The additional compensation to be paid to all AGMA members who perform in,or who perform services with regard to the production being broadcast, recordedor released,The length of advance notice that ARTISTs will be given prior to recordingand/or broadcast, andAn assurance from BSJ that it will secure, if the waiver is granted, the writtenconsent of each ARTIST who performs in the production being broadcast,recorded or released.d) Upon receipt of your waiver request, made in compliance with all of the foregoing, wewill process it as expeditiously as is possible. Any requests made in any other mannerwill not be considered. It is inappropriate for any company official to discuss the waiverrequest with individual members of the bargaining unit prior to AGMA’s consideration ofthe request. Please remember that AGMA’s Board of Governors retains constitutionalauthority to deny the waiver even if a majority of the bargaining unit is in favor of it.e) PLEASE NOTE: With regards to ‘emergency’ waivers made at the last minute, theconditions giving rise to the last minute or ‘emergency’ nature of the request must havebeen unforeseen and unforeseeable. Any waiver request that reasonably could have beenmade prior to two (2) months in advance period specified above will be summarilydenied as untimely.4) If BSJ requests a waiver, BSJ shall provide ARTISTS with one (1) hour of company time inaddition to the time set forth in paragraph K. above for ARTISTS to schedule a meeting todeliberate and vote on such a waiver. Such meeting will be scheduled at a time that ismutually agreeable to AGMA and BSJ.CONTRIBUTION TO BSJ PROHIBITED1) No officer, director, employee or agent/manager of BSJ and no person who occupies therelationship of independent contractor to BSJ shall act as manager, agent or personalrepresentative of any member of AGMA or receive, directly or indirectly, any compensationor remuneration of any kind or nature whatsoever from any member of AGMA. BSJ shall beresponsible for enforcing compliance with the preceding sentence. Within ten (10) days afternotice is given by AGMA to BSJ of any violation of this paragraph, BSJ shall correct suchviolation. If BSJ shall fail to correct such violation within such time, then BSJ shall bedeemed to have committed a material and substantial breach of this contract.2) BSJ agrees that no AGMA member will be solicited or required to make any payments orcontributions of any kind or nature whatsoever, or to have such payments or contributionsmade by any person firm or corporation, to or for the benefit of BSJ or anyone else, in orderto acquire or continue employment by BSJ or as a condition of acquiring such employmentor any preferment in such employment, and BSJ agrees that it will not accept or receive anysuch payments or contributions.9
