THE INTERIM CONSTITUTION OF NEPAL, <strong>2063</strong> (<strong>2007</strong>)AS AMENDED BY THE FIRST TO SIXTH AMENDMENTS160. Provisions regarding the Council <strong>of</strong> Ministers(1) <strong>The</strong> Council <strong>of</strong> Ministers existing at the time <strong>of</strong> the commencement <strong>of</strong> this<strong>Constitution</strong> shall be deemed to have been constituted under this <strong>Constitution</strong>.(2) <strong>The</strong> Council <strong>of</strong> Ministers constituted pursuant to clause (1), shall continueto work until the Council <strong>of</strong> Ministers is constituted under Article 38.161. Provisions regarding the Legislature-Parliament(1) Immediately after the commencement <strong>of</strong> this <strong>Constitution</strong>, the Legislature-Parliament shall be constituted under this <strong>Constitution</strong>.(2) After the commencement <strong>of</strong> this <strong>Constitution</strong>, the existing House <strong>of</strong>Representatives and the National Assembly shall ipso facto be dissolved, andthe first meeting <strong>of</strong> the Legislature-Parliament under this <strong>Constitution</strong> shallconvene on the same day.(3) Bills that were under consideration in the House <strong>of</strong> Representatives at thetime <strong>of</strong> the commencement <strong>of</strong> this <strong>Constitution</strong> shall be transferred to theLegislature-Parliament under this <strong>Constitution</strong>.(4) <strong>The</strong> Parliament Secretariat and <strong>of</strong>ficials and the staff working in theSecretariat at the time <strong>of</strong> the commencement <strong>of</strong> this <strong>Constitution</strong> shall be deemedto be the Secretariat <strong>of</strong> the Legislature-Parliament and the <strong>of</strong>ficials and staff <strong>of</strong>the Secretariat shall be deemed to have been appointed under this <strong>Constitution</strong>.162. Provisions regarding the Judiciary(1) <strong>The</strong> Supreme Court, Appellate Court and District Courts subsisting at thetime <strong>of</strong> the commencement <strong>of</strong> this <strong>Constitution</strong> shall be deemed to have beenconstituted under this <strong>Constitution</strong>, and this <strong>Constitution</strong> shall not hinder themaking <strong>of</strong> the decisions by the concerned courts on cases filed prior to thecommencement <strong>of</strong> this <strong>Constitution</strong>.(2) <strong>The</strong> Judges working in the Supreme Court, Appellate Courts and DistrictCourts, after the commencement <strong>of</strong> this <strong>Constitution</strong>, shall take an oath <strong>of</strong>commitment to this <strong>Constitution</strong> as determined by the Government <strong>of</strong> <strong>Nepal</strong>.Any Judge who declines to take the oath shall ipso facto cease to hold <strong>of</strong>fice.(3) Necessary legal arrangements shall be made on the basis <strong>of</strong> democraticnorms and values to bring about gradual reforms in the judicial sector to makeit independent, clean, impartial and competent.252
