MONTSERRATLABOUR CODE, <strong>2012</strong>No. 20 <strong>of</strong> <strong>2012</strong>162. Deposit and safeguard <strong>of</strong> funds(1) All funds received by or on behalf <strong>of</strong> a trade union or anemployers' organisation shall be deposited to the tradeunion or employers' organisation's bank account.(2) Every expenditure <strong>of</strong> funds by or on behalf <strong>of</strong> a tradeunion or employers' organisation shall be evidenced by awritten receipt or voucher, which shall be kept with thetrade union or employers' organisation's accounts.(3) The treasurer or the <strong>of</strong>ficer responsible for the custody<strong>of</strong> the trade union or employers' organisation's funds andproperty, including its records, shall hand over suchfunds and property to the trade union or employers'organisation when he or she leaves <strong>of</strong>fice, or earlier ifdirected by the governing body <strong>of</strong> trade union oremployers' the organisation.(4) Upon the application by a member or <strong>of</strong>ficer <strong>of</strong> the tradeunion or employers' organisation to the High Court, theCourt may make such order as it deems necessary tosecure compliance with this section.163. Application for certificationA trade union claiming to have as its members in goodstanding a majority <strong>of</strong> the employees <strong>of</strong> an employer ina bargaining unit may, subject to the provisions <strong>of</strong> thisPart, make an application to the <strong>Labour</strong> Commissionerto be certified as the exclusive bargaining agent <strong>of</strong> theemployees in the unit.164. Application procedure(1) A trade union claiming to have as its members in goodstanding a majority <strong>of</strong> the employees in a bargainingunit may, subject to the provisions <strong>of</strong> this Part, submitan application to the <strong>Labour</strong> Commissioner to becertified as the exclusive bargaining agent <strong>of</strong> theemployees in the unit.(2) A trade union which was certified as the bargainingagent immediately before the commencement <strong>of</strong> this97
