The law is that the Local Authority mustagree <strong>to</strong> your preference <str<strong>on</strong>g>for</str<strong>on</strong>g> a maintained(State) school, unless:The school is unsuitable <strong>to</strong> the child’s age,ability or aptitude, or his or her specialeducati<strong>on</strong>al needs – if you are looking <str<strong>on</strong>g>for</str<strong>on</strong>g> achange from mainstream school <strong>to</strong> a specialschool or special extra resources this will<strong>on</strong>ly be taken <str<strong>on</strong>g>for</str<strong>on</strong>g>ward if the school issuitable <strong>to</strong> your child’s ability <str<strong>on</strong>g>and</str<strong>on</strong>g> specialeducati<strong>on</strong>al needs.Or the attendance of your child at theschool would prejudice the provisi<strong>on</strong> ofefficient educati<strong>on</strong> <str<strong>on</strong>g>and</str<strong>on</strong>g> the efficient use ofresources. The governing body would have<strong>to</strong> dem<strong>on</strong>strate that they could not takereas<strong>on</strong>able steps <strong>to</strong> resolve these issues.In the majority of cases, it will be possible <strong>to</strong>meet the parental preference <str<strong>on</strong>g>for</str<strong>on</strong>g> a namedschool. However if you do not agree withthe school being suggested you will beinvited <strong>to</strong> meet with some<strong>on</strong>e from theSpecial Educati<strong>on</strong>al Needs Team <strong>to</strong> discussthe matter. The Parent Partnership Service isalso available <strong>to</strong> offer independent advice<str<strong>on</strong>g>and</str<strong>on</strong>g> support <strong>to</strong> <str<strong>on</strong>g>parents</str<strong>on</strong>g> of children withspecial educati<strong>on</strong>al needs.In cases wherethere is a disagreement about your child’sspecial educati<strong>on</strong>al provisi<strong>on</strong> you may beoffered <str<strong>on</strong>g>for</str<strong>on</strong>g>mal mediati<strong>on</strong> with anindependent mediati<strong>on</strong> service. If you aresent a final statement with which youdisagree, you then have the opportunity <strong>to</strong>appeal <strong>to</strong> the SEN <str<strong>on</strong>g>and</str<strong>on</strong>g> Disability Tribunal inL<strong>on</strong>d<strong>on</strong>.Mainstream schooling: the majority ofchildren will attend their local mainstreamschool serving their address in cases wherechildren attend a school that is not thedesignated area school <str<strong>on</strong>g>parents</str<strong>on</strong>g>/<str<strong>on</strong>g>carers</str<strong>on</strong>g> willnormally be expected <strong>to</strong> pay the full cost ofthe transport costs <strong>to</strong> the school.Specialist provisi<strong>on</strong>: if your preference is <str<strong>on</strong>g>for</str<strong>on</strong>g>a place in a resourced unit or special schoolthis in<str<strong>on</strong>g>for</str<strong>on</strong>g>mati<strong>on</strong> is passed <strong>to</strong> the SpecialEducati<strong>on</strong>al Needs Team. A move <strong>to</strong> aspecial school or <strong>to</strong> a special educati<strong>on</strong>resource can <strong>on</strong>ly be arranged if the schoolhas places available <str<strong>on</strong>g>and</str<strong>on</strong>g> is suitable <strong>to</strong> yourchild’s age, aptitude, ability <str<strong>on</strong>g>and</str<strong>on</strong>g> their specialeducati<strong>on</strong>al needs. Expressing a preference<str<strong>on</strong>g>for</str<strong>on</strong>g> a mainstream place in a school that hostsa resource will not necessarily secure theadmissi<strong>on</strong> of your child <strong>to</strong> either the schoolor the special resource.<strong>School</strong>s outside Reading Borough: you areable <strong>to</strong> express a preference <str<strong>on</strong>g>for</str<strong>on</strong>g> your child<strong>to</strong> be placed in a mainstream school, aspecial school, or <strong>to</strong> a special educati<strong>on</strong>resource within a mainstream school outsideReading. The allocati<strong>on</strong> of places in schoolsoutside Reading is arranged with theGoverning Body <str<strong>on</strong>g>and</str<strong>on</strong>g> the appropriate LocalAuthority. The Special Educati<strong>on</strong>al NeedsTeam must by law c<strong>on</strong>sult the admissi<strong>on</strong>authority <str<strong>on</strong>g>and</str<strong>on</strong>g> the governors of yourpreferred school. The admissi<strong>on</strong> authoritymay be the LA that maintains the school.Expressing a preference <str<strong>on</strong>g>for</str<strong>on</strong>g> a resource placein a mainstream in a school outside Readingwill not necessarily secure the admissi<strong>on</strong> ofyour child <strong>to</strong> either the school or the specialresource.If you live in Reading you will receive asec<strong>on</strong>dary school applicati<strong>on</strong> pack inSeptember 2012. You should complete theapplicati<strong>on</strong> <str<strong>on</strong>g>for</str<strong>on</strong>g>m enclosed <str<strong>on</strong>g>and</str<strong>on</strong>g> return it <strong>to</strong>the SEN team.
