Q. PAYMENT OF SALARIESBSJ agrees that all ARTISTs, shall with best efforts be paid by cash, check, or upon agreementby the ARTIST, by direct deposit to the ARTISTs specified bank account not later than 12:00noon on Friday <strong>of</strong> the week following each week <strong>of</strong> employment. All overtime payments, ECApayments, over mileage payments or any other payments which arise separate and apart from theweekly minimum salaries shall be paid by BSJ to the ARTIST no later than the Friday <strong>of</strong> theweek following each week <strong>of</strong> employment. Payment will include a detailed breakdown definingthe nature <strong>of</strong> all included compensation.R. NON-PAYMENT OR PARTIAL PAYMENT OF SALARIES1) Non-payment, or partial payment <strong>of</strong> salaries, when due, shall be deemed a material breach <strong>of</strong>contract, giving any ARTIST the right to terminate forthwith his contract with BSJ.However, upon application and sufficient pro<strong>of</strong> by BSJ <strong>of</strong> the reasons for any non-payment,AGMA in its discretion may grant BSJ a grace period not to exceed seven (7) days.2) If BSJ fails to pay the salary due the ARTIST, the ARTIST shall have an alternative right toreceive his contracted salary out <strong>of</strong> BSJ’s reserve funds as set forth in Section T belowAGMA shall notify BSJ <strong>of</strong> its intention to so pay the ARTIST; and if BSJ fails to institutearbitration proceeding within five (5) calendar days, AGMA will proceed to commencepayment to the ARTIST. BSJ agrees to replenish the security deposit upon receipt <strong>of</strong> arequest from AGMA to replenish the security deposit. Acceptance by the ARTIST <strong>of</strong> hissalary out <strong>of</strong> the security deposit shall be a waiver on his part <strong>of</strong> his right to terminate hiscontract with BSJ.S. SECURITY DEPOSIT/BOND1) At least one (1) week before the commencement <strong>of</strong> any rehearsal, engagement, series <strong>of</strong>engagements or tour within or without the United States <strong>of</strong> America, or at least one (1) weekbefore the ARTIST commences to travel in pursuance <strong>of</strong> any engagements, series <strong>of</strong>engagements or tour within or without the United States <strong>of</strong> America, whichever is earlier,BSJ shall provide pro<strong>of</strong> <strong>of</strong> the liquid reserve sufficient to cover one (1) week‘s payroll. Thecertified pro<strong>of</strong> <strong>of</strong> existence <strong>of</strong> the reserve must be shared with AGMA not less than monthlyfor the duration <strong>of</strong> this Basic Agreement.2) Pro<strong>of</strong> <strong>of</strong> the placing <strong>of</strong> the security bond with AGMA will be posted on the company bulletinboard and the AGMA bulletin board not later than the first (1st) day <strong>of</strong> each employmentperiod.3) No ARTIST shall leave the city <strong>of</strong> origination for work outside said city unless BSJ, prior tothe ARTIST’s departure therefrom, has provided and paid for his transportation and hisbaggage, including return transportation back to the city <strong>of</strong> origination. AGMA shall havethe right to require BSJ to post such bond or bonds or such other security, including money,and in such amount as in its sole discretion AGMA deems necessary to insure the safetransportation and return <strong>of</strong> the ARTIST. AGMA reserves the right to set up other terms andconditions for granting permission to BSJ to take any ARTISTs for an engagement, series <strong>of</strong>engagements or tours outside <strong>of</strong> the United States <strong>of</strong> America, as provided in the standardOverseas Rider attached hereto. All other foreign travel per diem shall be separatelynegotiated in the standard Overseas Rider.10
