THE INTERIM CONSTITUTION OF NEPAL, 2063 (2007)AS AMENDED BY THE FIRST TO SIXTH AMENDMENTS113. Judicial Council(1) There shall be a Judicial Council to make recommendations and give advicein accordance with this Constitution concerning the appointment of, transfer of,disciplinary action against, and dismissal of Judges, and other matters relatingto judicial administration, which shall consist of the following as its Chairpersonand members:-a) The Chief Justice – Chairpersonb) The Minister of Justice – Memberc) Senior-most Judge of the Supreme Court – Member#(d) A legal expert nominated by the President on therecommendation of the Prime Ministere) A senior advocate, or an advocatewho has at least twenty years experienceto be appointed by the Chief Justice on therecommendation of the Nepal Bar Association- Member– MemberExplanation: For the purpose of this article, the word "Minister" shall alsoinclude a Minister of State for Justice with an independent portfolio(2) The term of office of the members referred to in sub-clauses (c) and (d) of clause(1), shall be four years and their remuneration and privileges shall be the same asthose of a Judge of the Supreme Court.(3) The members referred to in sub-clause (c) and (d) of clause (1) above, may beremoved from office on the same grounds and in the same manner as providedfor the removal of a Judge of the Supreme Court.(4) The Chairperson and members of the Judicial Council may obtain and studythe documents and files of a case related to any complaint lodged against ajudge, and may furnish information thereon to the Judicial Council.(5) The Judicial Council may, while carrying out preliminary investigation of acomplaint received against a judge, constitute a Committee of Inquiry, if it hasdetermined that a detailed investigation by an expert is required.(6) The other functions, duties and powers of the Judicial Council shall be asdetermined by law.172#Amended on 2065 Ashad 28 (July 12, 2008) by the Interim Constitution of Nepal (FifthAmendment) Act, 2065.
