involved and shall carry the line: "Please credit Dancers - (Dancers' names)". If ARTISTsfail to show-up upon request to approve photographs, BSJ shall consider said photographsapproved without the consent of the ARTIST. If violated ARTIST shall receive fifty($50.00) Dollars.6) Photographs or other reproducible likenesses of ARTISTs paid for by BSJ may be used onpromotional items offered for sale to the public which promote the name of BSJ, the name ofthe ARTIST or the art form of dance. Such items or likenesses may not be licensed to thirdparties without written consent of ARTISTs.7) When headshots are needed, BSJ photographer will take photos of each ARTIST in need of aheadshot. Each ARTIST will then be allowed twenty (20) minutes, on paid time, to reviewthe photos and select their headshot, on a dedicated computer, in a private location at BSJstudios.8) It is agreed that photographing, including waiting time, make-up time and travel incidentalthereto, will be counted as rehearsal time and, if applicable, the appropriate overtime rateshall be paid to the ARTISTs.9) Unless ARTISTs are notified on official company callboard pertaining to "officialphotographers", under no circumstances will photographers be permitted on stage, in thewings or any corridors leading to the stage. This prohibition shall apply in all theaters wherethe ARTISTs perform.10) BSJ agrees to use the form hereinafter referred to as Exhibit "1" in order to protect the rightsof the ARTISTs and BSJ.11) BSJ agrees to enter into an agreement with photographers regarding the taking ofphotographs of ARTISTs with the intent of protecting the rights of BSJ and the ARTISTs.12) Photographs used in any place, such as, by way of example but not limited to Web sites, theInternet, or for any commercial purpose, theatrical exhibition or any other purpose will not bealtered in any manner without approval of the ARTIST.13) All ARTISTS shall be given a minimum of thirty (30) minutes to prepare for a photo-shoot.45
