4) Should any non-payment <strong>of</strong> salaries occur, BSJ will cooperate with AGMA in securingmonies in the amount <strong>of</strong> the unpaid compensation from the California Unpaid Wages Fundadministered by the California Department <strong>of</strong> Industrial Relations.T. SOCIAL SECURITY, WORKER’s COMPENSATION FUND1) BSJ must carry at its expense adequate Worker's Compensation Insurance, securing to all <strong>of</strong>the ARTISTs, wherever they may work for BSJ, compensation for injury, disability or deathfrom injury sustained in the course <strong>of</strong> their employment, without regard to fault as a cause <strong>of</strong>the injury, except that there shall be no liability for compensation when the injury has beensolely occasioned by intoxication <strong>of</strong> the injured ARTIST while on duty, or by willfulintention <strong>of</strong> the injured ARTIST to bring about the injury or death to himself or another.2) BSJ agrees to obtain coverage for all ARTISTs employed hereunder as permitted under theCalifornia State Unemployment Insurance Law. BSJ agrees to provide ARTISTs and AGMAany information in its possession necessary to secure ARTISTs any unemployment insurancebenefits earned and due.3) BSJ agrees to elect to continue to cover all ARTISTs herein under the Social Security laws <strong>of</strong>the United States and to execute and file the necessary forms required to obtain suchcoverage and, thereafter, as required by the laws, to make the proper contributions under theterms <strong>of</strong> the laws.4) The contribution made by BSJ for Unemployment Insurance or Social Security tax purposesshall be based upon the compensation provided for in the Standard Artist's Contract forEmployment or the actual gross compensation paid to the ARTIST, whichever shall begreater. No reference shall be made to amounts declared as exempt for Federal Income TaxWithholding purpose in determining what constitutes gross compensation for purposes <strong>of</strong>Unemployment Insurance and Social Security.5) Upon request, BSJ shall disclose to AGMA evidence <strong>of</strong> BSJ’s compliance with the<strong>provisions</strong> <strong>of</strong> this paragraph. BSJ agrees to meet and confer with AGMA as required by lawshould it consider any change to the coverage outlined in this Section effective as <strong>of</strong> the date<strong>of</strong> this Basic Agreement.U. ARBITRATION1) Any controversy or claim arising out <strong>of</strong> or relating to this Basic Agreement or theinterpretation, performance or breach there<strong>of</strong>, shall be settled by arbitration. Either party maydemand such arbitration by giving written notice <strong>of</strong> such demand. An impartial permanentarbitrator to be mutually selected within thirty (30) days <strong>of</strong> the ratification <strong>of</strong> this BasicAgreement shall hear and decide all matters referred to arbitration by either party.2) Any dispute regarding an ARTIST’s Standard ARTIST Agreement may be arbitrated in thesame manner described in the above Section I V <strong>of</strong> this Basic Agreement, in front <strong>of</strong> thepermanent arbitrator, unless ARTIST objects. Then ARTIST, AGMA and BSJ all agree tochoose another arbitrator.11
