(fifteen minutes undressing time)(d) The parties understand that the exact arrangement as set fort above may not occur ineach and every day during an In-Theatre Rehearsal/Performance week, however, anyalterations to the <strong>general</strong> paradigm as set forth in this Section shall respect rest spansand maximum amount <strong>of</strong> consecutive artists activity that can be scheduled without arest span and all other relevant Sections <strong>of</strong> this Basic Agreement. Emergencysituations or any other exigent circumstances shall not justify BSJ’s non-compliancewith this Section.(e) No rehearsal shall be permitted following matinee performances.(f) None <strong>of</strong> the above schedules set-forth herein preclude BSJ’s responsibility tocompensate the ARTISTs any Overtime or ECA fees such a schedule might incur.C. PERFORMANCE CONDITIONS1) Maximum Number <strong>of</strong> Performancesa) The ARTIST may be required to take part in no more than eight (8) performances perweek in the City <strong>of</strong> Origination. If the ARTIST shall be required to take part in morethan eight (8) performances in any Monday through Sunday week in the City <strong>of</strong>Origination, he/she shall be paid not less than one-sixth (1/6th) <strong>of</strong> his agreed-uponweekly compensation for each such additional performance. For the purpose <strong>of</strong>calculating number <strong>of</strong> performances in a week each Student Matinee Performance shallequal one-half (1/2) <strong>of</strong> a Performance.b) No ARTIST shall be required to perform in more than two (2) full performances per day.c) Each ARTIST shall receive in each Performance Week one (1) Free Day as definedherein.d) Closing Time <strong>of</strong> PerformanceBSJ agrees that in the event a performance shall be concluded after 11:30 PM or if theperformance exceeds three (3) hours and fifteen (15) minutes length from Curtain Time,each ARTIST shall be compensated at the rate <strong>of</strong> one-half the hourly Overtime Rate foreach half-hour or fraction there<strong>of</strong> during which the ARTIST is required to perform after11:30 PM or in excess <strong>of</strong> (3) hours and fifteen (15) minutes from five (5) minutes pastadvertised Curtain Time or the beginning <strong>of</strong> the music <strong>of</strong> the first (1st) dance piecewhichever occurs first.e) Intermissions/Pauses(i) No rehearsals, walk-throughs, bows or notes, stagings or spacing will occur duringany intermission or pause between pieces unless requested by an ARTIST or in anemergency situation.(ii) Intermissions shall be no less than fifteen (15) minutes in length. Pauses shall be longenough to accommodate whatever ARTIST(s) may need in order to prepare for thefollowing piece (e.g., costume, hairstyle or make-up change).38
