AGREEMENT BOND – HOSTEL MESS CONTRACTThis agreement is made between Mr. /Ms. _______________________________S/O /D/O _______________________________ herein called the Contractor as the firstparty and the Chief Warden. BPS Mahila Vishwavidyalaya <strong>Hostel</strong> No. _________ as thesecond party for providing and serving Meals to the residents of the <strong>Hostel</strong>.TERMS AND CONDITIONS: GENERAL1. This agreement for BPS <strong>Hostel</strong> <strong>Mess</strong>es shall be for 11 months. W.e.f. July,<strong>2009</strong> to May, 20<strong>10</strong>. On the condition that the contract shall be for 3 monthsinitially and on satisfactory performance it be extended for the full session.2. The contractor shall procure the licence issued by the Health Authority,Chandigarh under the prevention of Food. Adulteration Act at his own cost.3. <strong>Mess</strong> premises in the hostel with equipment and water supply fixtures shall beprovided to the contractor on a payment of Rs. 450/- p.m. as utility chargesincluding rent. The payment should be made by the <strong>10</strong> th of every month.Water in the Canteen and dining area shall be free of charge. Rs. <strong>10</strong>00/- p.m.shall be charged as payment for electricity.4. One/two unfurnished servant quarters shall be provided for the contractor. Noservant shall be allowed to stay in the <strong>Mess</strong> area after duty hours. At thecessation of the contract the contractor shall vacate the premises within twoweeks, an extension of a maximum period of 15 days may be granted forwhich he will be charged. Rs. 400/- for the period.5. Furniture (chairs, work tables and dining tables) shall be provided by the<strong>Hostel</strong>. The maintenance and custody of the furniture shall be theresponsibility of the Contractor and any loss or damage of the furniture shallbe the liability of the Contractor.


6. Gas installation and empty gas cylinders shall be provided by the hostelagainst a cash security of Rs. 5000/-. To get refills of LPG for use shall beentirely the responsibility of the Contractor, its maintenance, repairs andlosses for these shall be deducted from the Contractors bill.7. Cylinders shall not be taken out of the fixed system. <strong>For</strong> any misuse ormalpractice by the Contractor the contract shall be terminated without anynotice. Legal action will be taken for any use of kerosene oil stove or anyother fuels are prohibited.8. Utensils for cooking, serving etc shall be supplied by the hostel to theContractor and have to be returned to the hostel Office at the end of thesession. Breakage and loss of these utensils shall be the responsibility of theContractor and recovery at current rates shall be made from the securitydeposit of the contractor. The Contractor shall take over all equipment andgadgets after physical verification of the items.9. The Contractor and the <strong>Mess</strong> servants shall be responsible for keeping the<strong>Mess</strong> clean and maintaining hygienic condition. The <strong>Mess</strong> staff will wearuniform while on duty and use aprons and overalls provided by the contractor.Non compliance of this shall make the Contractor liable for imposition of fine.OBLIGATORY<strong>10</strong>. Canteen rates for the full session shall be fixed by the authorities and anyrevision of the rates shall be made by the authorities. The rates shall bebinding on all Contractors.11. The Contractor shall deposit Rs. 5000/- in cash as security deposit with thehostel for utensils/equipment. The same shall be refundable at the end of thesession after final settlement of accounts.12. A good food, good conduct A security deposit of Rs. <strong>10</strong>00/- will be chargedwhich is liable to the forfeited in case of repeated and serious defaults on thepart of the Contractor. Decision of the Warden in this regard shall be final.13. All the material and food articles shall be kept in closed covered containers.


14. The authorities or their nominee shall have access to the premises at all timesto inspect & see that the agreed conditions are strictly adhered to.15. Smoking and consumption of alcohol/intoxicants in the premises is strictlyprohibited.16. The Contractor will remain on the premises during working hours only. Heshall take permission from the Warden when moving out of station.17. The Contractor shall not close the <strong>Mess</strong> without the order of the Warden. Anysuch misconduct shall be liable to a fine of Rs. <strong>10</strong>00/- or less or termination ofcontract or both.18. <strong>For</strong> self-termination of the contract the Contractor shall give a notice of onemonth in advance, otherwise his security deposit shall be forfeited.19. The Contractors shall cooperate with the Chief Warden regarding garbagedisposal and follow her instructions to ensure proper disposal.20. Food will not be served to the residents in their rooms by the contractorwithout Warden’s permission.21. The Contractor will employ one servant for every 50 resident <strong>Mess</strong> membersas well as one cook and one assistant cook.22. The Contractor shall maintain complete service record and biodata of allemployees engaged by him, their photographs, addresses, signatures etc andsubmit the same to the office of the concerned Warden.23. The Contractor will employ only persons who are medically fit employees.All employees before being engaged for duty shall undergo a completemedical check-up (urine, stool examination) at M.S.M. Ayurvedic HospitalKhanpur Kalan.24. Police verification of the <strong>Mess</strong> employees shall be done by the Contractorwith the Police Station Sonipat/Gohana/Khanpur Kalan. The contract will beoperative only after the Contractor produces the medical certificate and policeverification of all employees of the mess.


25. Any change of an employee shall be brought to the notice of the Wardenconcerned and the Contractor shall get their medical examination and policeverification done immediately.26. General discipline and hostel rules are to be observed by the Contractor andhis employees. The Contractor shall be fully responsible for the conduct of hisemployees.27. The Contractor shall observe and follow the conditions laid down in labourlaws, employment Act and wages Rules etc.28. The contractor shall use good quality ration items and other materialsapproved by the hostel authorities.PAYMENT AND DEFAULTERS:29. The Contractor shall submit the Canteen bill for the residents by the 5 th ofevery month. The bill shall be prepared as per approved rates. The hosteloffice shall help in collection of bills and Rs. 3/- per account per month shallbe deducted from the bill as collection charges.30. The Contractor shall not serve food to any outsider except to the guests ofbonafide residents.31. The Contractor shall display the monthly bill of individual residents on thenotice Board with entries in terms of amount due from the residents.32. All the bills shall be cleared by 20 th of every month. 50% of the payment dueto the contractor may be made 5 days after the bill is submitted. The defaultersin terms of non-payment of dues by resident shall be notified by the Officeevery month.33. The Contractor shall not serve any defaulter for whom the service has beenstopped by the Warden. Further bill in respect of defaulter shall not beentertained.34. Equipment, gadgets, utensils and fixtures in the <strong>Mess</strong> shall be handed over tothe contractor in good condition. Maintenance and proper repair of these items


shall be the responsibility of the contractor and expenses incurred on this aswell losses shall be recovered from the contractor.35. The hostel authorities shall prepare the menu every month as per seasonalavailability and the same shall be followed unless the warden authorizeschange.36. In case of any dispute the decision of the Chief Warden shall be final.37.
