*If the notice is issued after draft publication of roll then suo-moto powers under Rule21A of RER 1960 is invoked. In case the action is initiated after final publication of rollsthen Section 22 of RPA 1950 is invoked.Appeal Against ERO’s Decisions:70. An appeal lies against the decision of the <strong>Electoral</strong> <strong>Registration</strong> Officer in regardto claims and objections and also inclusion of names inadvertently omitted. However, anappeal will not have the effect of staying or postponing the final publication of theelectoral roll. An appeal should be preferred to the Appellate Officer appointed underRule 23 of RER, 1960.71. The provision of appeal is only <strong>for</strong> the decisions under Rule 20, 21 and 21A ofRER 1960.72. The appeal cannot be preferred if the appellant has not availed himself of his rightto be heard or to make representation to the ERO. The appeal should be in the <strong>for</strong>m of amemorandum and it shall be signed by the appellant. It can be presented to the Appeals inthe Officer or be sent to him by registered post. In both these cases, the appeal mustreach the Appellate Officer within 15 days of the decision by the ERO becoming known.73. The appellate Officer, on receipt of an appeal, should satisfy himself that theappeal has been presented within the prescribed time and in the manner required. TheAppeals, which are time-barred or are not in the manner prescribed, should be rejectedsummarily.74. If the appeal is in order, the Appellate Officer should call <strong>for</strong> the records of thecase from the ERO. He should give the appellant a reasonable opportunity of being heardbe<strong>for</strong>e recording his final decision on an appeal.75. The decision of the Appellate Officer is final.76. In case an appellate authority either modifies or reverses the decision of the ERO,the decision of the appellate authority will take effect only from the date on which hemakes the decision.77. The appeal should normally be disposed of within 3 weeks.78. The ERO on receipt of orders of the appellate authority shall make amendment tothe electoral roll to give effect to the decision.54
