THE INTERIM CONSTITUTION OF NEPAL, <strong>2063</strong> (<strong>2007</strong>)AS AMENDED BY THE FIRST TO SIXTH AMENDMENTS7. Observance <strong>of</strong> Human Rights, Fundamental Rights and HumanitarianLawRemaining committed to the Universal Declaration <strong>of</strong> Human Rights, 1948,international humanitarian law and fundamental principles and norms concerninghuman rights, both sides express their consent to the following issues-7.1. Human Rights7.1.1. Both sides reconfirm their commitment to the respect and protection <strong>of</strong>human rights and commitment to the international humanitarian law andaccept that nobody shall be discriminated on the basis <strong>of</strong> colour, gender,language, religion, age, race, national or social origin, wealth, disability, birthor any other status, opinion or faith.7.1.2. Both sides agree to create an atmosphere for the <strong>Nepal</strong>i people to enjoytheir civil, political, economic, social and cultural rights and are committed tocreate an atmosphere where such rights are not violated in the future underany condition.7.1.3. Both sides express the commitment that impartial investigation and actionshall be carried out in accordance with law against the persons responsible forcreating obstructions to exercise the rights stated in the Accord and ensure thatimpunity shall not be encouraged. Apart from this, they also ensure the rights<strong>of</strong> the victims <strong>of</strong> conflict and torture and the rights <strong>of</strong> the family <strong>of</strong> disappearedpersons to obtain relief.7.1.4. Both sides shall not carry out acts <strong>of</strong> torture, kidnapping and forced laboragainst the public in general and shall also take necessary action to discouragesuch acts.7.1.5. Both sides shall, on the basis <strong>of</strong> norms and values <strong>of</strong> secularism, respectsocial, cultural and religious sensitivity, religious sites and the religious faith<strong>of</strong> individuals.7.2. Right to Life7.2.1. Both sides respect and protect an individual's fundamental right to life.No one shall be deprived <strong>of</strong> this fundamental right and no law shall be madethat provides for capital punishment.292
