Yükleniciye ihalelere katılma ile ilgili herhangi bir yasaklamacezası verilmez.In case one or some of the force majeure conditions stipulated in Article 40.1. occurs, theContracting Entity may extend the validity of the delivery time considering the effects of the forcemajeure on the committed work or in case it is understood that the Contract shall not be performed, itshall be terminated. In case the Purchase Order is terminated to this article, if any, the advance paymentshall be reimbursed to the account no. stated by the Contracting Entity within 30 (thirty) calendar dayswith the legal interest of the period between the payment date and reimbursement date of the advancepayment. The Contracting Entity shall release the Advance Letter of Guarantee (if advance payment wasmade) and if any, additional Performance Bond. Following this procedure, the performance bond and ifany additional performance bond shall be returned. Any prohibition penalty shall not be given to theContractor regarding the bidding.40.3.5. In case the purchase order is cancelled, theContractor exposed to any force majeure condition shall confirm this by the documents required for forcemajeure. In this case, if any, the advance payment shall be reimbursed to the account no. stated by theContracting Entity within 30 (thirty) calendar days with the legal interest of the period between thepayment date and reimbursement date of the advance payment. Söz konusu ilavesürenin toplamı teslim süresinin yarısını geçtiği taktirde, idare işin iptalini isteyebilir.In case the terms and conditions concerning the undelivered goods, the Contractor shall begranted an additional time upon the approval of the Contracting Entity. In case total additional timeexceeds the delivery time, the Contracting Entity may request the cancellation of the purchase order.40.3.6.2.İdari şartname şartlarının yüklenici tarafından yerine getirilemeyeceğinin anlaşılması veya bumaddenin 40.3.5. nolu alt bendindeki durumda alımın iptaline karar verilmiş ise teslim alınamayanmalzeme ile ilgili alım iptal edilir.In case the terms and conditions of the admin spec. shall not be executed and the purchaseorder is to be cancelled in accordance with sub paragraph 40.3.5, purchase concerning the undeliveredgoods shall be cancelled.40.3.7.
