E. BENEFITS1) AGMA Medical Coveragea) Medical CoverageBSJ will provide to all ARTISTs who are engaged for fifteen (15) weeks or more, HealthInsurance that will not fall below the level of coverage and range of providers of theHealth Insurance BSJ ISTS. BSJ will demonstrate that the current Health Insuranceprovided to ARTISTs is equivalent or superior to the AGMA Health Plan A. Suchcoverage will provide basic health benefits and major medical benefits both inside andoutside the city of origination. As of the effective date of this Basic Agreement BSJ shalldemonstrate to AGMA that the Medical Coverage available to ARTIST meets therequirement of this Section. At least sixty (60) days prior to any change in levels ofcoverage or medical service providers, BSJ shall meet and confer with AGMA so as todemonstrate compliance with this Section prior to any final decision taking place.b) Dental CoverageBSJ will provide to all ARTISTs who are engaged for fifteen (15) weeks or more, DentalInsurance for no less than twelve (12) months from first day of coverage per contractyear. Such insurance shall begin on the first day of the month after the first day of eachARTIST’s contract.c) Vision CoverageBSJ will make available to all ARTISTs who are engaged for fifteen (15) weeks or more,Vision Insurance for ARTISTs entire contracted period from the first day of employmentper contract year. BSJ shall make such contributions on behalf of each ARTIST whochooses to participate in such Vision plan and which shall be deducted from eachARTIST’s paycheck on a pre-taxed, pro-rated basis, upon written authorization fromeach ARTIST. Such insurance shall begin on the first day of the month after the first dayof each ARTIST’s contract.d) BSJ will provide to all ARTIST who are engaged for fifteen (15) weeks or more, HealthInsurance for no less than twelve (12) months* from first day of coverage per contractyear, that will not fall below the level of coverage and range of providers of the HealthInsurance BSJ currently provides ARTIST. Such insurance shall begin on the first dayof the month after the first day of each ARTIST’s contract.*For the 2010-11 contract year only, see Addendum 3.e) Family CoverageBSJ agrees to deduct the difference between the cost of Individual Coverage and the costof Family Coverage from the compensation of any ARTIST described in Section IV A 1,above, who chooses to elect such additional dependent coverage. BSJ agrees to remit thispayment to the applicable insurance provider along with the required BSJ contributionson a monthly basis.f) Plan BBSJ shall contribute seventy dollars ($70.00) for the 2010-11contract year per month foreach month ARTIST is engaged per dancer to the AGMA Health Plan B.26
(g) 403(b)BSJ will make available to all ARTISTs who are engaged for fifteen (15) weeks or more,a 403(b) ARTIST-BSJ retirement fund. The ARTISTs contribution is always onehundred percent (100%) vested. New eligible ARTISTs are able to enroll in the plan onthe first day of the month of employment.2) LEAVES(a) Sick and Personal Leavei. BSJ agrees that all ARTISTs shall be given Sick/Personal Leave with full pay atthe rate of one (1) block for each week of employment, during any contract year.ii.iii.iv.For the purpose of calculating Sick/Personal Days each day shall be divided intothree (3) blocks of time; Company Class = first block, end of class to lunch break= second block; After lunch break to end of day = third block. SickLeave/Personal Days = twenty-seven (27) blocks (9 days). Once ARTIST hasexhausted all of his/her Sick and Personal Leave, BSJ may deduct a pro-ratedamount of the ARTISTs’ base weekly compensation for any additional timemissed. Unused Sick and Personal leave shall not carry over to the next contractyear.Except in cases of emergency, on any day that ARTIST will be unable to attendany rehearsal, due to illness, injury or other unforeseen circumstance, ARTISTshall make best efforts to inform BSJ of his/her absence as soon as possible, bythe start of Company Class for that day or three (3) hours prior to the first ArtistActivity for which he/she is required to attend (if no Company Class isscheduled), whichever is later. Such notification shall be made by phone only tothe Stage Management office, at the studios or theater, as appropriate. If ARTISTfails to inform BSJ within the time frame set forth herein then BSJ shall deductone (1) block of time from such ARTIST’s sick-leave allotment as set forth inparagraph ii. above, in addition to the total amount of time ARTIST is absent.Notice for use of personal time: ARTISTs shall conduct personal or privateinterests or business only during non-company time. If unable to do so dancershall provide 2 working days notice to Company, by means of filling out aSick/Personal Time slip and turning it into stage management. The ARTIST shallindicate on the slip the date and time of the anticipated absence, unless preventedfrom doing so by reason of an emergency. No such absence shall be denied,provided that such absence does not contravene the provisions set forth inIV.E.2.a.i and IV.E.2.a.iv. If such occurrence does occur (excluding illness orinjury) BSJ shall deduct block(s) equivalent to those blocks missed plus one (1)additional Sick/Personal Time block from individual ARTIST’s allowance.v. An ARTIST shall not take a Personal Day in an In-Theater week. An ARTISTshall give the Artistic Director at least one (1) week’s notice of his/her intention totake a Personal Day during one (1) week prior to an In-Theater week. Suchrequirements will not apply to absences taken due to illness or injury.27
