THE INTERIM CONSTITUTION OF NEPAL, <strong>2063</strong> (<strong>2007</strong>)AS AMENDED BY THE FIRST TO SIXTH AMENDMENTS(5) Other powers and procedures <strong>of</strong> the Supreme Court shall be as prescribedby law.108. Establishment, management and jurisdiction <strong>of</strong> Appellate Courts andDistrict Courts<strong>The</strong> establishment and operation <strong>of</strong> the Appellate Courts, District Courts andother courts and judicial entities subordinate to the Supreme Court shall,subject to this <strong>Constitution</strong>, be as determined by law.109. Appointment, qualifications and conditions <strong>of</strong> service and privileges<strong>of</strong> the Judges <strong>of</strong> Appellate Courts and Districts Courts(1) <strong>The</strong> Chief Justice shall, on the recommendation <strong>of</strong> the Judicial Council,appoint the Chief Judge and Judges <strong>of</strong> the Appellate Courts and Judges <strong>of</strong> theDistrict Courts.(2) Any <strong>Nepal</strong>i citizen who has a Bachelor's Degree in law and has worked asa District Judge or worked in any post <strong>of</strong> gazetted first class <strong>of</strong>ficer <strong>of</strong> the JudicialService for a period <strong>of</strong> at least seven years; or has a Bachelors Degree in law andhas practiced as a senior advocate or advocate for at least ten years; or, for atleast 10 years, has either taught law or conducted research thereon or workedin any other field <strong>of</strong> law or justice shall be considered eligible for appointmentas Chief Judge or other Judge <strong>of</strong> an Appellate Court.(3) Any <strong>Nepal</strong>i citizen who has a Bachelor's Degree in law and has worked forat least three years as a gazetted second class <strong>of</strong>ficer in the Judicial Service, orhas practiced law for at least eight years as an advocate after having obtaineda Bachelor's Degree in law, is eligible for appointment as a District Judge.(4) A person who is an advocate with a Bachelor's Degree in law and haspassed the written and oral examination conducted by the Judicial Councilmay be appointed to the post <strong>of</strong> the District Judge pursuant to clause (3). Suchexamination system and procedures shall be prescribed by law.(5) For the appointment to the post <strong>of</strong> judge <strong>of</strong> the Appellate Court and theDistrict Court the Judicial Council shall consider, inter alia, the qualifications,capacity, experience, dedication and contribution to justice, reputation earnedin public life and high moral character <strong>of</strong> a person and make recommendationsaccordingly.166
