THE INTERIM CONSTITUTION OF NEPAL, <strong>2063</strong> (<strong>2007</strong>)AS AMENDED BY THE FIRST TO SIXTH AMENDMENTSPART 20PROVISIONS REGARDING THE ARMY144. Formation <strong>of</strong> the <strong>Nepal</strong> Army(1) <strong>The</strong>re shall be an institution <strong>of</strong> the <strong>Nepal</strong> Army in <strong>Nepal</strong>.*(1A) <strong>The</strong> president shall be the Supreme Commander <strong>of</strong> the <strong>Nepal</strong> Army.(2) **<strong>The</strong> President on the recommendation <strong>of</strong> the Council <strong>of</strong> Ministers shallappoint the Commander-in-Chief <strong>of</strong> the <strong>Nepal</strong> Army.(3) ***<strong>The</strong> President on the recommendation <strong>of</strong> the Council <strong>of</strong> Ministers shallcontrol, mobilize and manage the <strong>Nepal</strong> Army in accordance with the law.<strong>The</strong> Council <strong>of</strong> Ministers shall, with the consent <strong>of</strong> the political parties and byseeking the advice <strong>of</strong> the concerned committee <strong>of</strong> the Legislature-Parliament,formulate an extensive work plan for the democratization <strong>of</strong> the <strong>Nepal</strong> Armyand implement it.(4) In the case <strong>of</strong> formulating and implementing the action plan pursuant toclause (3), determination <strong>of</strong> the appropriate number <strong>of</strong> the <strong>Nepal</strong> Army, itsdemocratic structure and national and inclusive character shall be developed,and training shall be imparted to the army in accordance with the norms andvalues <strong>of</strong> democracy and human rights.#(4A) In order to give the <strong>Nepal</strong> Army a national character and make it inclusive,enlisting <strong>of</strong> Madhesi, indigenous ethnic groups, Dalits, women, and people frombackward regions into the armed forces on the basis <strong>of</strong> the principles <strong>of</strong> equalityand inclusiveness shall be ensured by law.(5) Other matters pertaining to the <strong>Nepal</strong> Army shall be as provided for in the law.228*Added on 2065 Jestha 15 (May 28, 2008) by the <strong>Interim</strong> <strong>Constitution</strong> <strong>of</strong> <strong>Nepal</strong> (Fourth Amendment) Act, 2065.**Amended on 2065 Jestha 15 (May 28, 2008) by the <strong>Interim</strong> <strong>Constitution</strong> <strong>of</strong> <strong>Nepal</strong> (Fourth Amendment) Act, 2065.
