on this account. Item rate ofearthwork shall be deemed to <strong>in</strong>clude all the above elements of the work.17.16 The break<strong>in</strong>g of all clods will be strictly <strong>in</strong>sisted upon for all earthworks <strong>in</strong>embankment and the contractor must take special care to ensure this. Should atany time the contractor be found to be deviat<strong>in</strong>g from this requirement, the55Signature of the tenderer/s


Eng<strong>in</strong>eer-<strong>in</strong>-charge of work or his representative will, after giv<strong>in</strong>g 24 hours notice<strong>in</strong> writ<strong>in</strong>g to the contractor or his representative at site for rectify<strong>in</strong>g all suchdefects and <strong>in</strong> case of his non-compliance thereof, departmental labour for gett<strong>in</strong>gthe clods broken up shall be deployed. This will be cont<strong>in</strong>ued till contractor/smake/makes adequate arrangements to abide by the specifications. Whereas noextra payment will be made for break<strong>in</strong>g clods, the expenditure so <strong>in</strong>curred by theRailway as certified by the Eng<strong>in</strong>eer-<strong>in</strong>-charge together with 2% <strong>in</strong>cidentalcharges thereon, plus 12.5% departmental charges on the whole will be deducted<strong>in</strong> full from the contractor/s bills. Similar action will also be taken if thecontractor/ is/are found deposit<strong>in</strong>g earth on wrong places. No correspondence willbe enterta<strong>in</strong>ed from contractor/s <strong>in</strong> connection with the engagement ofdepartmental labour under the circumstances mentioned <strong>in</strong> this para and the ordersgiven by the eng<strong>in</strong>eer-<strong>in</strong>-charge or his representative will be f<strong>in</strong>ally conclusive andnot amendable to any appeal or revision.17.17 The tendered rate aga<strong>in</strong>st the earthwork will be applicable for all classes of soiland be <strong>in</strong>clusive of all leads, lifts, ascents, descents, cross<strong>in</strong>g of nallahas/ streams,level cross<strong>in</strong>gs or any other obstructions etc.17.18 The entire quantity of spoils excavated from the cutt<strong>in</strong>g <strong>in</strong>clud<strong>in</strong>g side and catchwater dra<strong>in</strong>s diversions and tra<strong>in</strong><strong>in</strong>g works, will have to be led and utilized forfill<strong>in</strong>g <strong>in</strong> embankments with<strong>in</strong> the zone irrespective of the lead <strong>in</strong>volved. Noborrow pits shall be permitted to be dug with<strong>in</strong> Railway land for fill<strong>in</strong>g <strong>in</strong>embankments. No cutt<strong>in</strong>g spoils shall be allowed to be dumped outside the cutt<strong>in</strong>gexcept where the spoil earth is found to be surplus after mak<strong>in</strong>g use of <strong>in</strong> fill<strong>in</strong>gthroughout zone and shall be dumped by arrang<strong>in</strong>g dump<strong>in</strong>g side at his own cost.No payment of carriage of earth spoil either by head lead or by trucks or by anyother mach<strong>in</strong>e or by any other method will be made <strong>in</strong>clud<strong>in</strong>g the cost of dump<strong>in</strong>gside etc. The tendered rate will be <strong>in</strong>clusive of earthwork <strong>in</strong> formation <strong>in</strong> cutt<strong>in</strong>g/diversion/tra<strong>in</strong><strong>in</strong>g works and dra<strong>in</strong>s and fill<strong>in</strong>g <strong>in</strong> embankments completed to thef<strong>in</strong>ished executed profile.17.19 The width, side slopes of embankment may be changed by the eng<strong>in</strong>eer if sofound necessary for stability of be bank. The contractor shall have no claimwhatsoever on account of change of side slopes or formation width. The decisionof eng<strong>in</strong>eer-<strong>in</strong>-charge for determ<strong>in</strong><strong>in</strong>g the slopes <strong>in</strong>itially or subsequently and formodify<strong>in</strong>g the slopes and formation width will be f<strong>in</strong>al and b<strong>in</strong>d<strong>in</strong>g and no claimwhatsoever shall be enterta<strong>in</strong>ed by Railways.17.20 The quantities of earthwork to be done <strong>in</strong> embankment etc. shown <strong>in</strong> schedule area mere guidance. This may vary as per actual calculation based on cross sectionalareas taken at site and plotted accord<strong>in</strong>gly.17.21 After site clearance all pockets and depression left <strong>in</strong> the soil, if any, shall bemade good and compacted.17.22 Generally only L-section of the alignment will be supplied to the contractor. Thetop of the formation shall be f<strong>in</strong>ished to a slope of 1 <strong>in</strong> 30 away from th+e edge of56Signature of the tenderer/s


exist<strong>in</strong>g track. The formation level shall be reckoned to be the level of the centerof the bank/ cutt<strong>in</strong>g. The berms where the height of bank or depth of cutt<strong>in</strong>g ismore shall have to be provided as per the direction of the Eng<strong>in</strong>eer-<strong>in</strong>-charge.17.23 Earthwork <strong>in</strong> formation at any level shall be required to be executed 50cm extrawide on either side than that required for f<strong>in</strong>al payment. This extra width shall bethen f<strong>in</strong>ished manually. The rate for earthwork shall be deemed to haveconsidered <strong>in</strong> this work and trimm<strong>in</strong>g is also <strong>in</strong>cluded <strong>in</strong> the rate.17.24 The contractor/s should commence work systematically from one or more po<strong>in</strong>ts<strong>in</strong> the zone <strong>in</strong> consultation with Eng<strong>in</strong>eer & ma<strong>in</strong>ta<strong>in</strong> cont<strong>in</strong>uous progresscomplet<strong>in</strong>g the bank and cutt<strong>in</strong>g <strong>in</strong> cont<strong>in</strong>uous length <strong>in</strong> all respects <strong>in</strong>clud<strong>in</strong>glevell<strong>in</strong>g and dress<strong>in</strong>g.17.25 FORMATION WIDTH ON CURVES: On curves the actual widths to beprovided should take <strong>in</strong>to account 150mm extra widen<strong>in</strong>g of ballast shoulder(500mm <strong>in</strong> place of 350mm) required on the outerside of curves as per para 263 ofIRWM and para 5.3.1 of LWR Manual. Thus, additions <strong>in</strong> the width on thisaccount will be 0.15 Mtr. for S<strong>in</strong>gle l<strong>in</strong>e and 0.30 Mtr for double l<strong>in</strong>e (<strong>in</strong>clud<strong>in</strong>g0.15 Mtr. Increase <strong>in</strong> track centres.)18.0 CUTTING:18.1 The tender rate aga<strong>in</strong>st relevant NS item of schedule of item, rates and quantitiesfor open excavation <strong>in</strong> cutt<strong>in</strong>g <strong>in</strong> formation will be applicable to all classes of soil,.This will be <strong>in</strong>clusive of all lead, lift, ascent, descent etc lead<strong>in</strong>g of spoils toearthwork <strong>in</strong> formation <strong>in</strong> the zone as per specifications of mak<strong>in</strong>g embankmentand disposal of surplus cutt<strong>in</strong>g, if any, at suitable dump<strong>in</strong>g site arranged by thecontractor at his own cost..19.0 PAYMENT:19.1 The payment for the quantity of earthwork <strong>in</strong> embankment and cutt<strong>in</strong>g will bemade on cross-sectional measurements. The exist<strong>in</strong>g ground profile will be takenand plotted by the Eng<strong>in</strong>eer’s representative <strong>in</strong> the presence of contractor or hisauthorised agent before commencement of the work. The profile of thecutt<strong>in</strong>g/bank as required to be provided <strong>in</strong>clud<strong>in</strong>g allowance for settlement <strong>in</strong> caseof bank will also be plotted on the same sheets. The level & cross sections shall besigned by both the eng<strong>in</strong>eer’s representative and the contractor/s or his authorisedagent. (The profile of the cutt<strong>in</strong>g/bank as required to be provided are for theguidance of the contractor and not for the purpose of the measurement).19.2 The profile of the f<strong>in</strong>ished and plotted cutt<strong>in</strong>g/bank will likewise be taken <strong>in</strong> thepresence of the contractor or his authorized agent and super-imposed on theorig<strong>in</strong>al ground profiles, the gross volume of earthwork <strong>in</strong> cutt<strong>in</strong>g will becalculated from the orig<strong>in</strong>al ground profile and f<strong>in</strong>ished profile of the cutt<strong>in</strong>g forthe purpose of payment.57Signature of the tenderer/s


19.3 In case of earthwork <strong>in</strong> fill<strong>in</strong>g gross quantity of compacted earth shall be reduced by5% towards shr<strong>in</strong>kage while 10% shr<strong>in</strong>kage will be deducted from the grossquantity of un-compacted earth for purpose of on account and f<strong>in</strong>al payment.These reductions shall be made irrespective of the type and the nature of soil andirrespective of the number of monsoon passed which may clearly be noted by thetenderer/s. The contractor shall have no claim of whatsoever nature on this account<strong>in</strong>clud<strong>in</strong>g claim for arbitration.19.4 F<strong>in</strong>al measurement will be taken only after the cutt<strong>in</strong>g/bank has been completed tothe required profile, irrespective of the prolongation of period of completion andnumber of monsoons that may pass dur<strong>in</strong>g execution.19.5 On account payment for earthwork <strong>in</strong> formation, diversion and tra<strong>in</strong><strong>in</strong>g works willnormally be made only for such length of bank/cutt<strong>in</strong>g as <strong>in</strong> the op<strong>in</strong>ion of theEng<strong>in</strong>eer has been f<strong>in</strong>ally executed to the full profile <strong>in</strong> terms of the conditions ofcontract. The contractors are therefore advised to complete the bank/cutt<strong>in</strong>g to thefull profile and proceed systematically <strong>in</strong> consultations with the Eng<strong>in</strong>eer so as tofacilitate on this account. On account payments may however be made at thediscretion of the Eng<strong>in</strong>eer-<strong>in</strong>-charge for <strong>in</strong>complete banks/cutt<strong>in</strong>gs under specialcircumstances, such on account payments will be made to the extent of 90% ofthe total quantity of work done. The Eng<strong>in</strong>eer-<strong>in</strong>-charge will decide whethersuch payments are to be made and his decision <strong>in</strong> regard to this shall be f<strong>in</strong>al andb<strong>in</strong>d<strong>in</strong>g on the contractor.19.6 All cutt<strong>in</strong>g and banks are to be executed and made up neatly to the l<strong>in</strong>es, shown <strong>in</strong>the cross-section. No payment will be made for excess work done outside thesel<strong>in</strong>es except when such work are so ordered <strong>in</strong> writ<strong>in</strong>g by the Eng<strong>in</strong>eer.20.0 BARRICADING:20.1 The contractor before start<strong>in</strong>g the construction work along the runn<strong>in</strong>g l<strong>in</strong>e shallhave to barricade the entire length of runn<strong>in</strong>g l<strong>in</strong>e along which the work has to becarried out. Barricad<strong>in</strong>g will also be done at all location where contractor’s vehiclewill ply along the track. Barricad<strong>in</strong>g has to be done as per approved plan and tothe entire satisfaction of the Eng<strong>in</strong>eer-<strong>in</strong>-charge.. Contractor has to take precautionthat the barricad<strong>in</strong>g should not fall towards the railway runn<strong>in</strong>g l<strong>in</strong>e.Payment for barricad<strong>in</strong>g will be made under relevant NS-item.21.0 FORM WORK:21.1 Form work shall be of steel plates of m<strong>in</strong>imum 3.0mm thick fixed on theangle iron frame or waterproof ply wood shutter<strong>in</strong>g of adequate thickness unlessotherwise directed by the Eng<strong>in</strong>eer-<strong>in</strong>- charge. It should be watertight, sufficientlystrong and rigid to resist forces caused by vibration and <strong>in</strong>cidental loadsassociated with it and keep the form rigid.21.2 If the work is to be executed <strong>in</strong> close proximity of runn<strong>in</strong>g track, the shutter<strong>in</strong>gshould be so planned so as not to <strong>in</strong>fr<strong>in</strong>ge with schedule of m<strong>in</strong>imum mov<strong>in</strong>g58Signature of the tenderer/s


dimension, B.G of 1963 (1973 repr<strong>in</strong>t). Shutter<strong>in</strong>g should be of self-support<strong>in</strong>gnature as no center<strong>in</strong>g or propp<strong>in</strong>g will be permitted on the runn<strong>in</strong>g track side.21.3 Work shall be executed without disturb<strong>in</strong>g the exist<strong>in</strong>g position of runn<strong>in</strong>g track asshown <strong>in</strong> plan and entire work should be planned accord<strong>in</strong>gly.21.4 If at any stage of work dur<strong>in</strong>g/ after plac<strong>in</strong>g the concrete <strong>in</strong> the structure, the workis found defective, such concrete shall be removed and work shall be redone withfresh concrete at the cost of contractor. The props for the centr<strong>in</strong>g whereverpermitted shall be supported by the double wedges <strong>in</strong> order to facilitate caus<strong>in</strong>g &removal of the shutter<strong>in</strong>g without jarr<strong>in</strong>g. Centr<strong>in</strong>g and shutter<strong>in</strong>g should becarefully released <strong>in</strong> order to prevent the load<strong>in</strong>g be<strong>in</strong>g <strong>in</strong>stantly transferred toconcrete. The period that shall lapse after the last pour of concrete for eas<strong>in</strong>gremoval of centr<strong>in</strong>g and shutter<strong>in</strong>g shall be fixed by the Eng<strong>in</strong>eer-<strong>in</strong>-charge andwill be b<strong>in</strong>d<strong>in</strong>g on the contractor/s.21.5 It may be necessary to make provision for holes/ grooves <strong>in</strong> the form work tohouse the various services, for which neither any extra payment shall be made tothe contractor/s for mak<strong>in</strong>g these provisions nor any deduction shall be made ona/c of any sav<strong>in</strong>g <strong>in</strong> RCC work due to these provision.21.6 Wherever chamfer or rounded corners are mentioned <strong>in</strong> the draw<strong>in</strong>g formwork,should be such that no chisell<strong>in</strong>g/ cutt<strong>in</strong>g is required. The surface of formworkshould be clear, smooth and free of cement mortar.21.7 The Contractor shall give the Eng<strong>in</strong>eer In-charge sufficient notice <strong>in</strong> advance beforeplac<strong>in</strong>g any concrete <strong>in</strong> the forms to permit him to <strong>in</strong>spect and accept the falsework and forms as to their strength, alignment and general fitness but such<strong>in</strong>spection shall not relieve the contractor of his responsibility for safety of works,men, mach<strong>in</strong>ery, materials and for result obta<strong>in</strong>ed.22.0 REMOVAL OF FORM WORK:22.1 The Eng<strong>in</strong>eer-In-Charge shall be <strong>in</strong>formed <strong>in</strong> advance by the contractor of his<strong>in</strong>tention While fix<strong>in</strong>g the time for removal of form work, due consideration shallbe given to the local conditions, character of the structure, the weather and theother conditions that <strong>in</strong>fluence the sett<strong>in</strong>g of concrete and of the material used <strong>in</strong>the mixs to strike any formwork.22.2 The period shall be suitably <strong>in</strong>creased <strong>in</strong> case of temperature lower than 25 degreeCelsius and for any other conditions tend<strong>in</strong>g to delay the sett<strong>in</strong>g of concrete.22.3 These field operation are controlled by strength tests of concrete. The removal ofthe load support<strong>in</strong>g arrangements of soffit may commence when concrete hasatta<strong>in</strong>ed 70% characteristic strength, at the time of strik<strong>in</strong>g props <strong>in</strong>clud<strong>in</strong>g theeffect of any further additions of loads. When field operations are not controlledby strength, test of the concrete, the vertical forms of beams, columns & wallsmay be removed as per orders of the Eng<strong>in</strong>eer- In-charge.59Signature of the tenderer/s


22.4 For prestressed units the side forms shall be released as early as possible after 12hours of cast<strong>in</strong>g and soffit forms shall be permitted without restra<strong>in</strong>t deformationof the member when prestressed is applied.22.5 All formwork shall be removed without caus<strong>in</strong>g any damage to be concrete.Centr<strong>in</strong>g shall be gradually and uniformly lowered <strong>in</strong> such a manner as to avoidany shock or vibrations. Supports shall be removed <strong>in</strong> such a manner as to permitconcrete to take stress due to its own weight uniformly and gradually. Where<strong>in</strong>ternal metal ties are permitted, their removable parts shall be extracted withoutcaus<strong>in</strong>g any damage to the concrete and the rema<strong>in</strong><strong>in</strong>g holes filled with mortar.No permanently embedded metal parts shall have less than 40mm cover to thef<strong>in</strong>ished concrete surfaces, where it is <strong>in</strong>tended to re-use released form work, itshall be cleaned and make good to the satisfaction of Eng<strong>in</strong>eer-<strong>in</strong>-charge.23.0 MEASUREMENT:23.1 All work will be paid for at the tendered rates on the basis of actual measurementstaken at site. Individual rate for each non-schedule item should be fore completef<strong>in</strong>ished work, <strong>in</strong>clusive of all operational charges. Noth<strong>in</strong>g extra will be payableon any account.24.0 PLAIN/REINFORCED CEMENT CONCRETE WORKS:24.1 The ISI and IRS code of practices for the structural use of re<strong>in</strong>forced concrete <strong>in</strong>bridges and build<strong>in</strong>g shall form part of the specifications for the above work.24.2 The IS”456-2000 code of practice for the structural use of re<strong>in</strong>forced concrete <strong>in</strong>build<strong>in</strong>g shall form part of all RCC items as additional specifications and this codeand standard practice <strong>in</strong> re<strong>in</strong>forced concrete construction <strong>in</strong>volved by the adoptionof this code shall be followed.25.0 SPECIFICATIONS FOR CONCRETE WORKS:25.1 (a) These specifications shall be read <strong>in</strong> conjunction with any otherspecifications for concret<strong>in</strong>g work given elsewhere <strong>in</strong> tender document.(b) Clear Cover will be provided as per draw<strong>in</strong>gs & specifications or as directedby the Eng<strong>in</strong>eer –<strong>in</strong>-charge.26.0 AGGREGATES FOR CONCRETING:26.1 COARSE AGRGREGATES: Coarse aggregates shall be crushed gravel/ crushedquarry rock and shall conform to requirements of IS: 383/IS: 456 & IS: 1343.60Signature of the tenderer/s


All coarse aggregate material shall be chemically <strong>in</strong>ert, strong, hard, of limitedporosity and free from adher<strong>in</strong>g coat<strong>in</strong>gs, clay and corrosion of the re<strong>in</strong>forcementso as not to affect the strength and durability of the concrete.26.2 FINE AGGREGATE: F<strong>in</strong>e aggregate shall be washed coarse sand of approvedquality and grad<strong>in</strong>g conform<strong>in</strong>g to IS: 383, IS: 456 & IS: 1343 standards. It shallbe free from impurities and deleterious substances.The decision of Eng<strong>in</strong>eer-<strong>in</strong>-charge shall be f<strong>in</strong>al regard<strong>in</strong>g approval of the coarseand f<strong>in</strong>e aggregate for the construction work. The contractor shall be required tocarry out wash<strong>in</strong>g and re-stack<strong>in</strong>g of aggregates as directed by Eng<strong>in</strong>eer Inchargeand the cost of the same deemed to be <strong>in</strong>cluded <strong>in</strong> the quoted rates.26.3 STORAGE OF AGGREGATES: Aggregates shall be delivered at site andstored <strong>in</strong> separate sizes as ordered by the Eng<strong>in</strong>eer-<strong>in</strong>-charge. The Eng<strong>in</strong>eer-<strong>in</strong>chargeshall decide and direct the contractor to br<strong>in</strong>g, stack and store aggregates<strong>in</strong> different sizes as he deems necessary for the proper quality control.Aggregates shall be stored or stock piled <strong>in</strong> such a manner that various sizes willnot become <strong>in</strong>termixed before proportion<strong>in</strong>g. These shall be stored, stock piledand handled <strong>in</strong> such a manner that will prevent contam<strong>in</strong>ation by foreigndeleterious material. In the case of f<strong>in</strong>e aggregates they shall be deposited at theMix<strong>in</strong>g site for not less than 8 hours before use and should be got tested andapproved by the Eng<strong>in</strong>eer.26.4 WATER: Clause 5.4 of IS: 456-2000 shall be applicable <strong>in</strong> place of clause 4.3of IRS Concrete Bridge Code. However, <strong>in</strong> case of prestressed concrete work thepermissible limit of solids must satisfy the follow<strong>in</strong>g:Permissible Limit.OrganicInorganicSulphates (SO4)Chlorides.Suspended matter.The PH value should not be less than 6.(Max.)200mg/ lit.3000mg/lit.500mg/lit.250mg/lit.2000mg/lit.26.5 STORAGE OF CEMENT: Cement shall be stored above the ground level <strong>in</strong>perfectly dry and watertight sheds and shall be stacked not more than eight bags<strong>in</strong> height. Wherever Bulk storage conta<strong>in</strong>ers are used, their capacity should besufficient to cater to the requirements at site and should be cleaned at least once<strong>in</strong> every 3 to 4 months.61Signature of the tenderer/s


27.0 ADMIXTURES FOR CONCRETE27.1 No Admixtures shall <strong>in</strong> general be allowed. Railways may however, permit ordirect admixtures for specific purpose for which specifications will be drawn andapproved <strong>in</strong> advance. Noth<strong>in</strong>g extra shall be payable for the admixtures and thecost of the same shall be deemed to have been catered for <strong>in</strong> accepted item rates.To improve the workability of concrete and cement grout admixtures conform<strong>in</strong>gto IS: 6925 and IS 9103 maybe permitted as directed by Eng<strong>in</strong>eer-<strong>in</strong>-chargesubject to satisfactory proven use. The decision of Eng<strong>in</strong>eer <strong>in</strong>-charge shall bef<strong>in</strong>al <strong>in</strong> this case. Admixtures generat<strong>in</strong>g hydrogen, nitrogen or conta<strong>in</strong><strong>in</strong>gchlorides shall not be used.28.0 MANUFACTURE, PLACEMENT & CURING OF CONCRETE:28.1 Manufacture:28.1.1 Mix<strong>in</strong>g of concrete shall conform to requirements <strong>in</strong> clause 10.3 of I.S :456:2000. Mix<strong>in</strong>g for concrete for controlled concrete and prestressed concrete workshall be done, unless otherwise agreed by Eng<strong>in</strong>eer-<strong>in</strong>-charge by batch typemixer, which shall comply with IS: 1791 or other such type as the Eng<strong>in</strong>eer-Inchargemay approve.28.1.2 Batch mixers will be tested for their performance <strong>in</strong> accordance with IS: 4634 orsuch other testes as the Eng<strong>in</strong>eer-<strong>in</strong>-charge may require.28.1.3 Mixers, which have been out of use for more than 30 m<strong>in</strong>utes, shall be thoroughlycleaned before putt<strong>in</strong>g <strong>in</strong> a new batch. Unless otherwise agreed to by theEng<strong>in</strong>eer. The first batch of concrete from the mixer shall conta<strong>in</strong> only two thirdsof the normal quantity of coarse aggregate. Mix<strong>in</strong>g plant shall be thoroughlycleaned before chang<strong>in</strong>g from one type of cement to another.28.1.4 Concrete shall not be mixed when the air temperature <strong>in</strong> the shade is below 3degree (Celsius 93.8 degree F) unless special precautions are taken which havebeen approved by the Eng<strong>in</strong>eer.Dur<strong>in</strong>g the hot weather the contractor shall ensure that the constituent materialsare sufficiently cool to prevent the concrete from stiffen<strong>in</strong>g <strong>in</strong> the <strong>in</strong>tervalbetween its discharge from the mixer and its f<strong>in</strong>al deposition.28.1.5 Concrete shall be mixed for not less than 120 seconds and nor more than 5m<strong>in</strong>utes from the time all constituents have been <strong>in</strong>troduced <strong>in</strong>to the mixer and tillall materials are uniformly mixed.29.0 COMPACTION OF CONCRETE29.1 All concrete members shall be compacted by vibration. Generally <strong>in</strong>ternalvibrators shall be used on all sections that are sufficiently large to admit them.62Signature of the tenderer/s


29.1. Vibrator shall have operat<strong>in</strong>g frequency of at least 3600 impulses per m<strong>in</strong>ute.Higher frequencies upto twice the m<strong>in</strong>imum are preferred.29.2 The follow<strong>in</strong>g techniques shall be followed for vibration:-i) Vibrators shall be so distributed so that the concrete becomes uniformlydense and plastic mass.ii)30.0 CURINGVibrators shall be used for compaction only, not for mov<strong>in</strong>g concretehorizontally along the form.iii) For horizontal and vertical operations of form vibrators, the spac<strong>in</strong>g ofpo<strong>in</strong>ts of vibration shall be such that the zones of <strong>in</strong>fluence overlap.iv) For concrete deposited <strong>in</strong> one layer the vibrators shall be <strong>in</strong>sertedvertically and allowed to s<strong>in</strong>k due to its own weight to the bottom of thelayer and be slowly withdrawn. For concrete deposited <strong>in</strong> more than onelayers, the vibrator shall penetrate the surface of the previous layer.Compaction shall be accord<strong>in</strong>g to clause 13.3 of IS: 456-2000.All concrete work <strong>in</strong> cement mortar/plaster po<strong>in</strong>t<strong>in</strong>g etc. shall be cont<strong>in</strong>uouslycured for the prescribed period as per directions of the Eng<strong>in</strong>eer-<strong>in</strong>-charge , cur<strong>in</strong>gshall be done by cover<strong>in</strong>g the newly laid concrete with gunny bags and keep<strong>in</strong>gthem wet cont<strong>in</strong>uously. If it is found that the contractor is not properly observ<strong>in</strong>gthese <strong>in</strong>structions, the Eng<strong>in</strong>eer may undertake the cur<strong>in</strong>g through another agency/labour without any notice to the contractor at the cost of the contractor. The cost<strong>in</strong>curred along with <strong>in</strong>cidental charges of 2% and along with supervision charges12.5% of the total cost will be debited to the contractor. Intimation of theemployment of another agency, for cur<strong>in</strong>g will be given to the contractor as soonas possible. This <strong>in</strong>timation <strong>in</strong> writ<strong>in</strong>g to the contractor under the hand of theEng<strong>in</strong>eer-<strong>in</strong>-charge of the work shall be conclusive evidence of the employment.31.0 CONTRACTOR’S SUPERVISION:31.1 The contractor shall be required to employ qualified technical person togetherwith necessary supervis<strong>in</strong>g staff; dur<strong>in</strong>g provid<strong>in</strong>g tube wells and construction ofpump houses, The contractor or his authorized representative, approved <strong>in</strong> writ<strong>in</strong>gby Eng<strong>in</strong>eer shall be available at all times for supervision of the work & receiv<strong>in</strong>gdirections, written communications sign<strong>in</strong>g site records on behalf of thecontractor,. The contractor shall not change any of his supervisory staff employedon the work unless approved by Eng<strong>in</strong>eer <strong>in</strong>-charge of work.32.0 PROTECTION AND STEPS TO BE TAKEN IN ORDER TO AVOID.DANGERS TO RAILWAY INSTALLATIONS.a) At such of the locations where contractor/s road vehicle are permitted to plyadjacent to the runn<strong>in</strong>g l<strong>in</strong>es and yard, an experienced Track man shall be deputed63Signature of the tenderer/s


as flagman at the cost of the contractor to prevent accidents. This factor should beborne <strong>in</strong> m<strong>in</strong>d by the contractor/s while formulat<strong>in</strong>g the rates.b) The contractor shall take all precautionary measures <strong>in</strong> order to ensure protectionof his own personnel mov<strong>in</strong>g about or work<strong>in</strong>g <strong>in</strong> the railway premises and shallhave to conform to the rules and regulations of North Central Railway. If anyunforeseen accident or <strong>in</strong>jury happens while on work<strong>in</strong>g, the contractor shall besolely responsible for the same.c) The Contractors shall see that no change is caused to Railway signal<strong>in</strong>g andtransmission wire, stations, <strong>in</strong>stallation, communication l<strong>in</strong>es, electric devices,tra<strong>in</strong>s of any k<strong>in</strong>d, fenc<strong>in</strong>g, as well as any roll<strong>in</strong>g stock and <strong>in</strong> general to allrailway <strong>in</strong>stallation and equipment <strong>in</strong> case of any damage is caused to these due tothe fault of the contractor on the part of any one on his behalf all repairs thererequired will be carried out by the railway at the entire cost of the contractor andamount of expenses thus <strong>in</strong>curred will be recovered from the payment due to him.d) The contractor shall be responsible for safe custody of tools and for the safety ofhis labour. He should ensure that labour no work removes their tools after the daywork,. The contractor should ensure that the tools are deposited <strong>in</strong> proper placebefore the labour proceeds for their homes. Tool issued should not be allowed tofall <strong>in</strong> and unwanted hand who can tamper with the railway track.e) The contactor shall employ one suitable Eng<strong>in</strong>eer/supervisor to supervise thework at site and ensure safety. Though all work relat<strong>in</strong>g to the safety work shallbe executed under railway supervisor and presence of qualified supervisor.f) Assistant. Officer/Senior Scale Officer shall issue competency certificate aftercheck<strong>in</strong>g license and their work<strong>in</strong>g to all drivers of om<strong>in</strong>ated vehicles/mach<strong>in</strong>ery.Inspector at site shall ensure that the driver who does not possess the competencycertificate will not work at site.g) Mach<strong>in</strong>e/vehicle shall ply 6 m clear of track and movement/work at less than 6mm and up to 3.5 m of clear track centre, shall be done <strong>in</strong> the presence of therailway employee authorized by the Eng<strong>in</strong>eer <strong>in</strong> charge. The railway employee sodeputed shall ensure safety of the track, with banner flag, hand signal lamps anddetonators.h) If vehicle/mach<strong>in</strong>ery/materials are to come with<strong>in</strong> 3.5 m of exist<strong>in</strong>g track, workmust be done under the presence of an <strong>in</strong>spector authorized to do safety works, Acaution order shall be issued and track will be protected with the banner flag,hand signal lamps and detonators.i) Normally, night work<strong>in</strong>g shall be avoided. A night work<strong>in</strong>g shall be permitted byAEN/SEN <strong>in</strong> writ<strong>in</strong>g, One <strong>in</strong>spector shall be specifically deputed to supervise the64Signature of the tenderer/s


night work<strong>in</strong>g. The site/area where night work<strong>in</strong>g is to be done shall beadequately fit. Noth<strong>in</strong>g extra shall be paid for this.33.0 PENALITIES DUE TO UNSAFE WORK.a) In the event of accident at the work site, a departmental enquiry shall be held and<strong>in</strong> case it is established that the accident has occurred on account of contractor’snegligence or the negligence of his men, penalties up to an upper limit of 10% ofthe total cost of the work shall be imposed on the contractor.b) Railway adm<strong>in</strong>istration reserves the right to term<strong>in</strong>ate the contract with immediateeffect if the contractor is found responsible for caus<strong>in</strong>g an accident without giv<strong>in</strong>gand furter notice/notices to the contractor. In the event of contractor notcomplet<strong>in</strong>g the work or leav<strong>in</strong>g it unsafe at the end of days work so they mayserve speed restrictions if required to be imposed , track shall be attended to bythe railway immediately at the contrctor’s cost without any further notice.34.0 Labour :34.1 The pr<strong>in</strong>cipal Contractor/s will be held responsible for the compliance withprovision of Wages Act 1936 and Rules framed there under even <strong>in</strong> respect oflabour employed <strong>in</strong> his/their sub contractor <strong>in</strong> the execution of the workcontracted by him/them.34.2 The contractor/s shall carry out the provision of any regulation that may beenforced <strong>in</strong> the area <strong>in</strong> which work is to be done prohibit<strong>in</strong>g the recruitment oflocal labour.34.3 The contractor/s shall obta<strong>in</strong> license from the appropriate licens<strong>in</strong>g officer of thearea before commencement of the work and shall produce a copy there of alongwith the orig<strong>in</strong>al to the Dy. CE/IRPMU to start the work.34.4 In any case <strong>in</strong> which by virtue of relevant sections of the Contract Labour(Regulation and Abolition) Act 1970, the Railway is obliged to provide amenitiesand or pay wages to labour employed by the contractor or through pettycontractor or sub contractor/s under this contract, then the contractor shall<strong>in</strong>demnify the Railway fully and Railway shall be entitled to recover from thecontractor the expenditure <strong>in</strong>curred on provid<strong>in</strong>g the said amenities and or wagesso paid by deduct<strong>in</strong>g it from the security deposit or from any sum due to thecontractor (from the Railway) provided that if any dispute arises as to theexpenditure <strong>in</strong>curred by the Railway or provisions of the said amenities, thedecision of the Eng<strong>in</strong>eer shall be f<strong>in</strong>al and b<strong>in</strong>d<strong>in</strong>g.34.5 The Contractor/s shall provide Rest Shelters, Latr<strong>in</strong>es and Ur<strong>in</strong>als, Wash<strong>in</strong>gfacilities, First aid and Medical facilities strictly <strong>in</strong> accordance with the provision65Signature of the tenderer/s


of relevant sections of Contractor Labour Central Rules-1989. If the contractordoes not provide these facilities, with<strong>in</strong> the stipulated periods, the Railway willprovide these and the cost of the same will be recovered from the contractor/s.34.6 The Railway will not take responsibility or make arrangements for Supply ofFood Stuff to the contractor/s his/their staff or labourers.34.7 The contractor shall make his/their own arrangement at his/their own cost forsupply of water to his/their staff and labour and the Railway under take noresponsibility for supply of water to the contractor/s his/their staff or labour or forthe work.34.8 The contractor shall take all precautionary measures <strong>in</strong> order to ensure protectionof their own personal mov<strong>in</strong>g about or work<strong>in</strong>g on the Railway premises and shallhave to conform to the Rules and Regulation of the North Central Railway. Ifunforeseen accident or <strong>in</strong>jury happens while on work<strong>in</strong>g the contractor shall besolely responsible for the same.34.9 The contractor/s shall keep/ma<strong>in</strong>ta<strong>in</strong> necessary Register/Record, issuedemployment Cards & service certificates to be displayed on the board <strong>in</strong>accordance with the relevant section of the Labour Contract Act Rules- 1971.35.0 PRICE VARIATIONAPPLICABLE ONLY FOR TENDERS VALUEING MORE THAN RS. ONE CRORE:(A)PRICE VARIATION:1. The rates quoted by tenderers and accepted by Railway Adm<strong>in</strong>istration shall holdgood till the completion of the work and no additional <strong>in</strong>dividual claim will beadmissible on account of fluctuation <strong>in</strong> market rates, <strong>in</strong>crease <strong>in</strong> taxes/any otherlevies/tolls etc. except that payment/ recovery for overall market situation shall bemade as per price variation clause <strong>in</strong> para below.2. If the rates quoted <strong>in</strong> the Negotiated tender are accepted, the base month for the ‘Price VariationClause’ will be the month <strong>in</strong> which Negotiations are held.5. The adjustment for variation <strong>in</strong> prices if required shall be made once every quarter <strong>in</strong> the onaccount payments. If more than one on-account payment is made to the contractor <strong>in</strong> a quarter theadjustment, if required, shall be made <strong>in</strong> each bill.6. Price variation dur<strong>in</strong>g extended period of contract:The price adjustment as worked out above i.e. either <strong>in</strong> crease or decrease will be applicable up tothe stipulated date of completion of the work <strong>in</strong>clud<strong>in</strong>g the extended period of completion wheresuch extension has been granted under Clause 17(1), 17(2) & 17(3) of the General Conditions ofContract. However, where extensions of time has been granted due to contractor's failure underClause 17(4) of the General Conditions of Contract. Onecrore irrespective of the contract completion period and PVC shall not be applicable totenders of value less than Rs. One crore.NOTE:(1) Materials supplied free by the Railway to the contractors will not form part of the valueof the contract entered <strong>in</strong>to and will fall outside the purview of the price variation clause.(2) Duration of the contract shall be prescribed <strong>in</strong> the tender documents at the time of <strong>in</strong>vit<strong>in</strong>gtenders and will not <strong>in</strong>clude the extended period due to extension, if any, given".36.0 MACHINERY AND PLANT:36.1 The contractor will be entirely responsible to arrange all necessary mach<strong>in</strong>ery, i.erig mach<strong>in</strong>e, concrete mixers, vibrators, compressors, pumps, pneumaticequipment’s, dredges, derricks, cranes, service girders, stag<strong>in</strong>g, motor-vehicle,trailer tools and plants their spare parts required for sufficient and methodicalexecution of work and transport them to the site of work. Delay <strong>in</strong> procurement ofsuch items due to their non-availability on account of import difficulties or anyother cause whatsoever, will not be taken as excuse for slow or non-performanceof the work, Safety of plants and mach<strong>in</strong>ery will be the responsibility of thecontractor and for any loss due to any cause or wash away <strong>in</strong> flood, or otherwise,no claim will be enterta<strong>in</strong>ed on this account whatsoever.69Signature of the tenderer/s


36.2 The Railway may give on hire to the contractor any plan or equipment, ifavailable, But it will not enterta<strong>in</strong> any claim due to the railway’s failure to do norcan be Railway <strong>in</strong>ability to supply such plant taken as an excuse for slow progressor non-performance of the work.36.3 If, the Railway loans any plant to the contractor on hire, charge will be levied, asdetailed below and separate agreement will have to be entered <strong>in</strong>to before theplant is issued.a) The cost of the plant for the purpose of calculat<strong>in</strong>g the hire charges shall be itsbook value plus freight charges and all other <strong>in</strong>cidental charges to whichsupervision charges at the rate of 12-1/2% of total cost will be added.b) The charges per annum will be calculated at the follow<strong>in</strong>g rates on the cost ofplant as per (A) above.(i) Ord<strong>in</strong>ary repair and ma<strong>in</strong>tenance charge 5%.(ii) Interest on the capital cost at the rul<strong>in</strong>g rate, dividend payable by theRailway to the General Revenue.(iii)Special repairs and ma<strong>in</strong>tenance charges @ 10%.(iv) Depreciation charges at the follow<strong>in</strong>g rates.Light Plant-15% per annum.Heavy plant-10%per annumSpecial Plant - 6% per annum.The classification of the plants shall be as per para 3502 of India RailwayWay and works manual.An additional 10 % on the total (i) to (iv) above to meet cont<strong>in</strong>gencies.36.4 The hire charges per day shall be arrived at by divid<strong>in</strong>g the annual hire chargesvide (A) & (B) above by 250 which shall be assumed number of work<strong>in</strong>g days <strong>in</strong>a year for this purpose. These hire charges will be payable from the day the plantis handed over till it is returned by the firm/contractor to the RailwayAdm<strong>in</strong>istration. However, dur<strong>in</strong>g this period if the plant rema<strong>in</strong>s out of order forreasons beyond the control of the hirers or is sent for periodical overhaul, suchperiods shall not be counted for levy of hire charges Provided the Eng<strong>in</strong>eer givesa certificate to that effect. In case of any difference of op<strong>in</strong>ion between theEng<strong>in</strong>eer and the contractor the decision of the Dy Chief Eng<strong>in</strong>eer/IRPMU will bef<strong>in</strong>al and b<strong>in</strong>d<strong>in</strong>g.37.0 TECHNICAL SUPERVISION OF THE WORK :-i) Atleast one graduate eng<strong>in</strong>eer when the cost of the work to be executed isRs.15 Lakhs and above.70Signature of the tenderer/s


ii)Atleast one qualified diploma holder when the cost of the work to beexecuted is more than Rs. 5 Lakhs, but less than Rs.15 Lakhs.Technical staff should be available at site whenever required by theEng<strong>in</strong>eer-<strong>in</strong>-charge to take <strong>in</strong>structions. In case the contractor fails toemploy the technical staff as aforesaid, he shall be liable to pay a reasonableamount to the Railways not exceed<strong>in</strong>g a sum of Rs.2000/- (Rupees TwoThousand only) for each month of default <strong>in</strong> case of graduate eng<strong>in</strong>eer andRs.1000/- (Rupees One Thousand only) for each month default <strong>in</strong> case ofdiploma holder.The decision of the Eng<strong>in</strong>eer-<strong>in</strong>-charge as to the period for which requiredtechnical staff was not employed by the contractor and as to thereasonableness of the amount to be deducted from the contractor, shall bef<strong>in</strong>al & b<strong>in</strong>d<strong>in</strong>g on the contractor.38.0. INSPECTION REGISTERS AND RECORDSThe contractor shall ma<strong>in</strong>ta<strong>in</strong> accurate records, plans and charts show<strong>in</strong>g the datesand progress of all ma<strong>in</strong> operations and the Eng<strong>in</strong>eer shall have access to this<strong>in</strong>formation at all times. Records of tests made shall be handed over to theEng<strong>in</strong>eer's representative after carry<strong>in</strong>g out the tests. The follow<strong>in</strong>g registerswill be ma<strong>in</strong>ta<strong>in</strong>ed at site, by the Railway’s representative.i) Site Order Register -The contractor shall promptly acknowledge orders given there<strong>in</strong> by theEng<strong>in</strong>eer or his representative or his superior officers and comply withthem. The compliance shall be reported by the Contractor to the Eng<strong>in</strong>eer<strong>in</strong> good time so that it can be checked.ii) Cement Register -This register will be ma<strong>in</strong>ta<strong>in</strong>ed to record daily receipt and consumption ofthe cement duly <strong>in</strong>dicat<strong>in</strong>g the balance quantity. The quantum of the workdone for the cement issued on a particular date will also be ma<strong>in</strong>ta<strong>in</strong>ed.iii) Steel Register -This register will record the receipts of steel items and details ofre<strong>in</strong>forcements and members wherever steel is used.iv) Labour Register -71Signature of the tenderer/s


This register will be ma<strong>in</strong>ta<strong>in</strong>ed to show daily strength of labour <strong>in</strong>different categories employed by the contractor.v) Log Book of events -All events are required to be chronologically logged <strong>in</strong> this book date andshift wise.vi) Material Pass<strong>in</strong>g & Test<strong>in</strong>g Register -Register will show material brought at site, passed, rejected etc. withquantity, specifications and test results etc.All registers at item (i) to (vi) mentioned as above will be ma<strong>in</strong>ta<strong>in</strong>ed bythe representative of the Eng<strong>in</strong>eer and signed by the contractor. The registers, proforma charts, etc. will be the property of theRailway.Registers as mentioned above will have to be ma<strong>in</strong>ta<strong>in</strong>ed depend<strong>in</strong>g on thescope of the work as prescribed by Eng<strong>in</strong>eer at site.vii)SAMPLING AND TESTINGContractor shall establish a field laboratory at site of work at his cost provid<strong>in</strong>gnecessary facilities for perform<strong>in</strong>g rout<strong>in</strong>e type tests such as physical propertiesof cement, bricks, aggregate, water, concrete <strong>in</strong>clud<strong>in</strong>g its crush<strong>in</strong>g strength to thesatisfaction of the Eng<strong>in</strong>eer-<strong>in</strong>-charge. He will also arrange for the test<strong>in</strong>g ofphysical/ chemical properties of re<strong>in</strong>forcement steel used by him from Govt.approved test houses/Eng<strong>in</strong>eer<strong>in</strong>g Colleges to establish the quality of steel barsused. He shall ensure that equipments provided are of latest specification andare <strong>in</strong> good work<strong>in</strong>g order and got calibrated at the laboratory. The contractorshall get certa<strong>in</strong> percentage of samples tested at other approved laboratories asmay be directed by the Eng<strong>in</strong>eer-<strong>in</strong>-charge as confirmatory tests at his own cost.39.0 GENERAL39.1 The contractor/s are required to complete the works with<strong>in</strong> the specified period asprovided <strong>in</strong> each Agreement/work order. Dy. Chief Eng<strong>in</strong>eer is empowered togrant extension to the specified period provided <strong>in</strong> the work order, fail<strong>in</strong>g with<strong>in</strong>the f<strong>in</strong>ancial limits of the powers dur<strong>in</strong>g the currency of the contract, if consideredthe same as justified or with penality as per General Condition of Contract 2005Edition.72Signature of the tenderer/s


39.2 Every possible fluctuation <strong>in</strong> the market rates of labour, material & Generalconditions and other possibilities of such and every k<strong>in</strong>d should be consideredbefore quot<strong>in</strong>g the rates and no claim due to any reasons whatsoever on thisaccount will be enterta<strong>in</strong>ed after wards sales tax or any other tax, levied orliveable by the central or sales tax or any other taxes of State Govt. or localbodies, shall be borne by the contractor which should also be kept <strong>in</strong> view beforetender<strong>in</strong>g, no such taxes on contractor’s labour and materials will be paid by theRailway.39.3 The contractor will be required to give no claim certificate at the time of sign<strong>in</strong>gthe f<strong>in</strong>al bill/ Thus no claim certificate furnished by the contractor constitutespecial agreement under which contractor admits and acknowledged that nomoney is due to him <strong>in</strong> connection with execut<strong>in</strong>g of the particular contract byhim. The contractor cannot turn round and ask for any more payment even if postaudit records show that he had been paid less, hence after no claim certificate isgiven, the contractor cannot even ask for arbitration.39.4 The contractor shall have to co-ord<strong>in</strong>ate his work with other department’s i.e.electric <strong>in</strong>stallation Signal-<strong>in</strong>terlock<strong>in</strong>g work, which may be related to othercontractors or done departmentally, No claim of any k<strong>in</strong>d whatsoever shall beentera<strong>in</strong>ed if the execution of any such work be<strong>in</strong>g also done by thedepartment/contractor is held up due to their <strong>in</strong>terference or as a result of delay <strong>in</strong>any of these works.39.5 The tender/s should note that any person such as Eng<strong>in</strong>eer of the Gazetted rankand other Gazetted Officer whether <strong>in</strong> execution or Adm<strong>in</strong>istrative duties <strong>in</strong> theEng<strong>in</strong>eer<strong>in</strong>g Department, if pension-able or non-pension-able are not allowed towork as contractor/employee with<strong>in</strong> two years of his/their retirement withoutproper approval of the competent authority. If any one found work<strong>in</strong>g ascontractor or as employees of the contractor without prior approval of thecompetent authority, shall be liable to be rejected/term<strong>in</strong>ated for breach of thetender conditions.39.6 The Railway shall not be responsible any loss damage to contractor’s men,materials, equipment’s and plants etc, from any cause whatsoever.39.7 If any work (Whether temporary or permanent) or other material, the value ofwhich has been <strong>in</strong>cluded <strong>in</strong> on account bills is destroyed or damaged or has/havefor any other reasons to be replaced or restored by contractor, the value of thework or other materials. Destroyed may be recovered at any time from thecontractor as debit due, provided always that no omission to deduct any amountdue to the contractor and no payment made by the Railway to the contractor afterthe aforesaid amount become due and recoverable shall on any way prejudice oreffect the right of the Railway to make such deductions at any time or otherwiseto recover the amount as debit due.73Signature of the tenderer/s


39.8 No claim for extra payment shall be enterta<strong>in</strong>ed on account of <strong>in</strong>terruption towork on Railway account what so ever.39.9 The work will have to be done <strong>in</strong> close Co-operation with the otherdepartments/Agencies, if any.39.10 The rates for Non-Schedule items occurr<strong>in</strong>g dur<strong>in</strong>g the course of execution shallbe payable after approval of the competent authority whose decision shall be f<strong>in</strong>aland b<strong>in</strong>d<strong>in</strong>g on the contractor/s.39.11 The plan and sites are subject to alterations to suit the local conditions asrequirement of the Railway and the contractors will have no claim on account ofthe change <strong>in</strong> plan and sites etc.39.12 Any sum or sums of money due and payable to the contractor <strong>in</strong>clud<strong>in</strong>g thesecurity deposits returnable to him under the contract may be with held orreta<strong>in</strong>ed by way or lien by the Eng<strong>in</strong>eer aga<strong>in</strong>st any claim of this or any otherRailways or nay other departments of the Central Government <strong>in</strong> respect ofpayment of a sub of money aris<strong>in</strong>g out of or under any this or any other railway orany other department of the Central Government.39.13 For the day execution of the work if any clarification required by the contractorhave to be obta<strong>in</strong>ed from the Eng<strong>in</strong>eer/his representative, CPM/IRPMU/Dy. ChiefEng<strong>in</strong>eer/IRPMU/North Central Railway/New Delhi <strong>in</strong> writ<strong>in</strong>g and their decisionshall be f<strong>in</strong>al and b<strong>in</strong>d<strong>in</strong>g on contractor/s.39.14 In case of any dispute regard<strong>in</strong>g Interpretation of any of the above quoted clausesdecision of the CPM/IRPMU/North Central Railway, New Delhi will be f<strong>in</strong>al andb<strong>in</strong>d<strong>in</strong>g of the contractor.Dy.
