6 Procurement arrangements6.2 Procurement policies <strong>and</strong> guidelinesThese procurement guidelines apply to all procurement undertaken using <strong>ASDP</strong>basket funds. <strong>ASDP</strong> procures goods, works <strong>and</strong> services in accordance with theNational Laws as stipulated in the Public Procurement Act No 21 of 2004. The Act,which became effective on 8 th February 2005, is supplemented by Regulationspublished by the Minister responsible for Finance in accordance with Section 88 ofthe Act, <strong>and</strong> these became effective from 15 th April 2005.At the central level the Regulations comprise Regulations for Procurement of Goods,Works, Non-Consultant Services <strong>and</strong> Disposal of Public Assets by tender 2005, <strong>and</strong>Regulations for Selection <strong>and</strong> Employment of Consultants, 2005.At the LGA level, the regulatory framework for procurement is also specified insection 65 of the Local Government Finance Act of 1982. Since financial resourcesare constrained, all procurement by the LGA should be executed on the basis of thefollowing considerations:• The need for economy <strong>and</strong> efficiency in the use of public funds <strong>and</strong> in theimplementation of projects including the provision of related works• The best interests of the LGA in giving all eligible suppliers <strong>and</strong> contractorsequal opportunities to compete in the tender• Encouragement of national manufacturing, contracting <strong>and</strong> serviceindustries• The importance of integrity, accountability, fairness <strong>and</strong> transparency in theprocurement process.6.3 Procurement arrangementsThe <strong>ASDP</strong> procurement is informed by a procurement plan (see Annex B, B7) that isdeveloped once the costed work plan has been approved (see Section 4).The Public Procurement Act of 2004 requires all ASLMs to have a Ministerial TenderBoard (MTB) <strong>and</strong> all LGAs to have a LGA Tender Board (LGATB). In addition, theAct also requires all ASLMs <strong>and</strong> LGAs to establish a Procurement Management Unit(PMU) that consists of procurement <strong>and</strong> other technical specialists together with thenecessary supporting <strong>and</strong> administrative staff.Government of the United Republic of Tanzania46
