14.2. Bu durumda, iptal nedeni belirtilmek suretiyle alımın iptal edildiği isteklilere hemen ilân edilerekduyurulur. Alımın iptal edilmesi halinde, verilmiş olan bütün teklifler reddedilmiş sayılır ve bu teklifleraçılmaksızın isteklilere iade edilir. Alımın iptal edilmesi nedeniyle, isteklilerce idareden herhangi bir haktalebinde bulunulamaz.In this case, the cancellation of procurement is notified to all bidders promptly with the reasons forthe cancellation. All bids that already been submitted are considered rejected and these bids arereturned to the bidders unopened. The bidders cannot claim any rights from the Contracting Entitybecause of the cancellation of procurement.14.3. Alımın iptal edilmesi durumunda, iptal nedenleri gözden geçirilerek yeniden alıma çıkılabilir.In case of cancellation of the procurement, a new procurement may be performed by lookingthrough the cancellation reasons.15. ORTAK GİRİŞİMLER / JOINT VENTURES :15.1. Birden fazla gerçek veya tüzel kişi tarafından iş ortaklığı oluşturmak suretiyle teklif verilebilir. İşortaklığı üyeleri hak ve sorumlulukları ile işin tümünü birlikte yapmak üzere, ortaklık yaparlar. İş ortaklığıanlaşmalarında pilot ortak belirlenir. Alımın iş ortaklığı üzerinde kalması halinde; sipariş verilmedenönce noter tasdikli ortaklık sözleşmesi verilecektir. Gerek ortaklık anlaşmasında gerekse ortaklıksözleşmesinde, İş Ortaklığını oluşturan gerçek veya tüzel kişilerin taahhüdün yerine getirilmesindemüştereken ve müteselsilen sorumlu oldukları belirtilir.More than one real person or legal entity shall be able to submit bids for the procurement throughestablishing a joint venture. Members of respective joint venture shall form a partnership to undertakethe rights and responsibilities of the work together. A pilot partner is determined in joint ventureagreements. In case a joint venture is awarded a contract, a notarized copy of partnership agreementshall be given before the purchase order. Joint venture agreement shall specify that real persons or legalentities forming a joint venture shall jointly and severally be responsible for the fulfillment of thecommitment undertaken. The joint venture agreement shall be submitted together with the bid.15.2. Ortak Girişimin; mesleki ve teknik yeterlilik almış olması, ortak girişim ortaklarının her birinin ayrıayrı yeterlilik aldığını göstermez ve yeterlilik değerlendirilmesi sonucu yeterli görülen İş ortaklığınınihaleden önce bozulması halinde, ortaklardan birinin tek istekli olarak devam etme talebi geçersiz sayılır.Joint venture’s technical and professional adequacy does not mean that each partner of the jointventure is adequate, and in case the joint venture, accepted as adequate breaks down before the tender,the demand of any particular partner to attend the tender as the only tenderer is invalidated.15.3. ALT YÜKLENİCİLER/ SUB CONTRACTOR :Alım konusu işin tamamı veya bir kısmı alt yüklenicilere yaptırılamaz.Subcontractors shall not be employed for any part or the whole job.III. İstekli/İstekliler ile ayrıcasözleşme imzalanmayacaktır.Based on the assesments made without negotiations on the price, following various assessmentsare made considering criteria specified in the administrative and technical specification (if any) wherebythe quality and the quantity of the work has been clearly defined, a purchase order shall be granted tothe Bidder/Bidders whose bids are found to be convenient over a total price determined.
