SECTION II: EMPLOYMENT CONDITIONSA. MINIMUM EMPLOYMENT GUARANTEE1) BSJ guarantees to employ on a Guaranteed Employment Basis (as used in Exhibit A hereto),in each contract year not less than thirty-one (31) Company Members (not including GuestArtists), of which two (2) may be Apprentices for all contracted rehearsal and performanceweeks. Guaranteed Employment means employment of the ARTIST (by BSJ whereby BSJguarantees the ARTIST) for not less than the following number of weeks of employmentwithin a thirty-six (36) week consecutive (week) period:2010-11Number of Weeks 27Consecutive Weeks Span 36Such Guaranteed Employment shall consist of any 12-month period as designated by BSJ, asuniformly reflected in each individual ARTIST AGREEMENT No weeks of employmentfrom one Season shall be credited or offset to comply with the guarantee requirement inanother Season.2) Only if BSJ has engaged thirty-one (31) Company Members on a guaranteed employmentbasis for the required number of weeks outlined in Section II A.1., above, may any additionalARTISTs such as a Dancer engaged to augment the company or to replace an injured orabsent Company Member be hired.3) If the dancer guarantee is not satisfied at the beginning of the contract period, BSJ shalldivide the total salary for each unfulfilled contract including Plan B contributions equallyamongst the dancers for each employment week such contract remains unfulfilled after two(2) weeks.4) Rehearsal – Minimum GuaranteeAt the beginning of any contract year or following a lay-off of three (3) weeks or more BSJwill guarantee to the ARTIST not less than two (2) Rehearsal Weeks prior to the beginningof performance.B. WEEKS AND FREE DAYSWeek: a period of seven (7) full consecutive days. Any week of three (3) days or less may beprorated with regard to compensation. Any week of more than three (3) days shall be considereda full week.1) In-Studio Rehearsal Week – any week or major part thereof, as defined in Section III T, ofthis Basic Agreement, which is spent in BSJ’s rehearsal facilities in preparation for aperformance.13
