the responsibility for paying any debts to which subsection (4) refers.(7) A surrender of a customary right of occupancy shall be–(a)(b)(c)made on a prescribed form;signed by the person or the authorised representatives of the group of personssurrendering the customary right of occupancy;accompanied by any evidence which may be prescribed or which is considered by thevillage council to be satisfactory that all persons–(i)(ii)dependent on a person who is surrendering that customary right of occupancyare aware of the surrender and have agreed to it;having derivative rights in that customary right of occupancy are aware of thesurrender;(d)(e)any other information which may be prescribed;send or delivered to the village council of the village where the land is situate.(8) <strong>The</strong> <strong>Village</strong> Council shall make entries prescribed in the register of village land recordingthe surrender of customary right of occupancy.(9) A derivative right granted out of a customary right of occupancy which is surrenderedunder this section, shall, as from the date of the surrender, be held on the village council onthe same terms and conditions which it was held on the person who has surrendered thecustomary right of occupancy.36. Regrant of surrendered customary right of occupancy(1) <strong>The</strong> regrant of a surrendered customary right of occupancy by a village council shall bein accordance with the provisions of this Part applicable to the grant of a customary right ofoccupancy.(2) Where the person who has surrendered a customary right of occupancy hasdependants, or if a woman, a spouse and if a man one or more spouses, the village councilshall, before publicising the fact that the land is available to be granted to any villager or otherperson to whom section 22 refers first offer the land to the following persons in the followingorder, that is to say–(a)where the person who has surrendered the customary right of occupancy is a man–(i)his wife;
