The Bidder should submit Earnest Money Deposit (EMD) of R1,60,000/- (RupeesOne lakh sixty thousand only), by Account Payee Demand Draft/Pay Order, FixedDeposit Receipt, Bank Gaurantee of any nationalised or any other Scheduled Bankdrawn in favour of the Director, Lal Bahadur Shastri National Academy ofAdministration, Mussoorie. SECTION BGENERAL TERMS AND CONDITIONS TO THE TENDERERB-1: Earnest Money Deposit1. Earnest money in the form of Bank Guarantee (as per enclosed format valid for45 days beyond the final bid validity period.) fixed Deposit receipt or Bank Draft forR 1,60,000.00 (Rupees One lakh sixty thousand) only from anyNationalized/Scheduled Bank drawn in favour of Director, Lal Bahadur Shastri Nationalacademy of Administration, Mussoorie .2. Tender not accompanied with prescribed earnest money deposit will be rejectedsummarily.3. After the depositing of Performance Security i.e. 5% of total bid value, the EMD of thesuccessful Vendor will be refunded within 15 days. The successful tenderer shallfurnish the performance guarantee in the form of Bank guarantee, Fixed DepositReceipt, Account Payee Demand Draft issued by a nationalized bank. (BankGuarantee Form is enclosed as Annexure-III).4. The EMD will be forfeited if the vendor withdraws his offer or any clause of hisoffer/tender, if such withdrawal adversely affects the interest of LBSNAA.6. The EMD of the successful Vendor shall also be forfeited if the vendor fails todeposit the security money when required to do so within specified period and failsto sign the performance agreement within a specified period.7. The contract can be renewed for another year depending on satisfactory performanceand mutual agreement of the parties.8. The successful tenderer will have to make available the contractual workers to theAcademy within one week of awarding Letter of intent.B-2: ELIGIBILITY CRITERIA OF THE TENDERER (TECHNICAL REQUIREMENTS)The following are compulsory conditions that have to be satisfied failing which the offer willnot be considered. Papers will have to be supplied with the tender in proof thereof.1. The Registration number of the firm along with PAN number of the firm allotted by theIncome Tax authorities should be submitted, failing which vendor’s bid would becomeinvalid and same shall be rejected summarily.2. The bidder should be registered with Service tax department of the Government.Enclose self attested copy of the valid Registration certificate.3. The bidder should be registered with Commissioner of Employees Provident Fund.Enclose self attested copy of the valid Registration certificate of the EPF4. The bidder should be registered with Commissioner, Employees State InsuranceCorporation. Enclose self attested copy of the valid Registration certificate of the ESI.5. The bidder should be registered with Labour Commissioner, Govt. of India, Dehradun.Enclose self attested copy of the vailid registration certificate.6. The bidder should have completed satisfactorily in the last 3 years, at least 2 works ofproviding contractual workers amounting to R 20 lakh each. He must submitcertificates for the same.3


B-3:PRICE VALIDITY AND PAYMENT1. Bids should be valid for a minimum period of 120 days from the date of opening of thetender. However, the rates (service charges) offered should be valid for 3 years fromthe date of empanelment. Roll over of rate for 2 nd and 3 rd year will be made uponsatisfactory performance.2. A pre-receipted bill shall be submitted in triplicate in the name of “DIRECTOR, LalBahadur Shastri National Academy of Administration, Mussoorie” at the end of eachmonth for payment in respect of services of the Contractual Labour and SecurityGuards provided during the previous month. The payment will be made thorughcheque/demand draft on receipt of copy of the challans of EPF and ESI.3. Payment for the contractual workers/security guards will be made to the contractorwithin 7 days of production of bill, list of workers/security guards, attendance sheetduly verified and payment receipt of ESI, EPF and Service Tax.4. The Contractor should pay the minimum wages to their workers on the 7 th day of theeach month. The payment to the workers should be made through bank accounts inname of individual workers.5. The contractor should notify the rates of minimum wages fixed by the LabourCommissioner, Uttrakhand region at the notice board.B-4: DISPUTES AND APPLICABLE LAW1. Venue of arbitration shall be Mussoorie/Dehradun.2. The agency shall be governed by the laws and procedures established by Govt. ofIndia, within the framework of applicable legislation and enactment made from time totime concerning such commercial dealings/processing.3. All disputes in this connection shall be settled in Dehradun jurisdiction only.4. LBSNAA reserves the right to accept any bid and to reject any or all bids and alsocancel this tender or modify the requirement without assigning any reasons. LBSNAAwill not be under obligation to give clarifications for doing the aforementioned.5. LBSNAA reserves the right that the work can be allocated to more than one vendorand maximum three vendors.6. LBSNAA also reserves the right to relax any of the terms & conditions of the tender.7. LBSNAA without assigning any further reason can reject any tender(s), in which anyprescribed condition(s) is/are found incomplete in any respect..B.5. COMPULSORY CONDITIONS1. The service charges should be quoted in prescribed form only on per month percontractual worker/security guard basis.2. The wages to the contractual workers/security guards to be deployed inGovernment/Academy’s premises will be paid according to the rates as prescribed bythe Govt. of Uttarakhand/Labour Commissioner, Government of India for semi-skilledand skilled workers and highly-skilled workers.3. Service charges for the contractual workers to be deployed at Academy's Guest Housein Delhi to be quoted separately. Wages to be paid to them will be as prescribed byGovt. of NCT, Delhi, for unskilled/Semi-skilled workers/Highly-skilled workers.4. Tenderers are free to pay higher wage rates out of their service charges.5. Contractual workers are to be deployed at various sections/branches/hostels as wellas guest houses and also at other premises of the Academy according to need fromtime to time. Security guards are to deployed for 24 hours on shift basis of 8 hourseach duration for the entire month.6. Academy will not provide any accommodation to the workers/security guards.7. In case any incidence of theft etc. occurs or any damage is sustained to the Govt.property during duty period of the contractual workers/security guards, the concernedfirm will be responsible and double the cost of the loss/damages suffered will be4


ecovered from the contractor firm. In case of repeat of incidence the services of thecontractual worker will be immediately terminated.8. The firm will have also to submit the Police verification report and Medical certificatefrom the authorized Medical Officer for all the contractual workers/security guardsprovided within 15 days of supplying of contractual workers/security guards andsubsequent to any addition/change thereafter.9. Any kind of leave or relief under the labour law/act will be the responsibility of thecontractor providing contractual workers and security guards.10. The contractor will be responsible to give protection/benefits to the contractual workersand security guards under the labour act/law, as well as EPF and ESI Acts. All thepersons employed for the purpose of the contract must be enrolled under EPF and ESIand all statutory dues paid by the contractor will be verified every month before thepayments are released by the Academy.11. Accidental & medical facilities are the responsibility of the contractor and Academy willnot be responsible for any such facility.12. Number of contractual workers/security guards may be increased or decreasedaccording to the need and the firm should be in a position to supply additionalcontractual workers and security guards as per demand at the same rates.13. In case the services rendered by the contractual workers and security guards madeavailable by the firm are deemed not satisfactory, the contract will be terminated on anotice of 15 days.14. The contractual workers and security guards are required to work as helpers, farashes,classroom attendants in various office rooms and sections/ syces, sweepers, to shiftfurniture/ office equipments, waiters/bearers/cooks in various Guest Rooms of theAcademy, works relating to various training programmes running in the Academy aswell as miscellaneous works at Academy's Guest House in Delhi. Security guards arerequired to perform duties in various hostels, residential premises and offices of theAcademy in shifts.15. The successful tenderer will have to furnish a list of workers engaged in the Academyin the prescribed format. Any addition/change of worker will be duly informed to theAcademy within 7 days of deployment.16. The Contractor must make a local landline and mobile phone numbers available to theDeputy Director in-charge Estate for day to day coordination and trouble shooting. Thecontractor’s firm must deploy a representative at the Estate Section of the Academywho will provide the workers/security guards on day to day basis as per requirement ofthe Academy and also look into incidental and day to day issues.17. The rates and statutories dues paid to the contractor firm will be revised subsequent tochange in the statutorily prescribed minimum wages. However, the service chargeslevied by the contractor firm will remain constant during the currency of the contract.18. Security guards will be in proper uniform during the duty hours.19. The uniform for security guards will be blue trousers, white/blue shirts with gear ofboots/belts/Pea cap. The contractor will have to provide minimum two sets uniform.During winters all security guards are to be provided with dark bluesweater/coat/jacket. The cost of the uniforms will be borne by the contractor himselfand he would not deduct the cost of uniform from the wages of security guards.20. The contractor will be responsible to provide uniform, lathi, torch, whistle etc. to thesecurity guards for their effective functioning. The Academy may provide extraequipment, which the agency should safe guard.21. The contractor will have to provide minimum two sets uniform (Trousers, Shirt andJersey and Jacket for gents and Salvar/Kamiz or Sari and Jersey and Jacket forladies) with shoes and name plates to contractual workers to maintain decorum of theAcademy. The uniform will be decided by the Director, LBSNAA (Sample of theuniform is kept in the Estate Section of the Academy for inspection). The cost of theuniforms will be borne by the contractor himself and he would not deduct the cost ofuniform from the wages of workers.5


22. All the contractual workers/security guards should be properly insured (Insurance withminimum 1 lakh risk cover and minimum 2 lakh accidental cover).23. The contractor will submit the statement of EPF subscription deposited in the Office ofEPF quarterly/half yearly to the undersigned.24. The contractor will issue the ESI cards of the approved ESIC dispensary located atMussoorie within one month of the contract period.25. The contractor should pay the overtime and bonus payable and approved by Academyauthorities to contractual labour/security guards.26. The contractor should issue monthly wage slips to all the contractual labour/securityguards showing the amount of EPF/ESI etc and also issue annual EPF slip showingdetails of EPF monthly subscription.27. Any other works to be assigned by the Academy authorities.B-6: SUBMISSION OF THE TENDER1. Bids must reach LBSNAA not later than the time and date specified in the TenderDocument. In the event of the specified date for the submission of bids being declareda holiday for LBSNAA, the bids will be received till the next working day or if there is asudden Strike or Bundh or holiday the bid will be received on next second day.2. The Director, LBSNAA may, at his discretion extend this deadline for submission ofbids in which case all rights and obligations of LBSNAA and bidders previously subjectto the deadline will thereafter be subject to the deadline as extended.3. Late tender: Any tender received after the stipulated date and time of submission asmentioned in the tender notice, will be rejected and/or returned unopened to thebidder.B-7: OPENING OF TENDER BIDS1. The sealed covers containing EMD only will be opened in the first instance in thepresence of representatives of the vendors at the Office of the Deputy Director(Senior), I/c Estate, LBSNAA, Mussoorie- 248179, at the specified date and timementioned in the tender documents. The Technical bids of only those vendors whoseEMD is found to be in order will be opened subsequently in the same session forfurther evaluation. One authorized representative of each of the vendor would bepermitted to be present at the time of aforementioned opening of the tender a nd shallsign a register evidencing their attendance.2. The authorized representatives who will attend the tender opening are to bring withthem letters of authority from the corresponding tenderer.3. Evaluation of Technical Bids:3.1 A duly constituted Technical Evaluation Committee (TEC) will shortlist TechnicalBids on the basis of the prescribed technical parameters. The names of onlytechnically short listed vendors will be announced whose bids will qualify foropening the Financial/Commercial Bids.3.2 LBSNAA has the right to choose any subset of the tendered items.4. Evaluation of Financial Bids:4.1 The Financial Bids of only those Bidders short listed from the Technical Bids willbe opened in the presence of their representatives on a specified date and timeto be intimated to the respective Bidders.4.2 LBSNAA will award the Contract to the successful Bidder whose bid has beendetermined to the substantially responsive and evaluated as the best in thecriteria laid down.6


4.3 No enquiry shall be made by the bidder(s) during the course of evaluation of thetender, till final decision is conveyed to the successful bidder(s). However, theLBSNAA can make any enquiry/seek clarification from the bidders. In such asituation, the agency shall extend full co-operation.5. Empanelment :5.1 The decision of LBSNAA arrived at as per above will be final and representationof any kind shall not be entertained on the above.5.2 Work order will be placed on the finally selected vendor(s).5.3 In case the successful vendor found in-breach of any condition(s) of tender , atany stage during the course of contract period, the legal action as per rules/laws,shall be initiated against the vendor and Performance security shall be forfeited,besides debarring & Black listing the vendor concerned for at least 5 (five) years,for further dealing in Govt. departments.5.4 LBSNAA reserves the right to accept/reject any bid, to cancel/abort the tenderprocess and/or reject all bids at any time prior to award of Contract, withoutthereby incurring any liability to the affected agencies, of any obligation to informthe affected agencies on the grounds of such action taken by LBSNAA.5.5 No deviations from these terms and conditions will be accepted; violation thereofwill lead to rejection of the bid and forfeiture of EMD.B-8: TENDER ACCEPTANCE & REJECTION1. Director, LBSNAA, reserves the right to reject any part or whole of the Tender withoutassigning any reason whatsoever.2. Director, LBSNAA is not bound to accept the lowest tender.3. Letter of Intent will be issued to the successful vendor after evaluation of theTechnical and commercial tenders. The firm work order will only be issued after thevendor submits the Performance Guarantee in the form of bank guarantee andagreement within stipulated period.B-9: SIGNING OF CONTRACTAt the same time as LBSNAA notifies the successful Bidder that its bid has beenaccepted, LBSNAA will send the Bidder the contract agreement incorporating allagreements between the parties on non-judicial stamp.B-10: PERFORMANCE SECURITY1. The successful bidder should furnish performance security to LBSNAA for an amountof 5% of the contract value valid for 60 days after completion of contract obligation inaccordance with the conditions of contract in the Security Deposit Form prescribed byLBSNAA (Annexure enclosed) or another form acceptable to LBSNAA in the form ofbank guarantee, FDR, valid for 60 days after completion of contract obligation.2. In the event of satisfactory performance, the unclaimed Bank Guarantee for thispurpose, will lapse automatically.3. The Security Deposit will not carry any interest.4. Work order will be placed after receipt of Performance Guarantee and signing of theAgreement.5. Security Deposit will be refunded within 15 days after submission of the performanceguarantee by the tenderer.6. Performance guarantee will be forfeited for unsatisfactory service andnoncompliance of any clause of the contract.7


7. The contractor will be liable for misconduct and for damages by the contractuallabourers and security guards supplied by him and shall be liable for cash penalties asdecided by LBSNAA.B-11: TERMINATION FOR INSOLVENCY:LBSNAA may at any time terminate the order / contract by giving written notice of fourweeks to the contract, without any compensation to the tenderer, if the contractorbecomes bankrupt or otherwise insolvent.B-12: TERMINATION FOR CURRUPT OR FRAUDULENT PRACTICES OR DEFAUL:1. Tenderer shall observe the highest standard of ethics during the period of contract.2. LBSNAA will reject a proposal for award if it determines that the Bidder recommendedfor award has engaged in corrupt or fraudulent practices in competing for the contractin question.3. Default is said to have occurred:“If the contractor fails to deliver any or all of the services and/or fails to perform anyother obligation (s) under the contract within the time period(s) specified in the order or anyextension thereof granted by LBSNAA.”If the agency, in either of the above circumstances, does not take remedial stepswithin a period of 30 days after receipt of the default notice from LBSNAA (or takes longerperiod inspite of what LBSNAA may authorize in writing), LBSNAA may terminate thecontract in whole or in part.Sd/-(Jaspreet Talwar)Deputy Director (Sr.) &Incharge Estates8
