orders that have been placed but cannot be cancelled, before receiving shoes from the neworder. BSJ will make best efforts to cancel unfulfilled orders and/or return unused inventoryfor refund.ARTISTs acknowledge that it is a lengthy process for BSJ to procure special order pointeshoes and ballet slippers, and that even stock shoes can take a long time to obtain. ARTISTsfurthermore acknowledge that BSJ needs to keep sufficient stock of shoes on hand or onorder to meet the ARTIST’s expected needs. "Sufficient stock" will be determined by BSJon a case-by-case basis, considering the ARTIST’s history of shoe usage, the repertory to beperformed, and the difficulty of obtaining each ARTIST’s preferred shoes.In the event that ARTISTs preferred shoes are delayed or cannot be procured by BSJ forreasons beyond the control of BSJ or ARTIST, the ARTIST must agree to a shoe that BSJcan procure in a timely fashion until the preferred order arrives or a new shoe selection isreceived.Notwithstanding the above, ARTIST will not be required to wear incorrect, defective orpotentially injury causing shoes.At ARTIST’s request, BSJ will meet with AGMA to discuss resolving any challenges suchARTIST is experiencing with shoes including but not limited to insufficient supply.2) Performance and Rehearsal Accessoriesc) During each ARTISTs first week of employment, BSJ shall provide ARTISTs with thefollowing dance wear for his or her personal use during rehearsals:(i) All ARTISTs:three (3) new pairs of tights(ii) Each female ARTIST: two (2) leotards of her choice(iii)Each male ARTIST:three (3) dance belts of his choiced) In addition for Performances, BSJ shall provide each female ARTIST with tights, dancetrucks, and g-strings, and each male ARTIST with dance belts, t-shirts, and socks asneeded. All such items designated for Performance shall not be taken out of the theater atany time.e) If BSJ request ARTIST to purchase his/her own items, BSJ shall reimburse a monetaryequivalent.3) Costumes(a) Cleaning and Maintenance(i)BSJ agrees ARTIST’s costumes will be cleaned at the beginning of each contractyear and after fifteen (15) wearing of each costume thereafter. BSJ agrees tolaunder all washable performance items (e.g. tights, trunks, dance belts, unitards,and any clothing items that do not require dry-cleaning etc.) after eachperformance or rehearsal for which ARTIST is required to wear a costume or anyportion of a costume. If no costumes are required, upon request, ARTISTs willmake best efforts to wear rehearsal clothes of a similar color to the applicablecostume worn for pieces being rehearsed during any rehearsal for which lightingis being determined At no time shall any ARTIST be required to wear any tights,40
