The constitution will be the supreme law of the land.It may be amended only by a designated process <strong>in</strong>volv<strong>in</strong>glegislative approval, popular referendum, or both.2. Cambodia's tragic recent history requires specialmeasures to assure protection of human rights. Therefore, theconstitution will conta<strong>in</strong> a declaration of fundamental rights,<strong>in</strong>clud<strong>in</strong>g the rights to life, personal liberty, security,freedom of movement, freedom of religion, assembly andassociation <strong>in</strong>clud<strong>in</strong>g political parties and trade unions, dueprocess and equality before the law, protection from arbitrarydeprivation of property or deprivation of private propertywithout just compensation, and freedom from racial, ethnic,religious or sexual discrim<strong>in</strong>ation. It will prohibit theretroactive application of crim<strong>in</strong>al law. The declaration willbe consistent with the provisions of the Universal Declarationof Human Rights and other relevant <strong>in</strong>ternational <strong>in</strong>struments.Aggrieved <strong>in</strong>dividuals will be entitled to have the courtsadjudicate and enforce these rights.3. The constitution will declare Cambodia's status as asovereign, <strong>in</strong>dependent and neutral State, and the nationalunity of the Cambodian people.4. The constitution will state that Cambodia will followa system of liberal democracy, on the basis of pluralism. Itwill provide for periodic and genu<strong>in</strong>e elections. It willprovide for the right to vote and to be elected by universaland equal suffrage. It will provide for vot<strong>in</strong>g by secretballot, with a requirement that electoral procedures provide afull and fair opportunity to organize and participate <strong>in</strong> theelectoral process.Vol. 1663, 1-28613
