THE INTERIM CONSTITUTION OF NEPAL, 2063 (2007)AS AMENDED BY THE FIRST TO SIXTH AMENDMENTS(7) For the purpose of this Article a decision made during voting on the Preambleor any Article of the Bill relating to the Constitution introduced in theConstituent Assembly shall be deemed to be unanimous if none of the membersvoted against the Preamble or Article that is the subject of the vote.71. Chairperson and Vice Chairperson of the Constituent Assembly(1) The Constituent Assembly shall elect a Chairperson and a Vice Chairperson#from among its members on the basis of political consensus before thecommencement of its work of formulating the Constitution.##(1A) In the case when consensus is not reached pursuant to Clause (1) a memberof the Constituent Assembly who receives the majority of the votes of the totalmembers of the Constituent Assembly present shall be considered elected to theposition of the Chairperson or the Vice-Chairperson of the Constituent Assembly.(2) In the elections ### pursuant to clause (1) or clause (1A) the Chairperson andVice Chairperson shall be from different political parties represented in theConstituent Assembly.(3) If the election of the Chairperson and Vice Chairperson has not taken placepursuant to clause (1), the senior-most member of the Constituent Assemblyby age shall preside over the meeting of the Assembly.(4)The Chairperson and Vice Chairperson shall act as neutral persons and notfavour any political party or parties while performing their duties in accordancewith this Constitution.72. Vacation of the office of Chairperson and Vice Chairperson(1) The office of the Chairperson and Vice Chairperson shall become vacant inthe following circumstancesa) if he/she submits a written resignation,b) if he/she ceases to be a member of the Constituent Assembly,c) if a resolution is passed by a majority of at least two-thirds of the totalnumber of the members in the Constituent Assembly to the effect that hisor her conduct is not compatible with his or her position, ord) if he/she dies.134# Amended on 2065 Ashad 28 (July 12, 2008) by the Interim Constitution of Nepal (FifthAmendment) Act, 2065.
