f) No payment for the performers shall be required, provided no payments are made to anyother personnel employed in the production.g) The three (3) minute news clip and the balance <strong>of</strong> the filmed/taped sequence shall bereturned to BSJ for safekeeping after its use. Certification shall be given to AGMA thatthis has been done. BSJ shall insure that no producer/ broadcaster, news agency and/ ordocumentary organization maintains any tape/ film footage <strong>of</strong> any ARTIST in theirarchives.h) If there is any violation <strong>of</strong> any <strong>of</strong> the above listed regulations, or if the news clip is usedor taken in any manner other than hereto expressly authorized, the appropriate rates andconditions <strong>of</strong> SAG or AFTRA, whichever medium is used, shall prevail.i) Videotaping for promotional tapes may take place during a regular rehearsal,performance or a call specifically for the purposes <strong>of</strong> such taping. All time involved insuch taping shall be considered “called time” and the <strong>provisions</strong> <strong>of</strong> this Basic Agreementrelative to rehearsals/performance conditions, hours available and rest breaks shall apply.j) Promotional videotapes may be distributed, played and broadcast without restrictionproviding the total airtime for any one ARTIST does not exceed ninety (90) seconds andno ballet is shown in its entirety.3) Commercial Recording/Side letterShould BSJ intend to make an audio/visual record, on tape, film, in a digital medium or anyother medium for commercial use (e.g. PBS Broadcast, Videotape, DVD, Internet Streaming,etc.) BSJ shall notify the AGMA delegate(s) and Area Representative in writing, at leastsixty (60) days prior and shall negotiate in good faith for a separate specific agreementregarding such recording. BSJ recognizes AGMA as the Exclusive Bargaining Agent for allARTISTs for the purpose <strong>of</strong> negotiating any such side letter agreement.D. PHOTOGRAPHY1) No photo calls shall be permitted on a two (2) performance day, unless the ARTIST receivesan ECA payment as per Section IV B 3, <strong>of</strong> this Basic Agreement, with a one (1) hourminimum call guaranteed.2) BSJ agrees that if it shall require any ARTIST to pose for photographs <strong>of</strong> regular dancepieces for the purpose <strong>of</strong> publicizing and advertising performances <strong>of</strong> BSJ, that ARTISTshall receive at least twenty-four (24) hours notice <strong>of</strong> such photographing, and suchphotography or waiting time shall be compensated for at the appropriate rehearsal rates.3) If the ARTIST is required to pose for photographs on a Free Day, such call will be for notless than two (2) hours for which the ARTIST shall receive an ECA payment as per SectionIV B 3, <strong>of</strong> this Basic Agreement.4) Individual pictures used in souvenir booklets shall be mutually acceptable to the ARTISTand BSJ. ARTISTs' names shall appear along with all solo and duo photos on BSJ brochuresand publicity materials.5) All photos which are used for publicity purposes in any document which is solely underBSJ’s control which have three (3) ARTISTs or less must be approved by the ARTISTs44
