THE INTERIM CONSTITUTION OF NEPAL, <strong>2063</strong> (<strong>2007</strong>)AS AMENDED BY THE FIRST TO SIXTH AMENDMENTSPART 15NATIONAL HUMAN RIGHTS COMMISSION131. National Human Rights Commission(1) <strong>The</strong>re shall be a National Human Rights Commission in <strong>Nepal</strong> consisting <strong>of</strong>the following Chairperson and members(a) a person from among the retired Chief Justices or Judges <strong>of</strong> theSupreme Court who has made an outstanding contributionto the protection and promotion <strong>of</strong> human rights, or a personwho holds a high reputation and has rendered outstandingcontribution being actively involved in the field <strong>of</strong> protectionand promotion <strong>of</strong> human rights or social work.(b) four persons from among those who have made outstandingcontribution, by being actively involved in the field <strong>of</strong>protection and promotion <strong>of</strong> human rights or social work.- Chairperson- Members(2) While appointing the chairperson and members <strong>of</strong> the National HumanRights Commission, diversity, including gender diversity, must be maintained.(3) *<strong>The</strong> President shall, on the recommendation <strong>of</strong> the <strong>Constitution</strong>al Council,appoint the Chairperson and the Members <strong>of</strong> the National Human RightsCommission.(4) <strong>The</strong> term <strong>of</strong> the <strong>of</strong>fice <strong>of</strong> the Chairperson and the members <strong>of</strong> the NationalHuman Rights Commission shall be six years from the date <strong>of</strong> appointment.Provided that the Chairperson and the members <strong>of</strong> the National HumanRights Commission may be removed from his/her <strong>of</strong>fice on the same ground and inthe same manner as has been set out for removal <strong>of</strong> a Judge <strong>of</strong> the Supreme Court.(5) <strong>The</strong> <strong>of</strong>fice <strong>of</strong> the Chairperson and the members <strong>of</strong> the National HumanRights Commission shall be deemed vacant in the following circumstances(a) if he/she submits a written resignation **to the President,(b) if pursuant to clause (4) his/her term expires or he/she is removedfrom his/her <strong>of</strong>fice,(c) if he/she dies.204*Amended on 2065 Jestha 15 (May 28, 2008) by the <strong>Interim</strong> <strong>Constitution</strong> <strong>of</strong> <strong>Nepal</strong> (Fourth Amendment) Act, 2065.
