On 14 May 2012 Barnsley Metropolitan Borough Council (the Council)wrote to the Office of the <str<strong>on</strong>g>School</str<strong>on</strong>g>s Adjudicator referring to its own proposalmade under secti<strong>on</strong>s 15 <str<strong>on</strong>g>and</str<strong>on</strong>g> 11 of the Educati<strong>on</strong> <str<strong>on</strong>g>and</str<strong>on</strong>g> Inspecti<strong>on</strong>s Act 2006(the Act) for c<strong>on</strong>siderati<strong>on</strong> under Schedule 2 to the Act. The proposal is toclose two community schools, <str<strong>on</strong>g>Wilthorpe</str<strong>on</strong>g> <str<strong>on</strong>g>Infant</str<strong>on</strong>g> <str<strong>on</strong>g>School</str<strong>on</strong>g> <str<strong>on</strong>g>and</str<strong>on</strong>g> <str<strong>on</strong>g>Wilthorpe</str<strong>on</strong>g> <str<strong>on</strong>g>Junior</str<strong>on</strong>g><str<strong>on</strong>g>School</str<strong>on</strong>g> (the <str<strong>on</strong>g>School</str<strong>on</strong>g>s) <strong>on</strong> 31 December 2012 <str<strong>on</strong>g>and</str<strong>on</strong>g> to establish a newcommunity primary school <strong>on</strong> the two existing sites <strong>on</strong> 1 January 2013.Jurisdicti<strong>on</strong>2. On 16 March 2012, the Council as the proposer, having carried out theappropriate c<strong>on</strong>sultati<strong>on</strong>, formally published the proposal. The public noticewas in the form required by secti<strong>on</strong>s 15 <str<strong>on</strong>g>and</str<strong>on</strong>g> 11 of the Act, <str<strong>on</strong>g>and</str<strong>on</strong>g> included theproposals for the closure of the existing schools <strong>on</strong> 31 December 2012 <str<strong>on</strong>g>and</str<strong>on</strong>g>for the establishment of the proposed new school from 1 January 2013.Following the six week c<strong>on</strong>sultati<strong>on</strong> period the Council forwarded theinformati<strong>on</strong> specified in the Act <str<strong>on</strong>g>and</str<strong>on</strong>g> regulati<strong>on</strong>s.3. I am satisfied that this proposal has been properly referred to me inaccordance with Schedule 2 of the Act <str<strong>on</strong>g>and</str<strong>on</strong>g> Regulati<strong>on</strong>s made thereunder <str<strong>on</strong>g>and</str<strong>on</strong>g>that; therefore, I have the jurisdicti<strong>on</strong> to determine these matters.Procedures4. I have c<strong>on</strong>sidered this proposal as required by the Act <str<strong>on</strong>g>and</str<strong>on</strong>g> have had fullregard to the guidance provided by the Secretary of State <str<strong>on</strong>g>and</str<strong>on</strong>g> to all relevantlegislati<strong>on</strong> <str<strong>on</strong>g>and</str<strong>on</strong>g> guidance.


5. I have c<strong>on</strong>sidered all the papers put before me including the following:• prescribed informati<strong>on</strong> from the Council as set out in the relevant<str<strong>on</strong>g>School</str<strong>on</strong>g> Organisati<strong>on</strong> Regulati<strong>on</strong>s;• minutes of the Cabinet meeting <strong>on</strong> 12 October 2011 <str<strong>on</strong>g>and</str<strong>on</strong>g> 14 March2012;• minutes of the Council meeting <strong>on</strong> 3 November 2011 ;• the c<strong>on</strong>sultati<strong>on</strong> document <strong>on</strong> the proposal <str<strong>on</strong>g>and</str<strong>on</strong>g> minutes of publicmeetings with staff, parents <str<strong>on</strong>g>and</str<strong>on</strong>g> governors;• corresp<strong>on</strong>dence from the <str<strong>on</strong>g>School</str<strong>on</strong>g>s;• a copy of the statutory notice as published in the local press;• proposed admissi<strong>on</strong> arrangements from 1 January 2013;• trend data for the Council for Key Stages I <str<strong>on</strong>g>and</str<strong>on</strong>g> 2; <str<strong>on</strong>g>and</str<strong>on</strong>g>• the most recent Ofsted reports for both schools.6. I have also c<strong>on</strong>sidered informati<strong>on</strong> received during a visit to the <str<strong>on</strong>g>School</str<strong>on</strong>g>s<strong>on</strong> 21 June 2012 which I made in order to view the split sites <str<strong>on</strong>g>and</str<strong>on</strong>g> to discussthe implicati<strong>on</strong>s of managing these as a single school, with the headteachers<str<strong>on</strong>g>and</str<strong>on</strong>g> governors. It also enabled me to finalise a number of issues <str<strong>on</strong>g>and</str<strong>on</strong>g> toexpedite my decisi<strong>on</strong>.The proposal7. The Council has proposed that these community schools, <str<strong>on</strong>g>Wilthorpe</str<strong>on</strong>g><str<strong>on</strong>g>Infant</str<strong>on</strong>g> <str<strong>on</strong>g>School</str<strong>on</strong>g> for pupils aged 4-7 years <str<strong>on</strong>g>and</str<strong>on</strong>g> <str<strong>on</strong>g>Wilthorpe</str<strong>on</strong>g> <str<strong>on</strong>g>Junior</str<strong>on</strong>g> <str<strong>on</strong>g>School</str<strong>on</strong>g> for pupilsaged 7-11 years should close <strong>on</strong> 31 December 2012, <str<strong>on</strong>g>and</str<strong>on</strong>g> be replaced by theestablishment of a new community primary school in the premises of theclosing schools. The new school will provide 26 full time equivalent nurseryplaces <str<strong>on</strong>g>and</str<strong>on</strong>g> 420 primary phase places for children aged 3 to 11 years of age.Background8. The Council has been carrying out a policy of reorganisati<strong>on</strong>s to replaceseparate infant <str<strong>on</strong>g>and</str<strong>on</strong>g> junior schools for over 25 years with the dual aims ofachieving the educati<strong>on</strong>al benefits of single primary phase schools <str<strong>on</strong>g>and</str<strong>on</strong>g> ofreducing surplus capacity where it existed, at the time. These two schools arethe last remaining separate infant <str<strong>on</strong>g>and</str<strong>on</strong>g> junior schools in the borough <str<strong>on</strong>g>and</str<strong>on</strong>g> thecreati<strong>on</strong> of a primary school in <str<strong>on</strong>g>Wilthorpe</str<strong>on</strong>g> would successfully complete thepolicy initiative. The timing of this particular proposal is linked to theimpending retirement of the headteacher of the junior school in the summer of2012.


9. At its meeting <strong>on</strong> 2 October 2011, the Cabinet made a formalrecommendati<strong>on</strong> to the Council for the commencement of the statutoryprocesses related to this school organisati<strong>on</strong> proposal <str<strong>on</strong>g>and</str<strong>on</strong>g> the Council agreedto the recommendati<strong>on</strong> <strong>on</strong> 3 November 2011. A c<strong>on</strong>sultati<strong>on</strong> <strong>on</strong> theseproposals between 6 December 2011 <str<strong>on</strong>g>and</str<strong>on</strong>g> 20 January 2012 includedmeetings for stakeholders including parents, governors <str<strong>on</strong>g>and</str<strong>on</strong>g> staff. A numberof local individuals <str<strong>on</strong>g>and</str<strong>on</strong>g> groups were also c<strong>on</strong>sulted.10. At its meeting <strong>on</strong> 14 March 2012, the Cabinet c<strong>on</strong>sidered a reportoutlining the views expressed during the statutory c<strong>on</strong>sultati<strong>on</strong> period <str<strong>on</strong>g>and</str<strong>on</strong>g>gave approval for a public notice to be published <str<strong>on</strong>g>and</str<strong>on</strong>g> for the commencementof the formal c<strong>on</strong>sultati<strong>on</strong>.11. On 16 March 2012 the Council published notices in accordance with theprovisi<strong>on</strong>s of the Act, for the closure of the <str<strong>on</strong>g>School</str<strong>on</strong>g>s, <strong>on</strong> 31 December 2012<str<strong>on</strong>g>and</str<strong>on</strong>g> the establishment of a new community primary school <strong>on</strong> 1 January 2013to serve children between the ages of 3 <str<strong>on</strong>g>and</str<strong>on</strong>g> 11 in the premises of the closingschools. The Council has reported that no objecti<strong>on</strong>s had been received bythe end of the formal Public Notice period.Views <strong>on</strong> the proposals12. The Council’s view is that children’s learning at these two very goodschools would be further enhanced in a primary phase school by strategicplanning across both key stages to c<strong>on</strong>solidate policies <str<strong>on</strong>g>and</str<strong>on</strong>g> provisi<strong>on</strong> for eachsubject area. There would be c<strong>on</strong>tinuity of learning over the transiti<strong>on</strong> periodfrom Key stage 1 to 2 which would avoid the dip in pupils’ performance thathas been well documented at nati<strong>on</strong>al level, as young children transferbetween separate infant <str<strong>on</strong>g>and</str<strong>on</strong>g> junior schools. It would be possible to maximisethe use of resources provided by the increased flexibility of a larger staff teamengaged in cross key stage teaching. There would be of benefits to thechildren <str<strong>on</strong>g>and</str<strong>on</strong>g> to staff from the l<strong>on</strong>ger term partnership with pupils <str<strong>on</strong>g>and</str<strong>on</strong>g> parents.13. Parents were advised that the proposal had been brought forward by thegoverning bodies of both schools. They enquired about the number ofschools that operated <strong>on</strong> split sites <str<strong>on</strong>g>and</str<strong>on</strong>g> were advised that there was anotherprimary school in the borough <strong>on</strong> a split site. The headteacher would managepupils’ movement between sites; although it was envisaged that there wouldbe few occasi<strong>on</strong>s when pupils transferred between sites during the schoolday.14. Parents wanted to know whether potential sites for a single school hadbeen c<strong>on</strong>sidered <str<strong>on</strong>g>and</str<strong>on</strong>g> were advised that an analysis of sites had c<strong>on</strong>firmedthat the site of the current junior school, which is extensive, would be ideal fora new school building, if <str<strong>on</strong>g>and</str<strong>on</strong>g> when funding became available. The twoschools serve a densely populated area of the Borough <str<strong>on</strong>g>and</str<strong>on</strong>g> there are noalternative sites <strong>on</strong> which a new school could be built. In additi<strong>on</strong> there is nofunding available in the <str<strong>on</strong>g>School</str<strong>on</strong>g>’s Capital Programme to fund either a largeextensi<strong>on</strong> or a new school.


15. Parents noted that both schools are currently performing well <str<strong>on</strong>g>and</str<strong>on</strong>g>enquired whether this was because they operate as separate schools <str<strong>on</strong>g>and</str<strong>on</strong>g> areable to c<strong>on</strong>centrate <strong>on</strong> <strong>on</strong>e key stage of educati<strong>on</strong>. The Councilacknowledged the leadership of the two headteachers <str<strong>on</strong>g>and</str<strong>on</strong>g> expressed theview that the proposal would ensure that the primary school would become‘securely outst<str<strong>on</strong>g>and</str<strong>on</strong>g>ing’. Minutes of the parents’ meeting indicate that it was feltthat it would be difficult for <strong>on</strong>e headteacher to manage both sites. TheCouncil advised parents that the senior leadership team would provideadequate management of both sites.16. Staff enquired about a new staffing structure <str<strong>on</strong>g>and</str<strong>on</strong>g> were advised thatalthough there might be future changes, initially all staff would transfer <strong>on</strong> 1January 2013 <str<strong>on</strong>g>and</str<strong>on</strong>g> given the increasing l projecti<strong>on</strong>s for the number of pupils itwas likely that the new school would require more rather than fewer staff. Itwas c<strong>on</strong>firmed that any changes would be made in c<strong>on</strong>sultati<strong>on</strong> with staff.C<strong>on</strong>cern was expressed about the increased workload for a singleheadteacher running a school across two sites. The Council advised staff thatshould the proposal not be agreed then a new headteacher would beappointed to the junior school <str<strong>on</strong>g>and</str<strong>on</strong>g> there would be no guarantee that thecurrent working relati<strong>on</strong>ship between the schools would c<strong>on</strong>tinue. Thiscomment referred back to the time before the appointment of the currentinfant school headteacher when there was far less partnership workingbetween the <str<strong>on</strong>g>School</str<strong>on</strong>g>s.17. Staff questi<strong>on</strong>ed the adequacy of funding required to operate over twosites <str<strong>on</strong>g>and</str<strong>on</strong>g> were advised by the Council that the formula for school funding hadan in-built mechanism to cover the costs of running a split site school whichwould add two thous<str<strong>on</strong>g>and</str<strong>on</strong>g> pounds to the budget. However, it has sincebecome apparent that this split site factor is <strong>on</strong>ly applied to schools withseparate sites that are more than a mile apart <str<strong>on</strong>g>and</str<strong>on</strong>g> that the new school wouldnot qualify for this funding.18. Governors also raised c<strong>on</strong>cerns about the financial implicati<strong>on</strong>s of theproposal <str<strong>on</strong>g>and</str<strong>on</strong>g> asked for reassurance that the budget for the new school wouldbe equal to the total of the existing school budgets. The headteacher of theinfants’ school reported back to governors <strong>on</strong> a joint exercise with the Councilto project the new school budget <str<strong>on</strong>g>and</str<strong>on</strong>g> this had indicated a significantreducti<strong>on</strong>. It was felt that the split site element would be insufficient to coverthe costs involved in operating <strong>on</strong> two sites. Clarificati<strong>on</strong> from the Councilindicates that the projected reducti<strong>on</strong> merely reflects the change to a singleheadteacher. In additi<strong>on</strong> to this, there would be a readjustment to the budgetto allow for factors related to support services, for example, finance <str<strong>on</strong>g>and</str<strong>on</strong>g>payroll support, which in schools that are amalgamated, would be ‘recycled’ toall schools including <str<strong>on</strong>g>Wilthorpe</str<strong>on</strong>g> through the age weighted pupil unit value infuture years.19. Council officers acknowledged that governors <str<strong>on</strong>g>and</str<strong>on</strong>g> headteachers fromboth schools c<strong>on</strong>tinued to express c<strong>on</strong>cerns about the lack of additi<strong>on</strong>alfunding which they feel is needed to provide senior management presence <strong>on</strong>


oth sites. The Council advised governors that with increasing primaryschool pupil projecti<strong>on</strong>s it was likely that there would be additi<strong>on</strong>al funding infuture years. It was noted during my visit that the infant school has alreadyagreed to admit a ‘<strong>on</strong>e off’ bulge year into Year R in September of this year toassist the Council to provide sufficient places <str<strong>on</strong>g>and</str<strong>on</strong>g> that there would beadditi<strong>on</strong>al funding from the budget formula, which might offset the projectedreducti<strong>on</strong> to the revenue budget. The Council explained to staff that a splitsite primary school would automatically become a priority for future capitalfunding to create a single site school although it was stressed that this wouldbe unlikely for some c<strong>on</strong>siderable time.20. The initial proposal had been to open the new school <strong>on</strong> 1 September2012 but during informal c<strong>on</strong>sultati<strong>on</strong>s, the governing bodies of both schoolsraised c<strong>on</strong>cerns about the proposed timetable <str<strong>on</strong>g>and</str<strong>on</strong>g> they suggested analternative opening date of 1 January 2013. The Council resp<strong>on</strong>ded to theirc<strong>on</strong>cern by changing the implementati<strong>on</strong> date to 1 January 2013 <str<strong>on</strong>g>and</str<strong>on</strong>g>governors were advised that temporary arrangements would have to be madeto cover the autumn term headship of the junior school. However, the juniorschool’s headteacher has since agreed to postp<strong>on</strong>e his retirement untilDecember 2012 to provide c<strong>on</strong>tinuity.21. Governors fully support this proposal as in their view it will providec<strong>on</strong>tinuity of teaching <str<strong>on</strong>g>and</str<strong>on</strong>g> learning which will c<strong>on</strong>solidate the high quality ofeducati<strong>on</strong> provisi<strong>on</strong> across the whole primary range. They note that thedevelopment into an all-through school will remove parental anxiety aboutgaining admissi<strong>on</strong> to the juniors. Governors are also positive about theadditi<strong>on</strong>al opportunities to have middle leaders within a new exp<str<strong>on</strong>g>and</str<strong>on</strong>g>ed staffingstructure <str<strong>on</strong>g>and</str<strong>on</strong>g> together with the headteachers they expect this to aid futurerecruitment. Following the informal c<strong>on</strong>sultati<strong>on</strong> meeting the governing bodiesissued a joint statement in support of the proposal <str<strong>on</strong>g>and</str<strong>on</strong>g> the head teachers inboth schools have given their full backing to the proposed re-organisati<strong>on</strong>.C<strong>on</strong>siderati<strong>on</strong> of the Factors22. I have c<strong>on</strong>sidered the proposal <str<strong>on</strong>g>and</str<strong>on</strong>g> have taken careful account of theguidance provided by the Secretary of State.St<str<strong>on</strong>g>and</str<strong>on</strong>g>ards23. Trend data from the Council indicate that there have been variabletrends of improvement in other schools in the borough that have beenamalgamated since 2005. However, the Council has not linked this proposalto the need to address poor performance or low st<str<strong>on</strong>g>and</str<strong>on</strong>g>ards of achievement.Indeed the most recent inspecti<strong>on</strong> reports which provide an assessment ofprovisi<strong>on</strong> <str<strong>on</strong>g>and</str<strong>on</strong>g> st<str<strong>on</strong>g>and</str<strong>on</strong>g>ards at the <str<strong>on</strong>g>School</str<strong>on</strong>g>s indicate that the infant school providesa good <str<strong>on</strong>g>and</str<strong>on</strong>g> improving quality of educati<strong>on</strong> <str<strong>on</strong>g>and</str<strong>on</strong>g> that the junior school c<strong>on</strong>tinuesto provide an outst<str<strong>on</strong>g>and</str<strong>on</strong>g>ing quality of educati<strong>on</strong>.24. The Council believes that having an all-through primary school willenable the new school to develop a single curriculum model to bring


coherence <str<strong>on</strong>g>and</str<strong>on</strong>g> c<strong>on</strong>tinuity to the teaching <str<strong>on</strong>g>and</str<strong>on</strong>g> learning process. It will alsoimprove assessment <str<strong>on</strong>g>and</str<strong>on</strong>g> tracking of pupils’ progress as a single system isintroduced across all age groups; <str<strong>on</strong>g>and</str<strong>on</strong>g> the dip in performance which can occuras children transfer between separate schools will be preventable. Parentswill be able to benefit from knowing the staff who teach both key stages <str<strong>on</strong>g>and</str<strong>on</strong>g>by being familiar with whole school procedures <str<strong>on</strong>g>and</str<strong>on</strong>g> policies. Teaching staffwill be able to plan together to secure pupils’ progress from Recepti<strong>on</strong> to Year6.25. The new school would c<strong>on</strong>tinue to operate <strong>on</strong> two sites <str<strong>on</strong>g>and</str<strong>on</strong>g> thereforemake additi<strong>on</strong>al dem<str<strong>on</strong>g>and</str<strong>on</strong>g>s <strong>on</strong> the time of the headteacher. The intenti<strong>on</strong> is toretain two separate departments, each with its own senior managers, so therewould be no requirement for large scale staff movement between the two sitesduring the school day. Staff meetings, curriculum planning <str<strong>on</strong>g>and</str<strong>on</strong>g> professi<strong>on</strong>aldevelopment could be scheduled <strong>on</strong> either site after the school day hasfinished.26. Whilst there are many examples nati<strong>on</strong>ally of successful infant <str<strong>on</strong>g>and</str<strong>on</strong>g> juniorschools I accept that the proposed reorganisati<strong>on</strong> of provisi<strong>on</strong> has thepotential to c<strong>on</strong>tribute to the raising of st<str<strong>on</strong>g>and</str<strong>on</strong>g>ards, particularly through theopportunities for more sustained parental involvement <str<strong>on</strong>g>and</str<strong>on</strong>g> the sharing ofexpertise am<strong>on</strong>g teachers <str<strong>on</strong>g>and</str<strong>on</strong>g> other staff across the age-range to be servedby the proposed schools. I am therefore persuaded that a new primary schoolwould be well placed to secure the further improvement in st<str<strong>on</strong>g>and</str<strong>on</strong>g>ards that theCouncil wishes to achieve.Need for Places27. <str<strong>on</strong>g>Wilthorpe</str<strong>on</strong>g> <str<strong>on</strong>g>Infant</str<strong>on</strong>g> <str<strong>on</strong>g>School</str<strong>on</strong>g> <str<strong>on</strong>g>and</str<strong>on</strong>g> Children’s Centre has a net capacity of 176,a published admissi<strong>on</strong> number (PAN) of 60 <str<strong>on</strong>g>and</str<strong>on</strong>g> 173 children <strong>on</strong> roll <strong>on</strong> 1January 2012. The Children’s Centre is located within the premises of theinfant school is managed by the governing body. It provides childcare forchildren from birth to 5 years of age. The infant school also has nurseryprovisi<strong>on</strong> for 26 full time equivalent places <str<strong>on</strong>g>and</str<strong>on</strong>g> both these early years settingswill remain unchanged by this proposal.28. <str<strong>on</strong>g>Wilthorpe</str<strong>on</strong>g> <str<strong>on</strong>g>Junior</str<strong>on</strong>g> <str<strong>on</strong>g>School</str<strong>on</strong>g> has a net capacity of 240, a PAN of 60 <str<strong>on</strong>g>and</str<strong>on</strong>g>there were 182 children <strong>on</strong> roll <strong>on</strong> 1 January 2012. The proposal is for a new420 place community primary school for boys <str<strong>on</strong>g>and</str<strong>on</strong>g> girls aged between 3 <str<strong>on</strong>g>and</str<strong>on</strong>g>11 years of age, serving the community of <str<strong>on</strong>g>Wilthorpe</str<strong>on</strong>g> with a PAN of 60 from 1January 2013. If the proposal goes ahead, the new school will open in theaccommodati<strong>on</strong> being used currently by the <str<strong>on</strong>g>School</str<strong>on</strong>g>s.29. As in many areas of the country, the Council has seen recent growth inthe dem<str<strong>on</strong>g>and</str<strong>on</strong>g> for primary places. The projected intake for 2012 is 376, rising insubsequent years to 385 <str<strong>on</strong>g>and</str<strong>on</strong>g> 396. The Council anticipates that this trend willc<strong>on</strong>tinue <str<strong>on</strong>g>and</str<strong>on</strong>g> I am persuaded that the number <str<strong>on</strong>g>and</str<strong>on</strong>g> type of places are required.Community <str<strong>on</strong>g>and</str<strong>on</strong>g> Travel Implicati<strong>on</strong>s


30. The new primary school would c<strong>on</strong>tinue to serve the same community<str<strong>on</strong>g>and</str<strong>on</strong>g> would c<strong>on</strong>tribute to community cohesi<strong>on</strong> by c<strong>on</strong>solidating existing links<str<strong>on</strong>g>and</str<strong>on</strong>g> providing a single point of c<strong>on</strong>tact for parents. It would provide capacityto develop a single strategy for the extended school agenda by integratingchildren’s services.31. As the pupils would c<strong>on</strong>tinue to travel to the same two sites there wouldbe no change to the current travel arrangements for those children attendingthe new school. Should the children need to transfer between the two sitesfor any less<strong>on</strong>s or activities the <str<strong>on</strong>g>School</str<strong>on</strong>g> will need to develop procedures tosecure the safety of pupils <str<strong>on</strong>g>and</str<strong>on</strong>g> staff.Finance32. The Council owns the freehold for both <str<strong>on</strong>g>School</str<strong>on</strong>g> sites <str<strong>on</strong>g>and</str<strong>on</strong>g> proposes thatthe new school will operate in the premises of the closing schools. TheCouncil has been clear from the outset of the c<strong>on</strong>sultati<strong>on</strong> that it is not in apositi<strong>on</strong> to provide additi<strong>on</strong>al capital resources to fund building adaptati<strong>on</strong>s.However, it has c<strong>on</strong>firmed that schools <strong>on</strong> split sites would have priority in afuture capital programme to create a single site school, should fundingbecome available, but this seems unlikely to be the case for somec<strong>on</strong>siderable time.33. The Council is experiencing sustained pressure to provide sufficientprimary places. Given the significant space available <strong>on</strong> the junior site <str<strong>on</strong>g>and</str<strong>on</strong>g>the willingness of the governors to exp<str<strong>on</strong>g>and</str<strong>on</strong>g> provisi<strong>on</strong>; there will be furtherpotential through internal reorganisati<strong>on</strong> <str<strong>on</strong>g>and</str<strong>on</strong>g> use of the current sites toprovide much needed primary capacity for the area. This is turn would providemore income for the school in the future.34. The intenti<strong>on</strong> is that all buildings <str<strong>on</strong>g>and</str<strong>on</strong>g> resources of the separate schoolswill transfer to the new school <str<strong>on</strong>g>and</str<strong>on</strong>g> that the combined net positi<strong>on</strong> of therevenue budgets of the <str<strong>on</strong>g>School</str<strong>on</strong>g>s (surplus or deficit), at the point of closure(following closedown of their accounts at the end of the financial year), wouldaccrue to the new school at the beginning of the following financial year. Theproposed organisati<strong>on</strong> of provisi<strong>on</strong> will enable the headteacher <str<strong>on</strong>g>and</str<strong>on</strong>g> thegoverning body of the new school to manage resources more flexibly <str<strong>on</strong>g>and</str<strong>on</strong>g>therefore more in the most cost-effective manner.35. Having visited the schools <str<strong>on</strong>g>and</str<strong>on</strong>g> discussed matters with governors, theheadteachers <str<strong>on</strong>g>and</str<strong>on</strong>g> the Council, I agree that the buildings are adequate for thepurposes of the new schools <str<strong>on</strong>g>and</str<strong>on</strong>g> that the proposals do not depend <strong>on</strong> capitalexpenditure by the <str<strong>on</strong>g>School</str<strong>on</strong>g>. However, the Council has subsequently c<strong>on</strong>firmedthat it will provide £25,000 of capital funding to help with the reorganisati<strong>on</strong> ofthe two schools across the split sites <str<strong>on</strong>g>and</str<strong>on</strong>g> it will be for the new schoolheadteacher <str<strong>on</strong>g>and</str<strong>on</strong>g> the governing body to decide how this might best be utilised.36. I am satisfied that appropriate resources will be available to secure asuccessful amalgamati<strong>on</strong> of the two schools <str<strong>on</strong>g>and</str<strong>on</strong>g> the provisi<strong>on</strong> of a newprimary school.


C<strong>on</strong>clusi<strong>on</strong>37. In line with its policy to raise primary phase st<str<strong>on</strong>g>and</str<strong>on</strong>g>ards the Council hassuccessfully implemented a number of similar re-organisati<strong>on</strong>s. Additi<strong>on</strong>aladvisory support has been organised so that there is added capacity to tackleall aspects of an amalgamati<strong>on</strong>. I am therefore c<strong>on</strong>fident that both the<str<strong>on</strong>g>School</str<strong>on</strong>g>s <str<strong>on</strong>g>and</str<strong>on</strong>g> the Council have the capacity to ensure that this proposal issuccessfully implemented.38. The new <str<strong>on</strong>g>School</str<strong>on</strong>g> would be located <strong>on</strong> the same sites providing c<strong>on</strong>tinuityof relati<strong>on</strong>ships for both pupils <str<strong>on</strong>g>and</str<strong>on</strong>g> parents <str<strong>on</strong>g>and</str<strong>on</strong>g> has the potential to makebetter provisi<strong>on</strong> for the pupils <str<strong>on</strong>g>and</str<strong>on</strong>g> to raise st<str<strong>on</strong>g>and</str<strong>on</strong>g>ards. There is local support forthe proposals <str<strong>on</strong>g>and</str<strong>on</strong>g> the str<strong>on</strong>g likelihood that they will c<strong>on</strong>tribute to improvedst<str<strong>on</strong>g>and</str<strong>on</strong>g>ards <str<strong>on</strong>g>and</str<strong>on</strong>g> to the more efficient use of resources.39. In coming to my decisi<strong>on</strong> I have taken full account of thedocumentati<strong>on</strong> <str<strong>on</strong>g>and</str<strong>on</strong>g> informati<strong>on</strong> which I regard to be relevant <str<strong>on</strong>g>and</str<strong>on</strong>g> <strong>on</strong> the basisof the evidence submitted to me I am persuaded that there would be benefitsfor pupils <str<strong>on</strong>g>and</str<strong>on</strong>g> their families. I have therefore c<strong>on</strong>cluded that the proposal toclose the two existing schools <str<strong>on</strong>g>and</str<strong>on</strong>g> to establish a new community primaryschool <strong>on</strong> the same site should proceed as proposed.Determinati<strong>on</strong>40. Under powers c<strong>on</strong>ferred <strong>on</strong> me by paragraph 8 of Schedule 2 to theEducati<strong>on</strong> <str<strong>on</strong>g>and</str<strong>on</strong>g> Inspecti<strong>on</strong>s Act 2006, I hereby approve the proposals to<str<strong>on</strong>g>disc<strong>on</strong>tinue</str<strong>on</strong>g> <str<strong>on</strong>g>Wilthorpe</str<strong>on</strong>g> <str<strong>on</strong>g>Infant</str<strong>on</strong>g> <str<strong>on</strong>g>School</str<strong>on</strong>g> <str<strong>on</strong>g>and</str<strong>on</strong>g> <str<strong>on</strong>g>Wilthorpe</str<strong>on</strong>g> <str<strong>on</strong>g>Junior</str<strong>on</strong>g> <str<strong>on</strong>g>School</str<strong>on</strong>g> with effectfrom 31 December 2012 <str<strong>on</strong>g>and</str<strong>on</strong>g> to establish a new community school <strong>on</strong> the twoexisting sites with effect from 1 January 2013Signed:<str<strong>on</strong>g>School</str<strong>on</strong>g>s Adjudicator: Carol Pars<strong>on</strong>sDated: 28 June 2011
