THE INTERIM CONSTITUTION OF NEPAL, <strong>2063</strong> (<strong>2007</strong>)AS AMENDED BY THE FIRST TO SIXTH AMENDMENTS#(2) <strong>The</strong> Government <strong>of</strong> <strong>Nepal</strong> shall form district, municipal, andvillage level interim bodies with the participation and consensus <strong>of</strong>political parties active at the local level to operate until elections forthe local bodies are held.Explanation: For the purpose <strong>of</strong> this Clause “Political parties activeat the local level" means parties represented in the ConstituentAssembly and the political parties that fielded candidacy in theirrespective districts in the first-past-the post elections to the Assembly.(3) <strong>The</strong> organizational structure, forms and territorial boundaries as well asthe process <strong>of</strong> formation <strong>of</strong> the local self governance bodies shall be as providedfor in the law.140. Mobilization and management <strong>of</strong> revenue(1) In order to make the local bodies engaged in local self governance morecompetent by mobilising and allocating resources, and maintaining anequitable and judicious balance in the distribution <strong>of</strong> the fruits <strong>of</strong> development,and to make the local bodies accountable in recognising, formulating andimplementing local level projects, there shall be sharing <strong>of</strong> accountabilitiesand revenues between the Government <strong>of</strong> <strong>Nepal</strong> and local self governancebodies according to the provisions in the law.(2) While mobilizing and sharing revenues pursuant to clause (1) specialconsideration should be given to balanced and uniform development, and thetotal advancement <strong>of</strong> socially and economically backward classes andcommunities.218# Amended on 2065 Ashad 28 (July 12, 2008) by the <strong>Interim</strong> <strong>Constitution</strong> <strong>of</strong> <strong>Nepal</strong> (FifthAmendment) Act, 2065. Originallyread: (2) <strong>Interim</strong> local bodies shall be constituted at the District, Municipality and Village level by consensus among allconsenting parties to the agreement reached on the 22nd day <strong>of</strong> Kartik <strong>2063</strong> BS (November 7, 2006) between <strong>Nepal</strong>i Congress,<strong>Nepal</strong> Communist Party (UML), § Jana Morcha <strong>Nepal</strong>, <strong>Nepal</strong> Sadhbhavana party (Anandidevi), <strong>Nepal</strong> Majdur Kishan partyand United Left Front along with the <strong>Nepal</strong> Communist Party (Maoist).§<strong>The</strong> words <strong>Nepal</strong>i Congress (Democratic) were deleted on 2064 Paush 13 (28 December <strong>2007</strong>) by the <strong>Interim</strong> <strong>Constitution</strong><strong>of</strong> <strong>Nepal</strong> (Third Amendment)
