2) In-Theatre Rehearsal/Performance Week – any week or major part there<strong>of</strong>, as defined inSection III R, <strong>of</strong> this Basic Agreement, from one Monday through the following Sunday, inwhich a paid public performance is scheduled. The free day during said week shall beMonday unless that is a Travel Day, in which case the Free Day will be on the next Tuesday.3) BSJ shall give ARTISTs at least two (2) consecutive Free Days between an In-Theater andan In-Studio Rehearsal Week immediately following a two-week performance run. BSJ shallgive ARITSTS one and one half (1 ½) days after a one-week performance run. BSJ shall notschedule any <strong>Artists</strong> Activity to begin before noon or after 5:00PM on the half (1/2) dayC. HOLIDAYSARTISTs may not be required to rehearse and/or perform on the following legal holidays: LaborDay, Independence Day, Memorial Day, Martin Luther King Day, Thanksgiving, Christmas,New Year's Day and Easter Sunday and the Friday after Thanksgiving if it should fall on arehearsal week. All such legal holidays shall be in addition to the regularly scheduled Free Days.If the ARTIST is required to perform or rehearse on a legal holiday or if the holiday is scheduledto be the regular Free Day, the ARTISTs shall receive an extra Free Day within the succeedingor preceding two (2) week period <strong>of</strong> employment except Thanksgiving, Christmas, New Year'sDay and Martin Luther King Day which shall have the extra Free Day scheduled within thesucceeding or preceding four (4) week period <strong>of</strong> employment. If an alternate Free Day cannotbe scheduled ARTISTs will be compensated at one-sixth (1/6) <strong>of</strong> the weekly salary. Legalholidays which fall on a Sunday do not require an additional Free Day during that same week,provided the ARTIST shall have an alternate Free Day scheduled.D. LAYOFFS1) BSJ may lay <strong>of</strong>f ARTISTs in the City <strong>of</strong> Origination without any compensation. BSJ agreesthat all employment outside the City <strong>of</strong> Origination shall be continuous, and each ARTISTshall be compensated therefore at his Performance Week salary, and that it shall not lay <strong>of</strong>fan ARTIST in any place other than the City <strong>of</strong> Origination.2) In no event shall lay-<strong>of</strong>f affect the guaranteed number <strong>of</strong> weeks <strong>of</strong> employment.3) No lay<strong>of</strong>fs or return to employment shall occur without six (6) weeks prior writtennotification to each ARTIST.4) When the ARTIST returns to employment following a lay-<strong>of</strong>f period, BSJ agrees that therehearsal schedule will be posted by noon two (2) working days before the beginning <strong>of</strong>rehearsal.5) No lay-<strong>of</strong>f during the contract year shall be longer than three (3) weeks.6) BSJ will ensure that dance studios are made available to ARTISTs during all lay-<strong>of</strong>f weeks(i.e. Thanksgiving) given that ARTISTs use the studios during regular business hours when amember <strong>of</strong> management is present. ARTISTs will be required to sign a release <strong>of</strong> liability touse the facilities during these lay-<strong>of</strong>f weeks and will need to respect the studio requirements<strong>of</strong> the Ballet San Jose School during these periods. ARTISTs will need to schedule such usewith the Ballet San Jose School staff to prevent overbooking <strong>of</strong> studio space.14
