ID – P185)Contract No. UPJN/AWSP/ 5A Conduit Pipe1. The Government of India (GOI) has received a loan from Japan InternationalCooperation Agency (JICA) towards the cost of the Agra Water Supply Project.It is intended that part of the proceeds of this loan will be applied to eligiblepayments under Contract 5A: Conduit Pipelines. The Bidding Document hasbeen vetted by JICA, and disbursement of the ODA Loan by JICA will besubject, in all respects, to the terms and conditions of the Loan Agreement,including the disbursement procedures and the "Guidelines for Procurementunder JICA ODA Loans”. No party other than GOI shall derive any rights fromthe loan agreement or have any claim to loan proceeds. The above loanagreement will cover only a part of the project cost. As for the remaining portion,GOI will take appropriate measures for finance.2. JICA requires that bidders and contractors, as well as GOI, under contractsfunded with JICA ODA Loans and other Japanese ODA, observe the higheststandard of ethics during the procurement and execution of such contracts. Inpursuance of this policy, JICA will;(a)(b)reject a proposal for award if it determines that the bidder recommendedfor award has engaged in corrupt or fraudulent practices in competing forthe contract in question; andrecognize a contractor as ineligible, for a period determined by JICA, tobe awarded a contract funded with JICA ODA Loans if it at any timedetermines that the contractor has engaged in corrupt or fraudulentpractices in competing for, or in executing, another contract funded withJICA ODA Loans or other Japanese ODA.3. The Project Director, Agra Water Supply Project, Uttar Pradesh Jal Nigam(UPJN), Agra (hereinafter called as “the Employer”) now invites sealed bidsfrom eligible bidders for the construction and completion of the following work(“the Works”):Contract No. 5A – Conduit Pipes.The main elements of this contract comprise the supply and construction oftwo, parallel, 2100 mm diameter mild steel gravity mains of approximately 50km length each (100 km total). The approximate alignment for the Contract isfrom the Intake and Settling Tank at Palra (on the bank of the Upper GangaInvitation for Bids Contract 5A Page 1 of 5


Canal), along Mat feeder canal to Station 50+025. From Station 50+025, thepipelines will extend under a separate Contract 5B (not included in thisContract) along the Mat Branch Canal.4. The Bidder should note that multiple bids, namely Contract Nos. 5B, 5C, and7, are also being invited along with this Bid. Bidders are allowed to bid for allcontracts for which they qualify.5. Conditional Bids will not be accepted.6. Minimum eligibility requirements for qualification are:7.1 TurnoverThe Bidder shall demonstrate that he has successfully completed works overthe last three years with an average annual turnover as prime contractor ofmore than INR 5768 Million. If the Bidder wishes to be considered foraward of multiple contracts, then he must demonstrate an average annualturnover greater than or equal to the sum of the annual turnover requirementsof these contracts.7.2 Cash Flow RequirementThe Bidder shall demonstrate that he has access to, or has available, workingcapital, liquid assets, available lines of credit, and other financial meanssufficient to meet the required cash flow for execution of Contract for a periodof 4 months during the duration of the contract, estimated as INR 962 millionequivalent, net of the Applicant’s commitments for other contracts. If theBidder wishes to be considered for award of multiple contracts, then he mustdemonstrate financial means sufficient to meet the cumulative cash flowrequirements of these contracts.7.3 Net WorthThe Bidder shall demonstrate that his current net worth (assessed as totalassets minus total liabilities in the latest completed financial year) shall bepositive. The requisite information shall be certified by a RegisteredAccountant, and shall be accompanied by audited financial statements for thelast five years. If the Bidder wishes to be considered for award of multiplecontracts, then he must certify a net worth greater than or equal to the sum ofthe net worth requirements of these contracts.Invitation for Bids Contract 5A Page 2 of 5


7.4 Bidding CapacityThe bidder shall have an available bid capacity of not less than INR 10815Million.Bid Capacity shall be assessed on present value of completed contracts andcontracts in hand by the following method:Bidding Capacity = 2 x A x N – B Where,A= Minimum turnover during the last three financial year ending on 31-03-2013 (corrected to the current level of value).N= Stipulated period of execution of contract in years.B= value of existing commitments to be completed during the executionperiod of bid.Multiplying factor for assessing the current level of value shall be 1.10 for2011-12, 1.21 for 2010-11 and 1.331 for 2009-2010.The requisite information shall be furnished in an appropriate format, and shallbe certified by a Registered Accountant.7.5 Water Supply Pipeline Construction Contractor’s ExperienceThe Bidder shall demonstrate that it has successfully and satisfactorilycompleted during the last seven years at least one similar water supplypipeline works contract, of contract value not less than INR 5768 Million(including the value of pipeline materials),OrTwo similar water supply pipeline works contract, of contract value not lessthan amount* equals to INR 3605 Million (including the value of pipelinematerials),OrThree similar water supply pipeline works contract, of contract value not lessthan amount* equals to INR 2885 Million (including the value of pipelinematerials),The similarity shall be based on the physical size, complexity,methods/technology or other characteristics as described in the scope of theworks.*The amount shall be brought to present year value by appropriate multiflyingfactor mentioned in the bid document.7.6 Steel Pipeline Construction ExperienceThe Bidder shall demonstrate that they have experience of procurement,laying, jointing, testing and commissioning of mild steel pipelines for watertransmission within the last seven years as follows:Invitation for Bids Contract 5A Page 3 of 5


One contract of at least 55km length of 1300mm internal diameter and above.orTwo contracts of at least 40km length of 1300mm internal diameter and above.orThree contracts of at least 25km length of 1300mm internal diameter andabove.7.7 Mild Steel Pipeline Manufacturing ExperiencePipes shall be procured from one or more number of spirally welded pipesmanufactured from HR coils manufacturing agencies having followingindicated credentials, which shall be duly approved by the Employer.ISI Licence as per IS3589ISO 9001 and OHSAS 18001 certificate.7.8 Mild Steel Pipe Manufacturing CapacityThe Bidder is required to list the details of specific experience of Watertransmission Pipeline fabrication using HR Coils and such contractssuccessfully executed in last seven years.8. A complete set of bidding documents may be purchased by interested bidders onthe submission of a written application to the above and upon payment of a nonrefundablefee of INR 21,000/- (Indian Rupees Twenty One Thousandincluding 5% VAT or as applicable) or US $ 500 (US Dollars five hundredonly including 5% VAT) for each single Application, during normal workingdays and hours upto18-06-2013at the office indicated in Paragraph 6. The feeshall be payable in the form of demand draft drawn in favor of the ProjectManager, Ganga Jal Project Unit, U. P. Jal Nigam, Agra, from a bank, andpayable in Agra.9. A three envelope International Competitive Bidding (ICB) procedure(Eligibility Requirement, Technical Bid and Price Bid) will be adopted.Bidders shall submit the Eligibility Requirements, Technical Bid and Price Bidin paper form, in three separate sealed envelopes. Initially only the EligibilityRequirements and Technical Bid submitted shall be opened. The EligibilityRequirements and Technical Bid of the bidder which are not substantiallyresponsive will be rejected. If necessary, the Employer will seek clarificationof the Eligibility Requirements or Technical Bid, but no change in the price orsubstance of the bid shall be sought, offered or permitted, except to getadditional information to fully understand the proposals of the bidder and toconfirm that the requirements of the bidding documents are met. At the end ofthe evaluation of Technical Bid and after receiving the approval of JICA, theEmployer will invite bidders who have submitted substantially responsiveTechnical Bids and who have been determined as being qualified to attend thebid opening of the Price Bids.Invitation for Bids Contract 5A Page 4 of 5


10. Bids must be delivered to the above office on or before 1200 hrs on 15-07-2013and must be accompanied by a bid security of not less than INR 72,000,000(Indian Rupees Seventy Two Million only) or equivalent amount in a freelyconvertible currency in the name of the Project Director, Agra Water SupplyProject. The bid security must be delivered in a separate envelope within theenvelope for the Technical Bid. Any bid not accompanied by the bid securityshall be rejected. In the event of the specified date of the bid opening beingdeclared a holiday for the Employer, the bids shall be received and opened atthe same time and place on the next working day. It should be noted that thedate of bid submission cannot be extended in any case.11. The Qualification Bids will be opened on 15-07-2013 in the presence of bidders’representatives who choose to attend at 1500 hrs at the office indicated inParagraph 6.12. Bids delivered after the due date and time stated above will be declared “Late”and late bids shall be rejected.13. The Employer will not be responsible for any costs or expenses incurred bythe bidders in connection with preparation or delivery of bids as well as forany delay.14. The Employer reserves the right to accept any bid, or reject any or all bids,without assigning any reason thereof and without thereby incurring anyliability to the bidder or bidders.15. Price Bids of the Bids will be opened in the presence of the bidder’srepresentatives of technically qualified bidders who choose to attend at thetime and at the address to be advised by the Employer after approval of theevaluation of the Technical Bids. The time of price proposal opening will beinformed to the technically qualified Bidders by Electronic mail or Fax,followed by written letter on their postal address.16. A pre bid meeting will be held on 28-06-2013 at 1000 hrs in the office of theundersigned for any clarifications on the bid documents. The bidders arerequested to submit their queries, if any, in writing to reach Employer, not laterthan five (5) days before this Pre-bid meeting.17.
