additions thereto and modifications there<strong>of</strong> appropriately as may be agreeable to the ARTISTand to AGMA but in no event inconsistent with this Basic Agreement and less favorable tosuch ARTIST. A schedule <strong>of</strong> rules and regulations, as collectively bargained for, approvedand ratified by AGMA, may be attached to the Standard Artist's Contract for Employment.3) ARTISTs shall be employed on a Weekly or on a Guaranteed Employment Basis on theterms and at not less than the minimum compensation hereinafter set forth. As to thosedancers who accept such a Guaranteed Employment contract, BSJ may not substitutepayment for rehearsal weeks for payment <strong>of</strong> guaranteed performance weeks, if the weeklycompensation <strong>of</strong> the ARTIST is not the same in all employment weeks. This provision shallbecome effective upon the commencement <strong>of</strong> a Standard Artist's Contract for Employmentduring the term <strong>of</strong> this Basic Agreement.4) BSJ agrees that it will continue to employ during the duration <strong>of</strong> its performances (tour)outside <strong>of</strong> the city <strong>of</strong> origination no less than the total number <strong>of</strong> dancers employed at thebeginning <strong>of</strong> such tour, provided, however, that reduction in such total number may be madedue to sickness or injuries but in no event less than 85% <strong>of</strong> the original total number.5) When ARTISTs are engaged on a Weekly or Guaranteed Employment Basis, the StandardArtist's Contract for Employment may contain an option whereby BSJ may engage theARTIST to render his services for an additional specified period <strong>of</strong> employment. This optionmay be exercised by BSJ only by delivering a notice in writing to the ARTIST and to AGMAsixty (60) days prior to the completion <strong>of</strong> the initial employment set forth in the StandardArtist's Contract for Employment. There will be a three (3) month notice to the ARTIST <strong>of</strong>the possibility <strong>of</strong> the option.6) All ARTISTs employed shall be notified <strong>of</strong> re-engagement or non-reengagement, by writtennotification on or before March 1. The contract <strong>of</strong>fer will be considered to be withdrawnunless the ARTIST has accepted BSJ’s <strong>of</strong>fer within four (4) weeks after date <strong>of</strong> <strong>of</strong>fer. BSJwill furnish AGMA with a list <strong>of</strong> those ARTISTs engaged on a guaranteed employment basisthat BSJ does not plan to re-engage for the following contract year. Such letters <strong>of</strong> intentshall include employment dates and upon approval <strong>of</strong> BSJ’s Board, information regarding therepertory for the following contract year. BSJ shall make best efforts to provide informationregarding the repertory for the following contract year to the <strong>Artists</strong> no later than one (1)week prior to the end <strong>of</strong> the current contract year. An Artist shall not be required to sign anindividual employment contract for the following contract year without first receivinginformation regarding the repertory for the following contract year. However, ARTISTSshall make best efforts to return a signed individual contract within two (2) weeks <strong>of</strong>receiving information regarding the repertory along with a complete and final calendaroutlining rehearsal and performance dates for the entire contract year.a. Each ARTIST shall be given a written Artistic Evaluation by the Artistic Director by nolater than February 1 st <strong>of</strong> each contract year. Such Artistic Evaluation shall be made on aform that has been mutually agreed upon by BSJ and AGMA and shall include a place forthe Artistic Director to check <strong>of</strong>f whether or not any concerns expressed as part <strong>of</strong> theArtistic Evaluation may lead to the non-reengagement <strong>of</strong> the ARTIST.b. After receipt <strong>of</strong> the written Artistic Evaluation, an ARTIST may, in writing, request ameeting with the Artistic Director and/or Executive Director which will be held any timebetween 2/2 and 2/28 <strong>of</strong> that contract year. ARTIST’s written request shall include the6
