MONTSERRATLABOUR CODE, <strong>2012</strong>No. 20 <strong>of</strong> <strong>2012</strong>31. Contracts <strong>of</strong> employment deemed to be indefinitedurationWhere it appears to the Tribunal that a fixed termemployment contract is renewed so as to evade theprovisions <strong>of</strong> the <strong>Code</strong>, the Tribunal shall determine thatcontract to be for an indefinite period.32. Written terms and conditions <strong>of</strong> employment(1) Where an employee is engaged by an employer for aterm <strong>of</strong> employment exceeding 3 months, the employershall furnish the employee and the <strong>Labour</strong>Commissioner with a written statement within 10working days <strong>of</strong> engagement containing the terms andconditions <strong>of</strong> employment including—(a) the name and address <strong>of</strong> the employer and employeeand the responsibilities and duties <strong>of</strong> the employee;(b) the regular hours <strong>of</strong> work and rest periods;(c) the starting pay, methods <strong>of</strong> computing the pay andpay scale;(d) the interval between payment <strong>of</strong> wages;(e) the term <strong>of</strong> employment, if other than indefinite;(f) the period <strong>of</strong> probation, if any; and(g) the employee’s vacation and sick entitlement.(2) The written statement is to be signed by the employer,the employee and a witness.(3) Where a migrant worker is recruited from abroad, theemployer shall ensure that the terms and conditions <strong>of</strong>employment are conveyed to him or her in a languagethat he or she understands prior to his arrival in<strong>Montserrat</strong> and should indicate what arrangements aremade for his or her accommodation and return to his orher home country or the country from where he or shewas recruited.(4) Where, subsequent to the giving <strong>of</strong> a statement undersubsection (1) the employer desires to change the28
