MONTSERRATLABOUR CODE, 2012No. 20 of 2012(a) the risks to the safety and health of his or heremployees to which they are exposed whilst theyare at work; and(b) the risks to the safety and health of persons not inhis or her employment arising out of or inconnection with the conduct by him or her of his orher undertaking,for the purpose of identifying the measures he or sheneeds to take to comply with the requirements andprohibitions imposed upon him or her by or under anyenactment.101. Safety and health policy and emergency plan(1) The operator of a workplace where there are 20 or moreemployees shall prepare or revise, in consultation withthe employees’ representatives—(a) a written statement of the general policy withrespect to the safety and health of the employees,together with an implementation plan; and(b) an emergency plan in writing based on the riskassessment which shall include—(i) suitable and rapid means of obtaining first aidhelp and transportation from the workplace to ahospital for injured workers; and(ii) measures and procedures to be used to control amajor fire, to react to serious damage to theworkplace, to evacuate the workplace and tonotify rescue personnel.(2) The operator of a workplace shall submit the statementand the emergency plan prepared in accordance withsubsection (1), to the Labour Commissioner and shallbring them to the notice of all employees.(3) The operator of a workplace shall ensure, as far as isreasonably practicable, that no unsafe structure exists inthe workplace that is likely to expose persons to risks tobodily injury.64
