An ARTIST shall not be re-engaged at a rank lower than his/her current rank.7) END OF SEASON PERFORMANCE REVIEWAll ARTIST’s employed on a Guaranteed Employment basis shall be entitled to an End <strong>of</strong>Season Performance review, at their written request. This review shall be held during the lasttwo (2) weeks <strong>of</strong> the Guaranteed Employment period. The purpose <strong>of</strong> this review is to createanother opportunity for an ARTIST to sit with the Artistic Staff and receive feedback onhis/her work as well as discuss any concerns an ARTIST may have for his/her future. Thisreview is not considered part <strong>of</strong> the Artistic Evaluation process. In the event the ARTISTwishes to make use <strong>of</strong> the End <strong>of</strong> Season Performance Review, ARTIST shall use a sign-upsheet posted by EMPLOYER or notify the Company Manager in writing, no later than three(3) weeks before the last scheduled day <strong>of</strong> the Guaranteed Employment period. For thepurposes <strong>of</strong> this agreement notification via e-mail shall qualify as written notification.EMPLOYER will endeavor not to schedule the End <strong>of</strong> Season Performance Review on aPerformance Day.8) AGMA agrees that all ARTISTs have the obligation to fulfill his/her Standard Artist'sContract for Employment. AGMA acknowledges that BSJ has the right to pursue alldisciplinary avenues available to BSJ in instances in which an ARTIST willfully chooses todefault on the Standard Artist's Contract for Employment. These avenues include but are notlimited to recourse to AGMA for institution <strong>of</strong> disciplinary proceedings in accordance withits Constitution and By-laws. DANCERS shall not have the right to refuse to appear in anydancing role as assigned by the Artistic Director except when morally unacceptable to theARTIST (e.g. nudity, blackface).O. ASSIGNMENT OF ARTIST’s CONTRACTSBSJ agrees that the Standard Artist's Contract for Employment between BSJ and any ARTISTmay not be assigned or transferred to any individual or corporation unless the written consent <strong>of</strong>AGMA and the ARTIST concerned shall have been endorsed on the face <strong>of</strong> the contract and thethird-party individual or corporation has assumed in writing all <strong>of</strong> the obligations <strong>of</strong> this BasicAgreement with respect to such ARTIST, or has negotiated a collective bargaining agreementwith AGMA. Any attempt to transfer <strong>of</strong> said individual contract without compliance with thisSection <strong>of</strong> this Basic Agreement shall have no effect and shall be deemed null and void.P. LOWERING OF MINIMUMS AND WAIVERS PROHIBITED1) BSJ agrees that the minimum terms and conditions governing the employment <strong>of</strong> ARTISTsby BSJ are those contained herein, and BSJ further agrees that it will not enter into anycontract with or employ any ARTIST upon terms and conditions less favorable to theARTIST than those set forth herein. BSJ agrees that no waiver by an ARTIST <strong>of</strong> anyprovision <strong>of</strong> this Basic Agreement or any contract between any ARTIST and BSJ shall berequested by BSJ <strong>of</strong> an ARTIST or delegate, individually or as a group, or be effective unlessthe written consent <strong>of</strong> AGMA to the making <strong>of</strong> such request or such waiver is first had andobtained. BSJ further agrees that nothing in this Basic Agreement shall be deemed to preventany ARTIST from negotiating for or obtaining better terms than the minimum terms7
