AMERICAN GUILD OF MUSICALARTISTS1430 Broadway (between 39 th and 40 th Streets), New York, NY 10018212-265-3687 – Fax: 212-262-9088Affiliated with the AFL-CIO, Branch <strong>of</strong> Associated Actors and Artistes <strong>of</strong> AmericaThis letter will serve as an Addendum 2 to the 2010 Ballet San Jose/AGA collective bargainingThe following “Rules and Regulations” shall apply to all ARTISTs and Staff <strong>of</strong> Ballet San Jose without regard torace, color, creed, sex, age, national origin, or marital status:1. Harmonious Workplace. Echoing I.AA.1, BSJ, AGMA and ARTISTs agree to endeavor to promotemutual respect, a positive atmosphere, and harmonious working relationships. BSJ, AGMA andARTISTs acknowledge that artistic endeavors may involve stressful conditions. BSJ and ARTISTs willexpressly maintain the position that no ARTIST or BSJ Staff Member shall be subjected to insulting orhumiliating language or behavior, trespass, or abusive conduct on the part <strong>of</strong> any BSJ employee, affiliate,or representative. It is further acknowledged that injuries may result to the affected individual or BSJ’soperations may be impaired as a result <strong>of</strong> any such personal affront, racial or ethnic slur, or any trespassto person or property.2. Pr<strong>of</strong>essional Conduct and Behavior. All ARTISTs and BSJ Staff members are prohibited fromdrinking alcoholic beverages, taking <strong>of</strong> drugs or smoking in the Ballet San Jose workplace or in anytheater Ballet San Jose performs in. Additionally in line with I.U.1, neither ARTISTs nor BSJ Staff shallcome to work in the workplace or theater under the influence <strong>of</strong> drugs or alcohol. ARTISTs, when calledto an artist activity, will refrain from texting or using cellphones out <strong>of</strong> respect and consideration for thedirector <strong>of</strong> the artist activity and, because it can hinder the ability <strong>of</strong> the ARTIST to learn choreographyfor all roles for which they are responsible. Additionally, ARTISTs shall arrive on-time for all artistactivity calls, as definied in III.B, for which they are scheduled, and will appear and sign-in no later than30 minutes prior to any performances held by Ballet San Jose (V.A.4.i). As a pr<strong>of</strong>essional courtesy, it isrequested that ARTISTs refrain from smoking at least 10 minutes prior to any costume fitting.3. Artistic Respect and Responsibility ARTISTs shall wear costumes, accessories, wigs, facial hair orapply hair coloring or special make-up as directed by the Choreographer/Stager, Artistic Director,Costume Director/Designer and Makeup Designer, as necessary as long as such items and applications arein accordance with Sections A.10.D., E. <strong>of</strong> the Health and Safety Addendum and any other applicableprovision <strong>of</strong> the cba. All ARTISTs, to the best <strong>of</strong> their ability, will continue to uphold the original design<strong>of</strong> such persons listed and will maintain the choreography <strong>of</strong> any work as instructed by thechoreographer/stager/ballet master/Artistic Director, for the duration <strong>of</strong> the run for any performance inaccordance with Sections A. 11, 12, 13, 14, 15, B., F., G., <strong>of</strong> the Healthy and Safety Addendum and anyother applicable provision <strong>of</strong> the cba.4. Ballet San Jose Building Safety. For the safety <strong>of</strong> all ARTISTs and Staff, no one other than FacilityStaff shall go on the ro<strong>of</strong> <strong>of</strong> the Ballet San Jose building, or go above the 4 th floor <strong>of</strong> said building.Additionally, ARTISTs are not to go into the basement <strong>of</strong> said building. All ARTISTs and Staff shallonly enter said building through the Front Door (#40). The Box Office Door (#38) is for Box Office Staffand patron use only. The last door (#34) is an emergency exit. Additionally, in accordance with postedsigns, all smoking must occur at least 20 feet away from all Ballet San Jose doors. All ARTISTs andStaff must follow the elevator rules, regarding maximum capacity, as posted inside the elevator.5. Theater Safety. It is understood that “it is BSJ’s responsibility to provide a safe and healthy workplaceand it is the ARTIST’s responsibility to work in a safe manner,” as set forth in the Health and SafetyAddendum. Towards this end, when ARTISTs are in a theater, they should follow the directions <strong>of</strong> theArtistic Director, Technical Director and Stage Managers regarding movement and safety backstage.55
