Pay for period of call out or being on call(1) Where an employee who is required by his or heremployer is called out for work at the work place, he orshe shall be regarded as being on duty for that periodand be paid wages accordingly.(2) Where an employee is required by his or her employerto remain on call for any period, the employee shall bepaid an allowance to be agreed upon by the employerand employee.40. Payment in respect of public holidays(1) Where an employee does not work for his or heremployer on a public holiday, he or she shall not sufferloss of pay, provided that he or she worked on his or herscheduled work-day immediately before andimmediately after the said public holiday.(2) Where an employer requires an employee to work on apublic holiday, whether as part of the employee’sscheduled work day or not, the employer shall pay to theemployee at double time his or her basic wage for eachhour worked on that day.(3) Where employees are remunerated on a piece-work orby task, the expression “basic rate of pay” shall, for thepurposes of this section, be deemed to be equal to theemployee’s earnings over the period of thirteen weeksimmediately preceding the date payment is made,divided by the number of days worked during thatperiod.(4) The overtime pay for work on a public holiday shall notapply to persons holding positions of supervision ormanagement whose basic rate of pay and other termsand conditions of employment are at a level whichadequately compensates them.32

Wages to be paid in legal tenderThe wages of an employee is to be paid in legal tendereither directly in cash or by bank transfer, bank cheque,money order or other lawful means of monetarypayment with the consent of the employee.42. Remuneration other than wagesNothing in the Code shall render illegal an agreement orcontract with an employee for giving to him or her food,a dwelling place or other allowances or privileges inaddition to money wages as a remuneration for hisservice, provided that no employer shall give to aworker any illicit drugs or intoxicating liquor by way ofsuch remuneration.43. Agreements to place and manner of spending wagesillegalAn employer shall not impose in a contract for theemployment of an employee any terms as to the place atwhich, or the manner in which, or the person withwhom, any wages paid to the worker are to be expended,and every contract between an employer and anemployee containing such terms shall be illegal, null andvoid.44. Interest on advances prohibited(1) An employer shall not make any deduction by way ofinterest or any similar charge on account of any advanceof wages made to an employee in anticipation of theregular period of payment of such wages.(2) Any deduction from an employee’s wages for anadvance made by an employer to the employee shouldnot exceed 1/3 the wages of the employee.45. Deduction or payment in respect of fines prohibitedAn employer shall not make any deduction or make anyagreement or contract with an employee for anydeduction from the wages to be paid by the employer to33
