MONTSERRATLABOUR CODE, <strong>2012</strong>No. 20 <strong>of</strong> <strong>2012</strong>(2) An application for a work permit shall be made by theintended employer on behalf <strong>of</strong> the person for whom thepermit is sought, by filing an application, in theprescribed form, with the <strong>Labour</strong> Commissioner.(3) Unless the applicant is a self-employed person, theapplication shall be accompanied by a statement in theprescribed form, completed by the intended employer.(4) The Governor acting on the advice <strong>of</strong> Cabinet may, inapproving a work permit, impose any condition it mayconsider appropriate to promote the work permit policy<strong>of</strong> <strong>Montserrat</strong>.(5) The Minister shall, in considering an application undersubsection (3) take into account the extent to which theemployer has complied with conditions imposed undersubsection (2), the Social Security Act and the Incomeand Corporation Tax Act.(6) An application for a temporary work permit or itsrenewal shall be made by the employer on behalf <strong>of</strong> theperson for whom the permit is sought, by filing directlywith the Minister through the <strong>Labour</strong> Commissioner, anapplication in the prescribed form.(7) A work permit holder shall not seek alternativeemployment in <strong>Montserrat</strong> during the validity <strong>of</strong> thework permit unless he or she has the prior approval <strong>of</strong>the Minister.(8) Despite any other provision, a person who has thewritten consent <strong>of</strong> the primary employer may engage theservices <strong>of</strong> a work permit holder for not more than 5days per month.(9) The Governor acting on the advice <strong>of</strong> Cabinet may varythe conditions <strong>of</strong> a work permit.127. Exemption(1) The Governor acting on the advice <strong>of</strong> Cabinet may, byOrder, exempt a person or class <strong>of</strong> persons from therequirements <strong>of</strong> a work permit.79
