THE INTERIM CONSTITUTION OF NEPAL, <strong>2063</strong> (<strong>2007</strong>)AS AMENDED BY THE FIRST TO SIXTH AMENDMENTSPART 22MISCELLANEOUS149. <strong>Constitution</strong>al Council(1) <strong>The</strong>re shall be a <strong>Constitution</strong>al Council for making recommendations inaccordance with this <strong>Constitution</strong> for appointment <strong>of</strong> <strong>of</strong>ficials to <strong>Constitution</strong>alBodies, which shall consist <strong>of</strong> the Chairperson and members as follows(a) Prime Minister - Chairperson(b) Chief Justice - Member(c) Speaker <strong>of</strong> the Legislature-Parliament - Member#(d) Three ministers designated by the Prime Ministerrepresenting three different political parties inthe Council <strong>of</strong> Ministers- MemberProvided that if there are fewer than three political parties represented in theCouncil <strong>of</strong> Ministers the designation <strong>of</strong> the representation <strong>of</strong> less than threeparties shall not be barred.##(e) Leader <strong>of</strong> the opposition party in the Legislature- Parliament - Member(2) When the position <strong>of</strong> the Chief Justice falls vacant and a recommendationhas to be made for the same, the Minister for Justice shall be present in the<strong>Constitution</strong>al Council as a member.(3) <strong>The</strong> procedures regarding the appointment <strong>of</strong> the <strong>of</strong>ficials <strong>of</strong> the<strong>Constitution</strong>al Bodies, and the functions, duties, powers and workingprocedures <strong>of</strong> the <strong>Constitution</strong>al Council shall be as determined by the law.(4) <strong>The</strong> Chief Secretary <strong>of</strong> the Government <strong>of</strong> <strong>Nepal</strong> shall work as the Secretary<strong>of</strong> the <strong>Constitution</strong>al Council.150. <strong>Nepal</strong>i ambassadors and emissaries*<strong>The</strong> President on the recommendation <strong>of</strong> the Council <strong>of</strong> Ministersmay appoint ambassadors <strong>of</strong> <strong>Nepal</strong> and other emissaries for specifiedpurposes.236# Amended on 2065 Ashad 28 (July 12, 2008) by the <strong>Interim</strong> <strong>Constitution</strong> <strong>of</strong> <strong>Nepal</strong> (FifthAmendment) Act,, 2065.
