THE INTERIM CONSTITUTION OF NEPAL, <strong>2063</strong> (<strong>2007</strong>)AS AMENDED BY THE FIRST TO SIXTH AMENDMENTSAGREEMENT ON MONITORING OF THEMANAGEMENT OF ARMS AND ARMIES8 DECEMBER 2006PreambleIn keeping with the letters to the United Nations (UN) Secretary-General <strong>of</strong> 9August and the Comprehensive Peace Accord <strong>of</strong> 21 November 2006;Guaranteeing the fundamental right <strong>of</strong> the <strong>Nepal</strong>i people to take part in theconstituent assembly elections in a free and fair environment without fear;Declaring the beginning <strong>of</strong> a new chapter <strong>of</strong> peaceful democratic interactionby ending the armed conflict taking place in the country since 1996, based onthe Comprehensive Peace Accord between the two parties in order toaccomplish, through the constituent assembly, certainty <strong>of</strong> sovereignty <strong>of</strong> the<strong>Nepal</strong>i people, progressive political outlet [solution], democratic restructuring<strong>of</strong> the state, and socio-economic-cultural transformation; and,Affirming the will to fully observe the terms <strong>of</strong> this bilateral agreement witnessedby the United Nations<strong>The</strong> parties agree to seek UN assistance in monitoring the management <strong>of</strong> thearms and armies <strong>of</strong> both sides by the deployment <strong>of</strong> qualified UN civilianpersonnel to monitor, according to international norms, the confinement <strong>of</strong>Maoist army combatants and their weapons within designated cantonmentareas and monitor the <strong>Nepal</strong> Army (NA) to ensure that it remains in its barracksand its weapons are not used against any side.1. Modalities <strong>of</strong> the Agreement1.1 PrinciplesNeither <strong>of</strong> the parties shall engage in movement or redeployment <strong>of</strong> forces resultingin tactical or strategic advantage.304
