(3) <strong>The</strong> district council shall provide advice and guidance to village councils on the exerciseof their functions under this section.(4) A village council shall, when exercising functions under this section, have regard to anyadvice and guidance provided under subsection (3).(5) On receipt of the recommendations of the village council under this section, the villageassembly shall–(a)(b)(c)(d)approve;approve with amendments;refer back for further consideration; orreject,the recommendations and where the village assembly rejects the recommendations, the villagecouncil shall bring forward, as soon as may be, different recommendations.(6) <strong>The</strong> village council shall maintain a register of communal village land in accordance withany rules which may be prescribed.(7) Any land which has been set aside by a village council or village assembly forcommunity or public occupation and use or any land which is and has been, since theformation of the village, habitually used whether as a matter of practice or under customary lawor regarded by village residents as available for use as community or public land before theenactment of this <strong>Act</strong>, shall be deemed by this <strong>Act</strong> to be communal village land approved assuch by the village assembly and shall be registered by the village council under subsection(6).(8) Where there is a dispute between a person occupying land which is claimed ascommunal village land under subsection (7) and the village council, the Minister may, on beingsatisfied that–(a)(b)the dispute cannot be resolved through the organs of village government; orthe continuation of the dispute may lead to serious disruption in the village,exercise his powers or direct the Commissioner to exercise his powers under the provisions ofsubsections (6) to (10) of section 8 of this <strong>Act</strong> in relation to that dispute.14. <strong>Land</strong> which is or may be held for customary rights of occupancy(1) <strong>Land</strong> which is or may be held for a customary right of occupancy shall be–
