Fee of delay penalty shall be paid in cash by the Contractor. Delay penalty period, without anynotification, shall begin after the delivery date stated in the proforma invoice of the contractor. Otherwise,it will be encashed from the letter of credit or Performance Bond or if any additional performance bond,without any further necessity for formal protest or judgment. In case this penalty cannot be encashedfrom such values, then it shall be collected from the Contractor. Provided that the Administration and theContractor come to an agreement, the amount of penalty may be encashed from any receivables of theContractor at Administration’s side, too.42.3. Taahhüdün, teslim süresi içerisinde kalmak koşuluyla, kısmi olarak yerine getirilmemesidurumunda iptal edilen bölümün değeri üzerinden; tamamının yerine getirilmemesi durumunda tamamıüzerinden % 20 iptal cezası uygulanır.Ayrıca cezalı teslim süresi içerisinde veya bitiminde projenin tümünün veya bir malzemenin iptal edilmesidurumunda ise iptal edilen malzeme bedelinin % 20 (yüzde yirmi)si oranında iptal cezası ve her bir güniçin malzeme bedelinin 0.001 (binde bir)’i oranında hesaplanacak toplam tutar kadar gecikme cezasıugulanacaktır.Within the delivery period if the liability is not performed partially, a penalty in the amount of 20 % of thevalue of the cancelled item/s shall be applicable; if the liability is not performed wholly a penalty in theamount of 20 % of the value of the whole project shall be applicable.Moreover; in case the cancellation of the whole project or any material is required during or at the end ofthe delivery period subjected to fining, the cancellation fee in the amount of 20 % of the value of thecancelled item/s and the delay fee in the rate corresponding to 0,001 (one thousandth) of the value ofthe item shall be imposed for each day of delay.43.
