40. SÜRE UZATIMI VERİLEBİLECEK HALLER VE ŞARTLARI:TERMS AND CONDITIONS FOR TIME EXTENSION:40.1. Mücbir Sebep Halleri:Conditions as Force Majeure:İDARE, Yükleniciden kaynaklanan bir kusurdan ileri gelmemiş olması, taahhüdün kısmen veyatamamen yerine getirilmesine engel nitelikte olması, yüklenicinin bu engeli ortadan kaldırmaya gücününyetmemiş bulunması halinde bu durumun 40.2. maddesinde belirtilen yetkili merciler tarafındanbelgelendirilmesi kaydıyla aşağıda belirtilen halleri mücbir sebep olarak kabul eder.The Contracting Entity shall accept the below mentioned conditions as force majeure provided thatthey have not arisen due to the Contractor’ s failure, prevent the fulfillment of the commitment and theContractor has no capability to stop and are documented by the competent authorities specified in Article40.2.40.1.1. Olağanüstü tabiat olayları, zelzele, yangın, su baskını gibi doğal afetlerin meydana gelmesi,Occurrence of natural disasters such as extraordinary natural events, earthquake, fire and flood40.1.2. İmalatın yapıldığı işyeri, fabrika ve mıntıkada taahhüdü önemli ölçüde etkileyen kanuni grev,ayaklanma ve taşımada ulaşımın engellenmesi,Legal strike, rebellion preventing the fulfillment of the commitment in the work place, factory andregion and blockages in the transportation.40.1.3. Genel salgın hastalık ve kıtlık olması veya bu nedenler ile giriş ve çıkışın işçi veya malzemeulaşımının engellenmesi,Epidemics and starvation or the prevention of entry, exit and the transportation of workers orgoods thereto40.1.4. Yapılan Sözleşmelerden sonra Harp ve abluka hali olması, kısmî veya genel seferberlik ilânı,War and blockade, announcement of partial or general mobilization after the signed contracts,40.1.5. FOB/FCA teslim şekillerinde, idareden kaynaklanan sebeplerle idarenin anlaşmalı olduğu taşımafirmalarının malzemeyi taşıyamaması, idarenin taşımayı yapacak taşıyıcı firma gösterememesi,malzemenin nakliyat sigortasının yaptırılamaması veya sigorta sözleşmesi olmaması,Due to the reasons arising from Contracting Entity’s failure, the failure of the Contracting Entity’sshipping firm in transportation of the goods or the Contracting Entity’s failure to appoint a shipping firmfor FOB/FCA deliveries, to ensure a transportation insurance for the goods or to have an insuranceagreement.40.1.6. Taşıma esnasında taşımayı engelleyen kazalarının vuku bulması,Occurrence of accidents preventing transportation.40.1.7. İdare ve/veya ülkesindeki yetkili kurum ve kuruluşların işlemlerinden kaynaklanan ve sorumluluğuyükleniciye ait olmayan yer tesliminin yapılamaması, projelerin onaylanmaması, ödenek yetersizliği,teslim limanı ve taşıma aracında değişiklik olması gibi durumlar,Failure to make delivery to the point which is not under the Contractor’s responsibility, to ratify thecontracts, inadequate appropriations, changes in the delivery port and delivery vehicle due to theprocedures of the authorized agencies and institutions,40.1.8. Türk resmi makam ve mercileri veya yüklenicinin memleketindeki resmi makamların karar veişlemleri, malzeme ihraç lisansına tabi ise ihraç lisansının alınamaması veya alınmış ise iptal edilmesisonucu ithalatın imkansız hale gelmesi veya gecikmesi.The blocking or delaying of the import due to the decisions and procedures of the Turkish officialauthorities or those of the Contractor’s country or the failure to get export license or cancellation of it.40.1.9.
