THE INTERIM CONSTITUTION OF NEPAL, <strong>2063</strong> (<strong>2007</strong>)AS AMENDED BY THE FIRST TO SIXTH AMENDMENTS(2) No person shall, on the ground <strong>of</strong> caste or tribe, be deprived <strong>of</strong> the use <strong>of</strong> services,conveniences or utilities available to the public, or be denied access to any publicplace, or public religious places, or be prevented from performing any religious act.(3) No person belonging to any particular caste or tribe shall, in relation to the productionor making available <strong>of</strong> any goods, services or conveniences, be prevented frompurchasing or acquiring such goods, services or conveniences; and no such goods,services or conveniences shall be sold or distributed only to members <strong>of</strong> a particularcaste or tribe.(4) No one shall be allowed to purport to demonstrate superiority or inferiority <strong>of</strong> anyperson or a group <strong>of</strong> persons belonging to any caste, tribe or origin; or to justify socialdiscrimination on the basis <strong>of</strong> caste and tribe; or to disseminate ideas based on castesuperiority or hatred; or to encourage caste discrimination in any form.(5) Any act contrary to the provisions <strong>of</strong> clauses (2), (3) and (4) shall be punishable inaccordance with law.15. Rights regarding publication, broadcasting and press(1) <strong>The</strong>re shall be no prior censorship <strong>of</strong> publication and broadcasting or printing<strong>of</strong> any news item, editorial, article, feature or other reading or audio-visual materialby any means including electronic publication, broadcasting and the press.Provided that nothing shall be deemed to prevent the making <strong>of</strong> laws toimpose reasonable restrictions on any act which may undermine the sovereigntyor integrity <strong>of</strong> <strong>Nepal</strong>, or which may jeopardise the harmonious relations subsistingamong the peoples <strong>of</strong> various castes, tribes or communities; or on any act <strong>of</strong>sedition, defamation, contempt <strong>of</strong> court or incitement to an <strong>of</strong>fence; or on any actwhich may be contrary to decent public behaviour or morality.(2) If there is any broadcasting, publishing or printing <strong>of</strong> material using radio,television, online or other types <strong>of</strong> digital or electronic equipment or medium, nosuch equipment or medium shall be closed, seized or any registration cancelledbecause <strong>of</strong> such broadcasting, publication or printing.(3) No newspaper, periodical or press shall be closed or seized nor shall itsregistration be cancelled merely for printing or publishing any news items,articles, editorials, writings or other reading material.(4) No means <strong>of</strong> communication including the press, electronic broadcastingand telephone shall be obstructed except in accordance with law.68
