Reg. ______, effective ____________)SUBPART C: FINANCIAL ELIGIBILITY DETERMINATIONSection 120.60 Community Cases Other Than Long Term Care, Pregnant Women andCertain ChildrenThe following subsections apply to persons or family units who reside in the community orcommunity-based residential facilities or settings (such as a Community Living Facility, SpecialHome Placement, Home Individual Program or Community and Residential Alternatives (59 Ill.Adm. Code 120.10) all cases other than those receiving care in licensed intermediate carefacilities, licensed skilled nursing facilities, Department of Human Services (DHS) facilities, orDHS approved community based residential settings under 89 Ill. Adm. Code 140.643, orpregnant women and children under age 19 who do not qualify as mandatory categoricallyneedy.a) The eligibility period shall begin with:1) the first day of the month of application;2) the first day of any month, prior to the month of application, in which thepersonclient meets financial and non-financial eligibility requirements upto three months prior to the month of application, if the personclient sodesires; or3) the first day of a month, after the month of application, in which thepersonclient meets non-financial eligibility requirements.b) Eligibility Without Spenddown for MANG1) For MANG AABD MANG, if the person's countableclient's nonexemptincome available during the eligibility period is equal to or below theapplicable MANG AABD income standard (SectionSections 120.20 and120.30) and nonexempt resourcesassets are not in excess of the applicableresourceasset disregard (Section 120.382), the personclient is eligible formedical assistance from the first day of the eligibility period. TheDepartment will pay for covered services received during the entireeligibility period.2) For TANF MANG, if the person's countableclient's nonexempt incomeavailable during the eligibility period is equal to or below the applicable
