We would like you to takepart, and let us know what you think.The draft policy document can be found online at www.westminster.gov.uk/streettrading.………………………………………………………………………………………………………<strong>Licensing</strong> Sub-Committee – Tuesday 20 th NovemberMetra, Basement, Victory House, 14 Leicester Square, London WC2 (St James’s Ward/ West End Stress Area) – The Metropolitan Police submitted an expedited review on 19November and the Sub-Committee gave initial consideration at a hearing on 20 Novemberas to whether any interim measures should be implemented pending the full review of thepremises licence. The Police had made the application following a fight which had brokenout by the entrance to the VIP area of Metra on 10 th November. The Sub-Committee wereshown CCTV footage of the incidents and were able to see from the footage that theincidents had been poorly managed by the premises, including the crime scene not beingclosed off with a male and a female being led back into this area and blood and other liquidsat the scene being cleaned up before it could be inspected by the Police. The DesignatedPremises Supervisor had been unaware of the seriousness of the incidents until he hadreviewed the CCTV and the Police had only by chance become aware of the incidents.The Police were requesting that given the seriousness of the incidents the hours forlicensable activities were reduced to a 1am terminal hour Mondays to Saturdays and11.30pm Sundays and that almost exactly the same conditions were attached to the licenceas had been attached by the Sub-Committee at a previous review hearing for the venue inAugust 2012. The decision in August 2012 was currently being appealed by the Licenseeand whilst under appeal, the decision of that hearing does not take effect. The Sub-Committee decided to impose the hours and conditions suggested by the Police, noting thatif the hours and conditions that had been imposed by the Sub-Committee in August had notbeen appealed, the incident would not have happened.<strong>Licensing</strong> Sub-Committee – Thursday 22 nd NovemberBubbles and Wine, 20 Moxon Street, W1 (Marylebone High Street / not in stress area)- The applicant wished to operate the premises as a retail shop/delicatessen/café providingon and off sales of alcohol on the ground and lower ground floor levels. He informedMembers that he specialised in the sale of quality wines, champagnes and spirits andprovided these to English and French restaurants. He now wished to sell these from hisown shop and provide some pre-booked wine and spirit tasting classes until 10.30pm everynight of the week which was within the <strong>Council</strong>’s core hours policy. The Sub-Committeetook into account concerns from local residents that sounds including conversation couldalready be heard from the premises prior to the shop opening and Members thereforedecided to limit the terminal hour for both the sale and consumption for alcohol on thePage 3


premises to 8pm. The applicant would be expected to take action to ensure that hecomplied with the condition that no noise would emanate from the premises. The sale ofalcohol for consumption off the premises would be permitted until 10.30pm.Nokia, Fourth Floor and Fifth Floor, 2 Kingdom Street, W2 (Hyde Park / not in stressarea) – The Sub-Committee granted the application. By the time of the hearing theapplicant had largely addressed the concerns of the parties who had originally submittedrepresentations, Environmental Health and 3 residents’ associations. The proposedcommencement hour for the sale of alcohol had been amended to midday on Sundays sothat the hours during the week were within the <strong>Council</strong>’s core hours policy. Alcohol couldonly be sold to employees of Nokia and the Licensee and their bona fide guests or to thoseinvited to a private function. The Sub-Committee noted that the application sought toauthorise licensable activities on the ground and fifth floors only. Other areas, such asoffices and meeting rooms, were not included. Very occasionally alcohol could be suppliedto employees and clients on other floors. This would technically constitute an off sale, sincethese areas were not included in the application. There was no intention to operate atypical 'off licence' or similar with alcohol being taken out of the building.Duke Of York Public House, 47 Rathbone Street, W1 (West End / not in stress area) –Review application submitted by the <strong>Licensing</strong> Authority on the grounds of the prevention ofpublic nuisance and public safety. The Sub-Committee noted that there had been threenoise complaints in relation to the premises since 2009 and that the <strong>Licensing</strong> Inspectorshad visited the premises 28 times with the obstruction of the pavement by patrons drinkingoutside being an issue on a number of occasions. However, it was clear at the hearing thatthe premises had now made active attempts to address the particular concerns regardingthe highway being obstructed with the employment of stewards and the use of barriers. TheLicence Holder had also agreed a way forward acceptable to the Responsible Authoritiesthat any patrons drinking outside would be encouraged to go to the east side of thepremises which would cause the least potential for obstruction. The area used on the southside would be limited allowing at least a metre clearance. The Responsible Authoritieswere not proposing to add prescriptive conditions to the licence.
