MONTSERRATLABOUR CODE, 2012No. 20 of 2012(e) arrangements for the return travel of the prospectiveemployee; and(f) the prescribed fee.(2) A person who makes a false statement in an applicationfor a work permit or work permit renewal or in responseto any queries put to him or her in the course of aninvestigation during the work permit applicationprocess, commits an offence and is liable on summaryconviction to a fine of $5,000.00.129. Rights of migrant worker(1) An employer shall inform a work permit holder, whererecruited from abroad, of his or her terms and conditionsof employment, arrangements for accommodation andreturn travel to his or her home country or country ofrecruitment prior to his or her arrival in Montserrat.(2) An employer shall not compel a work permit holder tolive with his or her employer.(3) An employer shall not compel a work permit holder,who is employed as a domestic worker, to remain in thehousehold of his or her employer during periods ofweekly rest and holidays.(4) An employer shall not keep a work permit holder’stravel and identity documents in his or her possession.130. Penalty applicable to employersAn employer who contravenes this Part commits anoffence and is liable on summary conviction to a fine of$5,000.00.131. Revocation of work permitA work permit may be revoked by the Governor actingon the advice of the Cabinet.82

FeesThe Governor acting on the advice of Cabinet shall, byOrder specify the fee to be paid for every application forthe grant, renewal or extension of a work permit.PART 12—REGISTRATION, STATUS ANDRECOGNITION OF TRADE UNIONS AND EMPLOYERS’ORGANISATIONS133. InterpretationIn this Part—“employers' organisation” means any associationestablished by employers, the principalpurposes of which are the representation andpromotion of employers' interests and theregulation of relations between employers andemployees;“managerial employee” means an individual who hasmanagerial responsibilities and who worksunder a contract of employment;“Registrar” means the Registrar of the High Court;“rules” means rules made by a trade union as authorizedby this Code;“trade dispute” means any dispute or differencebetween employers and workmen, or betweenworkmen and workmen, connected with theemployment or non-employment, or the termsof employment, or with the conditions oflabour, of any person;“trade union” means any association of personsregistered under the Code, the principalpurposes of which are the representation andpromotion of employees interests and theregulation of relations between employeesand employers, and includes a federation oftrade unions, but not an organization orassociation that is dominated by an employeror employers’ organization.83
