MONTSERRATLABOUR CODE, <strong>2012</strong>No. 20 <strong>of</strong> <strong>2012</strong>(2) A person who contravenes this section commits an<strong>of</strong>fence and is liable on summary conviction to a fine <strong>of</strong>$5,000.00.12. Records and returns(1) An employer shall, at an address in <strong>Montserrat</strong>, keep insuch form as the <strong>Labour</strong> Commissioner may approve—(a) an accurate record in respect <strong>of</strong> each employeeshowing—(i) the employee’s name, address, occupation andhiring dates either by the employer or by apredecessor-employer;(ii) the immigration status <strong>of</strong> the employee and,where applicable, the date <strong>of</strong> expiry <strong>of</strong> theemployee’s work permit;(iii) the number <strong>of</strong> hours worked each day in eachpay period;(iv) the basic and other wages paid to the employeefor each pay period;(v) the leave taken by the employee by type,duration and date; and(vi) the protective gear issued to the employee; and(b) a register <strong>of</strong> all employees under the age <strong>of</strong> 18years,and, where applicable, shall keep at that address a copy<strong>of</strong> each written statement furnished to an employee.(2) Where an employee’s services have been terminated forany reason, an employer shall preserve the employee’srecords and the written statements referred to insubsection (1) for a period not less than 6 years after thedate <strong>of</strong> termination.(3) Upon request by the <strong>Labour</strong> Commissioner or <strong>Labour</strong>Officer, the employer shall make the employee’s recordavailable to the <strong>Labour</strong> Commissioner or a labour20
