MONTSERRATLABOUR CODE, 2012No. 20 of 2012(c) the name of the trade union or employers’organisation is not identical to that of any existingtrade union or organisation or so closely resemblingthat name as to be likely to deceive its ownmembers or members of the public,the Registrar shall register the trade union or employers'organisation and furnish it with a certificate ofregistration.(6) A trade union or employers' organisation which wasregistered prior to the commencement of the Code shallbe deemed registered under the Code.(7) A person aggrieved by the refusal or failure of theRegistrar to register a trade union or employers'organisation may apply to the High Court within thetime and in the manner and on the conditions directed bythe Rules of Court.143. Rules of trade unionThe rules of every trade union and employers'organisation shall include the information contained inthe Schedule.144. Alterations in constitution or name(1) A trade union or employers' organisation may amend itsrules, in accordance with the procedures set out in itsrules.(2) The trade union or employers' organisation shalltransmit the proposed amendments to the rules to theRegistrar, and if the Registrar is satisfied that saidamendments are consistent with the Code, the Registrarshall issue a written certificate of approval.(3) The amendments shall take effect from the date of theRegistrar’s certificate of approval.(4) Subject to section 142 (5)(c) any trade union oremployers' organisation may change the name underwhich it is registered in the same manner as an88
