THE INTERIM CONSTITUTION OF NEPAL, <strong>2063</strong> (<strong>2007</strong>)AS AMENDED BY THE FIRST TO SIXTH AMENDMENTSPART 2CITIZENSHIP8. Citizenship at the commencement <strong>of</strong> the <strong>Constitution</strong>(1) Persons who have citizenship at the commencement <strong>of</strong> this <strong>Constitution</strong>and persons who are eligible to acquire citizenship by virtue <strong>of</strong> the provisions<strong>of</strong> this Part shall be the citizens <strong>of</strong> <strong>Nepal</strong>.(2) At the commencement <strong>of</strong> this <strong>Constitution</strong>, the following persons whohave their domicile in <strong>Nepal</strong> shall be deemed to be citizens <strong>of</strong> <strong>Nepal</strong> by descent(a) a person who has acquired citizenship by descent before thecommencement <strong>of</strong> this <strong>Constitution</strong>, and(b) any person whose father or mother was a citizen <strong>of</strong> <strong>Nepal</strong> at the birth <strong>of</strong>such person.(3) Any child who is found within the territory <strong>of</strong> <strong>Nepal</strong> and whose parents arenot known shall, until the father or mother <strong>of</strong> the child is traced, be deemed tobe a citizen <strong>of</strong> <strong>Nepal</strong> by descent.(4) Whenever any territory is acquired by way <strong>of</strong> merger into <strong>Nepal</strong>, everyperson having his domicile within such territory shall become a citizen <strong>of</strong><strong>Nepal</strong>, as provided for by the existing law.(5) Any person born and living permanently in <strong>Nepal</strong> before the end <strong>of</strong> Chaitra,2046 (mid April, 1990) shall acquire the citizenship <strong>of</strong> <strong>Nepal</strong> by birth inaccordance with the existing law.Provided that application to that effect shall be submitted once inaccordance with existing laws within the prescribed timeframe.(6) A woman <strong>of</strong> foreign nationality who is married to a <strong>Nepal</strong>i citizen mayacquire naturalized citizenship, if she desires to do so, as provided for by theexisting law.60
